Former US Attorney (Joseph DiGenova) Says FBI Director Comey Should Resign

FBI Director James Comey should resign, according to former U.S. Attorney Joseph DiGenova, after giving immunity deals to Hillary Clinton’s chief of staff Cheryl Mills and four other aides in the investigation over the former Secretary of State’s use of a private email server for government business.

Matthew Whittaker, another former federal attorney, told The Daily Caller News Foundation that Congress should know why the Clinton aides were “treated differently than any other investigation has ever been done.”

Mills got the immunity deal after refusing to let investigators examiner her computer, according to the Associated Press, ..

“This now gets to the point of a serious question as to the director’s fitness for office,” DiGenova told TheDCNF. He said a grand jury should have been convened and they should have issued a subpoena for Mills’ computer.

“You go to a federal judge, you get a grand jury subpoena and you fight that out. He didn’t want to do that. And neither did the Justice Department,” DiGenova said.

“The contours of this investigation are so embarrassing to the FBI because it is now clear that they immunized people who had criminal exposure and did not conduct a proper investigation before they gave immunity,” he said.

DiGenova called for Congress to hold hearings with Comey testifying under oath and to consider sanctions such as censorship or impeachment, although he doubted that Congress would impeach the director. A hearing is scheduled for Sept. 28, 2016, before the House Judiciary Committee.

“This was not a real investigation,” added DiGenova. “This was a ‘protected investigation’ designed to look like an investigation.” He called it a “politically corrupt investigation.”

“I think it’s an appropriate role of Congress to ask why this group of Clinton people was treated differently than any other investigation has ever been done,” he said.

DiGenova also said he was surprised that given her immunity, the FBI allowed Mills to attend Hillary Clinton’s interview at FBI Headquarters.

“Not only was she given immunity, but she attended Hillary Clinton’s interview. It is the first time in history that an immunized witness has attended an interview of the ultimate target of an investigation. This is one of the single most embarrassing moments in the history of the FBI,” DiGenova said.

DiGenova was the U.S. Attorney for the District of Columbia and also served as the Independent Counsel in the Clinton’s passport case. Whitaker was the U.S. Attorney for the Southern District of Iowa.

I agree with DiGenova’s premise here, but I also remember that for months he was telling everyone (he has a weekly spiel on Washington’s WMAL) that Comey was so damn upright that when the investigation was through he would recommend indictment and that he knew that if there was no indictment his agents would be screaming in protest and resigning. He was the most upright guy in government; total integrity; blah, blah, blah.

Then we saw what Comey really was, - another crooked political hack who was positioning himself for a high level appointment in a Clinton administration.

There are no honest people left in government (OK, maybe a Jeff Sessions). We have lost our country, and except for Trump, there is no white knight out in the wings ready to rescue us. A Clinton presidency will turn us into a Venezuela. Start saving your toilet paper.

I agree with DiGenova’s premise here, but I also remember that for months he was telling everyone (he has a weekly spiel on Washington’s WMAL) that Comey was so damn upright that when the investigation was through he would recommend indictment and that he knew that if there was no indictment his agents would be screaming in protest and resigning. He was the most upright guy in government; total integrity; blah, blah, blah.


DiGenova maintained that spiel from January through about late April. Then suddenly he said Comey was not going to indict. Joe knew it months before Comey made it public.

Joe also says that there is now a grand jury active in the southern district of NY looking into the foundation. Though nothing will happen before the election.

Which makes his indictment now all the more important and damning.

He was a fan of Comey. And now he calls on him to resign.

It is an almost inviolable rule that no government employee will “resign” over their principles.

None.

Almost all went into government service because of the gold-plated retirement/medical benefits. When it comes down to it, they will do what’s in their own self-interest every time.

I think gallows may be a step too far, but maybe he should serve a prison term equal to the combined times served behind bars of the major Watergate figures.

L. Patrick Gray tarnished the reputation of the FBI during the Watergate scandal but Gray seems to have been mainly gullible and in over his head rather than corrupt--and he never was indicted for his actions during Watergate.

Comey's actions are far worse.

No, when he tweets out “YOU’RE INDICTED!” He should be investigated to see if he had any financial purpose in his decision as I heard he has some involvement in the Clinton money laundering foundation.

Congress should impeach tyrants, but this would not prevent pardons.

The House might manage to impeach him with a simple majority, but then he’s still able to pardon during the senate impeachment trial.

And you need some democrat senators to cross the aisle to remove him during the senate impeachment vote — a 2/3 super majority.
