so I could learn if the daughter was raped or not. If not, the murderer should fry. If yes, "Not guilty, it was justifiable homicide."

Not very clear but the fact is she got her brother killed:
Serbu said she had also recruited her brother, John Vargas, 29, to help with her plot. Vargas was also shot during a fracas at the crime scene and later died of his wounds.

No jury worth a crap would convict her of anything but wasting ammunition. One shot to the head would have done the trick. Maybe another one to be sure. And one in center mass. Maybe a couple.
