Even before court victory, Trump’s pick to lead consumer watchdog began reshaping agency

A federal judge on Tuesday refused to block President Trump’s pick to be the temporary leader of the Consumer Financial Protection Bureau, denying a request by a high-ranking agency employee that she be put in charge instead.

In turning down Leandra English’s request for a temporary restraining order, U.S. District Judge Timothy J. Kelly acknowledged that the case raised constitutional questions, but he ruled that White House budget director Mick Mulvaney can remain acting CFPB director. Former CFPB litigation counsel Deepak Gupta, representing English, said they would weigh their options to resolve an issue they say has left the six-year old agency and its 1,600 employees in legal limbo.

“There needs to be an answer, and there needs to be a final answer. There needs to be a resolution of this cloud of impropriety hanging over the bureau,” Gupta told reporters after the hearing.

The Trump administration applauded the decision and said the ruling supports its contention that Mulvaney is the rightful acting director.

“It’s time for the Democrats to stop enabling this brazen political stunt by a rogue employee and allow Acting Director Mulvaney to continue the Bureau’s smooth transition into an agency that truly serves to help consumers,” White House spokesman Raj Shah said in a statement.

I want to know how much Deepak Gupta has been paid over the years representing the CFPB. It will be in the millions. I’m sure he is representing English pro bono since his gravy train is now derailed.

The Progressives have been really screaming about this “Consumer Financial Protection Bureau”. This must have been the Trojan Horse that Obama brought in to divert billions of dollars in Federal monies to Prog causes.

Right you are. Today,Rush explained the workings of this Democrat slush fund that funneled money from the Federal Reserve, which is unconstitutional, to Democrat organizations, such as Planned Parenthood, environmental scams, SEICU, and the community organizers of the discredited ACORN group.Someone should be prosecuted for this.

Shutting down this Democrat slush fund could go a long ways to making Americas voting system unlike the Banana Republic it has become.

Judge Kelly said there was not a substantial likelihood that the case would succeed on its merits.

The judge also said he could not find any law that would prevent Mulvaney from serving as acting CFPB director and budget director simultaneously.

So: yet another fake news article by fake news WaPo ...

protesters assembled outside the CFPB’s Washington offices, holding signs and chanting “hey, hey, ho, ho, Mick Mulvaney had to go”

If they were paid to show up, as I suspect they were, they should have chanted something more original at least. Come on you RATS, this Warren designed crime racket was pulling in billions, you've got to do better than that!

If you have read the Office of Legal Counsel Opinion concerning “succession” issue you would notice that it was well written and researched, indicating that it was in the works for weeks/months. Trump and his team anticipated this move by Cordray and were ready for it. I believe that Cordray got word that upon his originally announced departure date that Mulvaney was going to be put in place and moved up his departure in order to attempt to stop Trump.

Also notice that it took England 2 days to file her lawsuit, (in her personal capacity, not as the Director). That also tells me they were caught by surprise by Trump’s move.
Also, the PHH decision, (110 pages), made it clear that the CFPB could not appoint its own successor. It made it clear that the President had the right and authority to fire/appoint the Director of the CFPB at will. That decision was put on hold while it is being appealed (which likely will now result in the appeal being withdrawn by Mulvaney).
My understanding is that Mulvaney had his folks in place even before Trump made the announcement and locked down all computers. Emails etc.

When folks say that Trump plays 3D chess I tend to agree. This move only reinforces that opinion.

and the rest of what you said are fascinating. did you read this somewhere (searching shows nothing so far), or do you have an inside source?

mrs. catnipman said she heard somewhere (maybe TV) that they actually had to remove English from the director’s office because she had already moved in ... (if true, i wonder if she went quietly or if they had to bring in a Federal Marshal or two ...)
