I realize that, and its a very good point. My view is that if he ordered the release and the DOJ refused a direct presidential order this would give him more than sufficient grounds to remove anyone who refuses to comply.
Bear in mind that Sally Yates (of the DOJ incidentally) was fired for refusing to defend the travel ban. Insubordination is always grounds for dismissal.
Now Trump has the advantage of firing people for not only not accepting his authority and direction, but he also has the high moral ground for doing so. That is, he would be promoting transparency and exposing government corruption at the same time! And lastly, he would be draining the Swamp as a side benefit.
Yes the DOJ is recalcitrant. It see’s itself as being above the law and even unaccountable to the president, but the people are sick and tired of their arrogance and abuse of power and they will back him solidly.
