Palin appeals dismissal of New York Times defamation suit

Washington (AFP) – Sarah Palin, a former governor of Alaska and Republican vice presidential candidate, appealed on Tuesday the dismissal of her defamation suit against The New York Times, according to a court filing.

Her suit against America’s newspaper of record was thrown out in late August by a New York judge who ruled that, in the context of “free” and “robust” American political journalism, “mistakes will be made.”

Palin accused the newspaper of having published the editorial with the full knowledge that the connection it mentioned was unfounded, and has pursued a defamation suit against it.

I'm no fan of the NYT but I predicted at the start of this case that it wouldn't go very far.

For one thing, Palin has a hard time demonstrating that she suffered any actual damages as a result of this debacle -- which is a prerequisite for the case to proceed. Secondly, the fact that the NYT issued a correction makes it hard to prove any ill intent on their part.

It's always good to get into a position where the defendant in a lawsuit mounts a defense that basically says: "I'm not malicious ... I'm just a moron." But that may be the extent of where this case goes.

Exactly. Next time you get a speeding ticket, or find yourself before a jusge for pretty much any reason, just go ahead and rely on the “Mistakes will be made, judge” defense. See how that works for you.

Part of the appeal could be based on the judge’s admission that mistakes were made! The judge screwed the times potentially with that remark in an appeals trial.

The judge admitted ‘mistakes’ were made...the appeals court can decide how big those “mistakes” were!

An Appeals Court is going to “decide how big those “mistakes” were”?

Excuse the cynicism, but considering the current states of the legal and political systems in this country, the only place Palin (or anybody else Not In With The In Crowd) is going to find Justice is as an entry in a dictionary.

.....somewhere after the word “Joke”.
