Of course it requires lenders to perform due diligence. From what I’ve seen, this is frivolous and predatory judicial bullying. I get the sense Trump like tangling with bullies.

IMO, this “judge” shouldn’t be in charge on anything more involved than stocking shelves at Wal-Mart.
The problem with the ruling is that no one was defrauded. Trump could sell a property to another Trump affiliated company at a profit and make the judge’s ruling irrelevant, but that might cause him to owe more taxes. A lot of these deals are structured to avoid taxes, which is completely legal unless your Donald J. Trump.

My BIL worked for a large real estate developer. He said the company had two sets of books, one for the city or state they were schmoozing to get freebies and one for the banks and investors they wanted to secure loans from. The government one pleaded destitution and the investor one showed untold riches. It’s how real estate developers operate.

I would be wondering more about the banks/lenders/underwriting. Plus isn’t there a clause in most contracts that if the applicant didn’t disclose properly the loan is pulled/called back?
Now, I can see the fraud from the standpoint that the Banks do not have an asset on their books worth the amount claimed in the loan...so whose at fault here?
