Federal Court Sides With Grassroots Activists: RNC Delegates Are Bound to Follow Election Results

Delegates Remain Committed to Donald J. Trump; Anti-Trump Effort Dealt Crippling Blow

(New York) July 11, 2016 – Senior United States District Judge Robert E. Payne today ruled in favor of Trump campaign delegates who had argued – in line with overwhelming public opinion – that RNC delegates must follow election results and that delegates cannot be stolen at the national convention. Delegate Beau Correll, Jr., had brought the suit against the Commonwealth of Virginia hoping to reject the will of the voters, but was soundly defeated.

Specifically, the Court found that RNC Rule 16, which binds delegates based on their election results, “is in effect presently and that it controls the allocation and binding of delegates as to their voting at convention.” (p. 6) The Court held that the Plaintiff’s “expert testimony” from Erling ‘Curly’ Haugland was not credible, lacked “textual support,” (p.6) and that “delegates are bound by RNC Rule 16.” (p. 7)

Further, the Court found that by signing the “Declaration and Statement of Qualification,” RNC delegates are bound by RNC Rule 16(c)(2) (p. 10), and that this Declaration obligated Correll to vote in accordance with Republican Party rules and Virginia’s election results. (p. 46)

Trump Campaign Attorney and former FEC Chairman Don McGahn issued the following statement:

"The court has confirmed what we have said all along: Rule 16 is in effect and thus delegates, including Correll, are bound to vote in accordance with the election results. The court did not buy what Curly Haugland was selling, and noted that his testimony has no support in the rule's text and was contradicted by his own book, Unbound. This case puts his unbound theory to rest, and is a fatal blow to the Anti-Trump agitators.”

What about this earlier news of the ruling, which said the opposite? Was there a new ruling which invalidated the earlier one or what is going on?

This is an update to the prior Post where the Judge Struck the Virgina law.
The Ruling not only had no effect on National and State Party Rules the Judge ruled delegates were required to follows the RNC rules on bound delegates.
I see the problem Mechanicos,  

The PRIOR POST which was wrong, is STILL LISTED under BREAKING NEWS, and FRONT PAGE NEWS, 
while THIS POST which corrects THAT post was in neither.

SO the vast majority of FR readers, were seeing ONLY THAT post, but NOT THIS ONE.

Maybe the Admin Moderator would be so kind, to please REMOVE topics: "Front Page" and "Breaking" 
from the other post??
The OTHER POST was titled... "Federal Court Blocks Virgina Delegate Rule (PDF)"

I posted both threads. The initial thread was as it happened and was on an anti-Trump site. That was their opinion. After reading it and then seeing Trump’s press release on it I posted the other thread showing only the State Statute for winner take all was struck down and the State Party and National was still binding the delegates to vote proportional. So Initial thread was in error saying unbound. They were only unbound from voting winner take all in VA but still bound to vote proportional.

I truly do not get that mindset at all. The man lost. He’s out of the running. He officially stepped out of the race months ago, when it became apparent to any and everyone (except die hard Cruzers), that it was the end of the line for him.

Clinging to some mystical hope that this guy can somehow overturn the will of millions of voters at the convention, and somehow go on to win the election, is simply fantasy. It’s un-American, as well.

This is cult-think on steroids.

Yeah, pretty much. I'm thinking the sane ones will have gotten wise to him by November, if he can survive the convention, that is. But for the public people who are NeverTrumpers, I'm done with them. Me and 14 million other people. lol.

There was even more wrong with the state law than I thought. Barring proportional voting? Not the business of the state.

The State can pass any law it deems proper regarding voting. Especially in primaries—it is not a Federal issue.

As long as one party is not treated differently or favored, there is no issue.

The Constitution even awards states in the Electoral College based on the popular vote, not proportional voting, unless a State has passed a law allowing the awarding the of electoral college votes based on winning individual Congressional districts.

The legal arguments presented by Correll for the Counts I and II are bogus, and the Court played along.

I am extremely wary of this ruling, which is an extra-constitutional farce. The back room dealers are just getting warmed up, I think.

Rule 16 is in force until the rules for 2016 are voted on by the Convention.

The Rules Committee could present a modified Rule 16, and if the Convention approves, the Rule is modified for the 2016 Convention.

The “firewall” of Rule 16 is not absolute.

As long as the 2016 Rules Committee doesn’t screw with it, we will be OK.

Nevertheless, my opinion is that the entire case, and the Court’s opinion, is the weakest of sauces.
