This NBA is criminal and Unconstitutional....Loretta Lynch, Comey, Obama. The informant, whom I sincerely hope has LOTS of security around him 24/7, should volunteer to testify regardless of the law. Whistleblowers should be protected.

Congress deserves no respect as long as it will not use its power.
Congress can zero out the budget of the DOJ. Congress can literally impeach the AG. Congress can literally -abolish- the FBI.

Congress prefers to whine that nobody respects them. I wouldn’t either. Another Grassley investigation with no results? Another scornful Gowdy remark? That’s supposed to scare anyone? Laughable.

You are mistaken. Sessions is in charge of the DOJ. Trump cannot legally command Sessions to obey him. All he can do is ask. If Sessions refuses, Trump’s only recourse is to fire him. If you think the Frederica Wilson broohaha was big, multiply it by 10,000 and you’ll get the approximate media/political hysteria that would erupt upon Sessions’ firing.

Plus, the Senate has vowed not to confirm a replacement. That’s one promise they’d likely keep.

Maybe I'm missing something here, but I've never heard of a case where a non-disclosure agreement would be held to a higher legal standard than a subpoena.

Wouldn't it be easy for anyone who wants to avoid testifying in a court case to just sign an NDA and just render any subpoena worthless?

The hell he can’t. The DOJ is not some independent agency that does not answer to the president. It is long established that the President may direct an investigation, or he may stop one. It happened as far back as Jefferson.
The president IS the chief executive. And sure firing is a recourse.
But yes, the president may give a direct order to anyone in the executive branch, and fire them for their refusal.

Laughable that the president cannot legally command him. What in the law do you base that laughable idea on?

Imagine Trump fires Sessions and nominates someone. Senate let's him know that they refuse to confirm anyone he nominates. So his only logical recourse is to just work harder.... therefore, he decides the he will serve the country as acting AG and President, until the Senate decides to confirm a nominee.

Oh yes, we just don’t know about all the investigations he’s doing, because they don’t tell us.

Exactly. If the senate refuses to confirm a replacement, Trump can direct the DOJ, which he has full and unquestioned constitutional authority to do.

While I agree with the sentiment that the pace of things is Stone Age slow, I also see that there is a distinct possibility that AG Sessions is actually abiding by the rules of his agency, I.e. not divulging investigation information before it is appropriate.

I base that correct idea on the testimony of people who know more about the law than you do. I recommend the entire article. Everyone agreed with Mukasey.

Asked in a telephone interview whether Trump could order that a special prosecutor be appointed, “No, that’s not within his powers. I think he said, ‘I would direct my attorney general’ to exercise the power to appoint a special counsel. “The AG’s proper answer would then be, ‘I’ll think about it.’ Or ‘I’ll review the facts,’” Mukasey said. [His point is that the attorney general must exercise independent discretion—not merely carry out the President’s whims.]

Interesting idea. My theory is that Trump is waiting for the 2018 midterm to get closer. Then he’ll lay out very publicly all the reasons Sessions has to go, and vow to assist Bannon in primarying any GOPer that doesn’t quickly help to confirm the new AG nominee.

It’s just a theory.
