How can you pardon someone who hasn’t been charged?

Not only will 0bama do it, he will mirror the language used by Gerald Ford in the Nixon pardon, then remind us all that Ford was a Republican.

The gall of the ‘Rats never ceases to amaze.

Siccing Lois Lerner the IRS on the tea party was using power to exact political revenge.

Prosecuting corrupt public officials is not.

Can one be pardoned from a crime they have not been charged with yet? How does that work?

Oh, Trump wouldn’t be doing it to ‘exact revenge on his political opponent’. He would be doing it BECAUSE SHE BROKE THE LAWS OF OUR COUNTRY.......MANY TIMES OVER. If Trump is going to stand up for the Laws of this country, he had better bring her up on charges!

HOW can he give her a pardon if there is no indictment or case that has been brought up against her. FBI director should have opened a case, brining her to court,,.THEN a pardon could be rendered. The ball now is in the court of Donald J. Trump.

Vice president Biden mentioned that he wanted to have a “show trial” for GWB. That was the term he used. That would have been political prosecution. What Hillary did was criminal. Plain and simple. Anyone else would have gone to prison.

I believe her lawyers would suggest a defense of diminished capacity as she almost certainly has suffered from Parkinsons for at least eight years. She could probably be declared incompetent right now.

He can’t pardon her for federal crimes she has yet to commit.

As long as they can keep a breath in her, she will continue to be corrupt and unlawful.

Hopefully, Trump will put someone in the IRS to give the Clinton Foundation a royal enema.

Pardon for what? Doesn’t it imply that there is an admission of guilt before a pardon is necessary. No “intent”, therefore, no guilt is what the public has been told.

He is America-hating trash. He will do EVERYTHING he can to p@ss all over America and the citizens who threw his criminal, corrupt, Marxist party out of the White House and out of commission for a long time to come.

Pure filth. Expect anything.

Here is the problem facing Obama and Hillary here:

https://www.law.cornell.edu/uscode/text/18/793

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—
Shall be fined under this title or imprisoned not more than ten years, or both.

Note what is missing - intent.

Comey clearly documented that Hillary could be charged under subsection F - and then invented the requirement that intent be provable as well. The head of the Trump Justice Department could on Day 1 seek an indictment under the actual law itself from what Comey demonstrated. So I see a pardon as inevitable.

Why does Trump have to make any decision on this. Isn’t that what the DOJ is all about?

She broke the law. Yes or no? There’s an investigation on the Foundation now going on, yes or no?

Trump can stay out of it.

But Obama spokesman Josh Earnest stressed that the president is hopeful Trump will continue the longstanding tradition of not using the criminal-justice system to exact revenge on political opponents. You mean like not using the IRS to shut down your opponents?! What chutzpah!

HRC is neutalized as a political entity, and she's still a criminal. Done and done. Have the subpoenas ready on January 21.
