Too bad the perp didn’t leave while the homeowner went to get his gun - he could have left the shower and made a clean get away.

Always a mistake to go and get a gun and come back and shoot. Almost impossible to prove reasonable fear. Plenty of time to call cops and let them deal with it.

Looks like a really bad shoot. And the castle doctrine probably won’t help this idiot out, if the story is anywhere close to being accurate.

And how the bleep could the homeowner know the intruder was unarmed?

Well, I guess he could have had one of those concealed .380s that we read about on FR a few days ago. But naked in the shower, it's going to be really hard to sell to the jury that you had a *reasonable* belief that he was armed.

Best hope for the shooter is that this was a total stranger to the situation that has a mile long rap sheet for being an axe murderer.

A man has the right to confront someone who has invaded his house. Doesn’t mean lethal force at first, but it does allow confrontation. You make it sound as if the intruder has the right not to be confronted.

Jeez, what is this, England?? I mean what’s next, harming the intruder is against his rights?? That’s the way it is in England.

That didn't make sense to me either.

Why didn't the burglar run away?

Why stay hidden behind the shower curtain?

The most likely scenario was that the owner was leaving to call the police. But why would the intruder take THAT chance either?

The homeowner was plain dumb for putting HIMSELF in danger.

He had no idea what the intruder was going to do or was armed, etc.

Like they say: If you come home, and it looks like your property has been broken into DON'T go in. Call the cops.

Last thing you want to do is go inside and surprise the home-breaker.

That will end... poorly for you.

Not at all. He did confront him. Then he left and was not obstructed from leaving in any way. Once that occurred the potential for threat was gone. He then knew there was an intruder, knew he was clear of the threat and chose to go back and become the instigator of a new confrontation. He lost all claim to self defense.

You try that here in CO and depend on the “Make My Day Law” and I’ll write you in Florence.
