Freddie Gray case: Judge acquits Lt. Brian Rice of all charges

Prosecutors in Baltimore have failed for the fourth time to secure a conviction in the Freddie Gray case, with Circuit Judge Barry Williams acquitting Lt. Brian Rice of all charges related to Gray's arrest and death.

Williams cleared Rice, 42, of involuntary manslaughter, reckless endangerment and misconduct in office in a downtown Baltimore courtroom on Monday morning. The judge had dismissed a second-degree assault charge at the trial's midpoint, and prosecutors dropped a second misconduct charge at the start.

Rice selected a bench trial rather than a jury trial, putting his legal fate in Williams' hands. He was was fourth of six officers charged in the case to go to trial.

Williams previously acquitted two other officers — Edward Nero and Caesar Goodson Jr. — of all charges in May and June, respectively. A fourth officer, William Porter, had a mistrial in December after a 12-member jury could not reach a consensus on any of the charges against him.

Rice's acquittal is likely to renew calls for Baltimore State's Attorney Marilyn J. Mosby to drop the remaining charges in the case, including from the union that represents the city's rank-and-file officers.

I guess I dont understand this case. I mean the dude ends up dead from a broken spine and no one is to blame??

IIRC, Witnesses said that the guy was throwing himself around in the back of the van, trying to injure himself, likely looking for a lawsuit.

It worked, a little too well.

BALTIMORE (WJZ) — Baltimore City State’s Attorney Marilyn Mosby has been under fire. Now she could potentially face being disbarred, WJZ’s Meghan McCorkell reports.

A new complaint filed with the Maryland Bar Counsel calls Mosby “a runaway prosecutor” and alleges she violated ethics rules, claiming she never had probable cause to charge six officers in the death of Freddie Gray.

“I think Marilyn Mosby has harmed the city of Baltimore. And if she continues, that harm will get worse,” said law professor John Banzhaf, George Washington University.

Banzhaf, who filed the complaint, accuses Mosby of only filing charges to stop the unrest in Baltimore.

“I heard your call for ‘No justice, no peace.’ Your peace is sincerely needed as I work to deliver justice on behalf of this young man,” Mosby said in May of 2015.

Banzhaf’s complaint calls Mosby’s words a “misuse of her role” and a “perversion of her office.”

“It’s a crime, it’s unethical to indict somebody simply because it will quell the thirst of a rioting mob,” he said.

Judging by the videos I’ve seen on Youtube it looked like he was faking injury before he ever got in the van.

Not at all. Your hands are cuffed behind you. The vehicle is stopped at a red light. You stand up, facing the rear of the vehicle. You are bent over because the vehicle is not tall enough for you to stand upright. The light changes to green and the driver starts through the intersection. You lose your balance and fall head first into the rear door of the vehicle.

Sounds to me very much like a typical paralyzing neck injury that happens to football players who don’t tackle properly.

There is all sorts of evidence that Freddie Gray was moving about inside the vehicle in just this sort of manner. In any case, there is enough “reasonable doubt” as to the officers’ intentions and actions to acquit all of them.

This is why the prosecutors had no possible hope of conviction. The scenario I proposed is, by definition, "reasonable doubt," backed up by any passenger who has ever been injured on a bus or subway when the vehicle accelerated from a stop. Any defense lawyer worth his salt would have been able to make that case. If I had been on a jury trying one of these cases, I would have made that argument myself as I held out for acquittal.

It was admitted by all parties that Freddie Gray was not seatbelted, despite a policy issued just days before the incident. The reason given is that he was combative and it was dangerous to seatbelt him in the confines of the paddy wagon.

How is it more dangerous to not belt him in vs belting him in?? seems if he is belted he couldnt move much.

No! You missed the point.

These outcomes are due to institutional racism against her. The fact that she lost four times and won none is proof alone. Anybody that attacks her is a racist, sexist, misogynist that needs to check their privilege!
