Michigan’s Court of Appeals ordered the state government on Tuesday evening to undo its previous approval of an election recount requested by Green Party presidential nominee Jill Stein.
The decision will not interfere with the ongoing recount in the state, however, due to a 2-1 ruling by the U.S. Court of Appeals for the 6th Circuit that came out around the same time, according to the Detroit Free Press.
The Court of Appeals for the 6th Circuit upheld a ruling that U.S. District Judge Mark Goldsmith issued early Monday morning ordering the recount to proceed at noon that day, and precluding it from stopping until “further order of this court.”
Michigan’s Republican Attorney General Bill Schuette and President-elect Donald Trump filed separate lawsuits with the state appeals court on Friday seeking to block Stein’s crowdfunded recount effort in the Great Lakes State.
The panel of judges on Michigan’s Court of Appeals accepted Schuette’s and Trump’s arguments that Stein, who came in a distant fourth place in Michigan, was not an “aggrieved” party with standing to challenge the election results.
At the same time, the judges appeared to acknowledge that their order would not take effect in light of Goldsmith’s original ruling, the Detroit Free Press reported.
The challenge to the recount will now head back to Goldsmith.

I don’t understand why the states let these fed judges push them around. The SoS should simply say that we certified our electors on the 28th and the MI COA ordered an end to the recount...done. Let Goodsmith say whatever he wants. Even if they recounted, the SoS doesnt habe to certify that count. These judges only have power because the states keep ceding theirs to them.

Goldsmith will slow walk his decision until pressured to buy time. Stein won’t appeal to the MISC until unless the secretary of state goes over his head for his slow walk, but the appeal to the MISC even if affirming the appeals court goes back to Goldsmith where he will slow walk it again until slapped down. By that time, the recount will have completed.
Because it is exactly correct in this case.
It is all a big load of BS. Our judicial system acts like they have a blank check from the taxpayers. They bounce cases back and forth drawing their checks.
We’ve had the mortgage bubble burst. It’s past time for the judicial system bubble to burst. These clowns need to realize they don’t have blank checks to enrich themselves and yield all kinds of lawless power.

But you need to understand what it is you highlighted.
The federal courts had a very narrow question in this matter. The federal District Court (lower court) had to determine if the counting should start Monday or Wednesday. It ordered that it be started on Monday. That decision was upheld by the federal Court of Appeals pending further order from the federal court of appeals.
That was ONLY a question of timing, not the propriety of having a recount at all. THAT is the province of the state courts which now have decided at the highest level that the recount petition does not meet state law requirements.
The state AG will now go back to the federal district court where Goldsmith should reverse his order in light of the state court’s decision; if he does not, the federal circuit court will. That would constitute a further order from that court.
But let's hope we are wrong.

He can do that, and the AG can ask the 6th Circuit Court (which has already said they expect him to modify or dissolve his order on the basis of what the MI state courts decide) can order him to dissolve the order if he will not do so in a timely manner.
How can you have a recount in Wayne County (Detroit)
if they refuse to open their books due to massive fraud.
