Constitutional Scholar/Attorney Mark Levin: There is NO Birthright Citizenship — Video

Mark Levin is more than a talk radio star, he is a successful attorney who was the chief of staff to President Reagan Attorney General Edwin Meese and a Constitutional scholar who has written six books (by my count) on Constitutional issues. Levin explains that the 14th Amendment to the Constitution does not grant birthright citizenship on anyone born inside our borders. He argues that says there is no such constitutional rule.

Article 1 Section 8 of the Constitution which lays out the powers of Congress says.

“The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States (…)To establish a uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States…”

Levin addressed the issue on his October 30 broadcast where he lit into Ryan for his absurd characterization of the law.

“There’s been no law passed that conveys birthright citizenship onto illegal aliens. There’s been no Supreme Court decision that definitively confers birthright citizenship onto illegal alien children,” Levin began. “Nobody’s a hundred percent certain how this came to be. But everybody seems to be a hundred percent certain that the president can’t fix it. … Well, does the Constitution confer birthright citizenship on the children of illegal aliens? Of course, it doesn’t!”

So children of illegal aliens should not be granted US citizenship under the constitution. How about the children of legal foreign citizen vistors and or legal foreign residents? Are they allowed US citizenship? Or is birthright citizenship reserved for the children of US citizens, natural born or naturalized, only?

Women don’t just come here illegally to have their children, they also come here legally and stay long enough to give birth, before returning to their own country with a US citizen child. Also, what about dual citizenship? Should that only be allowed to a child who has a US citizen child and a different citizen parent? Lots of things that need to be discussed on a national and congressional level. I’m glad Trump is pushing the issue. It is about time to have a logical discussion about this. Citizens elect congress, citizens pays the salary of congress, congress should care most about the citizens of the nation they serve, then about giving public charity to foreigners. If a congress person wants to give charity to foreigners, they should use their own money, not public tax money.

The 14th was never intended to apply to foreigners.
Any foreigners.

The Supreme Court stretched it to cover the children of foreigners here legally in Wong Kim Ark, but did not extend it to illegal aliens.

That was done administratively sometime in the 1960’s.
An executive order can remedy that.

Children of foreign nationals inherit the nationality(ies) of their foreign national parent(s).

That’s why the children of foreign nationals are NOT natural born citizens. Only those with only ONE nationality are naturally citizens.

The same principle is also how Ted Cruz acquired US citizenship being born in Canada. A citizen by extension of his mother’s citizenship, but not a natural born citizen.

ILLEGALS, by the act of entering the country without application or as it is against the law, are not eligible for citizenship.

By a court decision(wong kim ark). Those are CINOs(citizens in name only) since the judiciary doesn’t have the power of naturalization. Nor does it have the power to change the Constitution or make law.

Well the left wants a “living Constitution” now they’ll get one. Reinterpretation of the 14th to fit today’s voting public wishes. Everything they touch backfires on them. The Biden rule, the Reid rule, why not this too?
