Defense Hopes To Show Child Porn Wasn't Downloaded By Defendant

SAN DIEGO -- A computer expert hired by David Westerfield's defense team said that at least some of the pornography seized from his home was downloaded by the defendant's son.

Marcus Lawson (pictured, right), president of Global CompuSearch of Spokane, Wash., testified Wednesday that he found two photographs of naked women and Japanese "anime" computer animations on the hard drive of a Gateway computer in an upstairs bedroom used by Westerfield's 18-year-old son, David Neal Westerfield. The former Customs Service agent said that a detailed analysis of the files showed the pornography was downloaded at about the same time someone was accessing an email account belonging to the younger Westerfield.

David A. Westerfield, 50, is charged with kidnapping and killing 7-year-old Danielle van Dam. He is also charged with misdemeanor possession of child pornography. Prosecutors have said the 80 or so images of child pornography taken from Westerfield's home indicate sexual interest in children.Defense attorneys are trying to show that the defendant is not responsible for the pornographic images -- including those of young children -- found on his computer equipment.

David A. Westerfield, a 50-year-old self-employed design engineer, is on trial for the kidnapping and murder of 7-year-old Danielle van Dam.

Lawson told jurors that he examined copies of hard drives, zip disks and compact disks made by police and took numerous screen captures -- essentially photographs of what came up on the computer monitor at a given time.

Defense attorney Steven Feldman asked Lawson if there was a theme to the animations.

"A considerable number of the screen prints showed bondage -- where women were tied in ropes," Lawson said.

A screen print of an e-mail to a DNWesthotmail.com, as quoted by Lawson, said: "Thanks for joining anime.com."

Lawson also confirmed screen prints the defense entered into evidence last week, that a computer in the office of Westerfield's house was used to access pornography on Feb. 4 at 4:47 p.m., when the defendant was busy with detectives.

Feldman mentioned last week's suggestion that the clock on the computer may have been doctored.

"Did you see any evidence that that happened on any of the computers you examined?" Feldman asked.

"No, I did not," Lawson answered. He said there's usually signs when a clock has been tampered with, such as files being accessed before they were created. Nothing like that was apparent on Westerfield's computers, he said.

Tuesday, San Diego police Detective Johnny Keene testified that he collected Westerfield from his Sabre Springs home that Monday around 3:40 p.m. and took him to the Northeastern substation in Rancho Penasquitos. The defendant remained there until approximately 11:30 p.m.

Not saying this is the case here, but if someone wanted to collect from an insurance policy, it would probably be accomplished more quickly if a body were found.

What if she got scared and started to yell for mommy..and they were afraid the other kids would hear ..what if they tried to quiet her and hit her ....and she hit her head......and accident that would also be child abuse..

Neal had an airtight alibi for that night. He was with 8 friends. I think the only thing that David was covering for Neal on was the porn. Or David really had no idea that Neal had it when he told police it was his. We don't know how much they told him the found when he "confessed to it". Also Neal told the police that it wasn't his. So he lied... apparently his mother didn't know that he surfed porn. Think about it, at 18 would you want your mother to know you surf porn? Don't think so, cuz in her eyes you're still a kid.

DW could have purchased a $20 plastic fitted mattress protector from walmart.. wrapped her up...etc.. disposed of it, burned it somewhere..

No, it was Brenda, and she bought it at Mervyns. After Brenda and the girls left to go drinking, Damon killed his little girl and wrapped the body up in the plastic fitted mattress protector.

When the pizza gang comes over that night, the mode is somber because they help clean up the evidence, and move the body into Damon's van.

See Kim, anyone can spin a story when you get to make up facts and speculate wildly.

There is no evidence of this "plastic fitted mattress protector from walmart." or even from Mervyns. -- And no evidence that anyone remotely connnect to the case has bought one.

I mentioned this before on a previous thread: Bed wetting or other wetting could have set off DVD. It was the same thing that set off Jeffrey McDonald of the famous "Fatal Vision" case. He stabbed his wife and family to death after his daughter wet on his side of the bed. Then he stabbed himself (he was an M.D.) and tried to make it look like he was attached by "hippies".

Perhaps we should look at DVD's testimony again with new eyes. He may be using the dog to cover all these issues, so Layla may indeed be the roadmap to Danielle's death....

Did she walk in on something? What fibers are in her hair, hands and body and where did they come from? (the dogbed?)

Damon had a dog that ran into his leg (or was she kicked?)....
Was not housebroken and needed to be cleaned up after (or was she?)....
She needed to shut into Derrick's room (why?).....
But DVD heard her whimper to go out (but didn't hear his daughter being kidnapped?).....
Danielle played with and walked the dog (was she the dog's favorite? Had Layla 'protected' her before and gotten kicked for it?)

Where's the dogbed? And who was DVD entertaining earlier in the evening?


The timeline seems like it was cobbled together and that a couple of witnesses missed some instructions. So now they're stuck with doors opening and closing all night long, and DVD getting up to let the dog pee, no, to pee himself, no, to move the dog from one place to the next.

Might be time to read all of those VD transcripts again. :-(

I've decided to burn a cd containing the PH and trial transcripts to make it easier to read and search. Where can I find text files of the trial transcripts? I have the PH ones in text format, thanks to whoever it was that posted a link a while back. The SanDiegoChannel transcripts don't work for me with all the graphics, etc. TIA for any help you can offer.

All of Layla's deeds on that night were bogus...letting her out several times was a story in case someone came forward and said the patio door was being opened and closed and Damon was in and out.

The dog bed was not destroyed by Layla..it was used to suffocate and/or carry her out of the house..the steam cleaner was used in the MB, not her room....her room was never the crime scene, which is why he had no problem preserving it...IMO

Pin..we've been going over what Damon and Brenda have said since day one. We've always come back to square one..their versions of what happened that night are questionable.

Damon and Brenda have left a trail of clues to pick up on. For one, they said way too much that we didn't need to know. Thinking ahead, covering thier asses was their main purpose. Finding her blood, urine, fingerprints would all be very natural, or is it?

Did we need to know that Danielle sleep-walked? (First alibi)...not true, tho. Did we need to know about the Potty Dance? Did we need to know that Layla tore up her dog bed? (Why did Damon say this?) Did we need to know that Danielle suffered from nose-bleeds? (Her blood was probably found in the house somewhere).. Did we need to know Damon ran into the dogs nose? Did we need to know about the vacuuming? Did we need to know Laya scratched Danielle? And on and on...They led the LE away from them...sort of like, a good offense is a good defense.

The VD's offered up way too much information that in my mind, only served to give them an alibi thereby neutralizing any clues that the child could have been harmed in the house, or by someone invited there. They had an answer already provided, even before they were asked. Very clever..these two. But they aren't SMART. LE, OTOH, was stupid..to write them off so fast.

Sorry for the long rant..I just can't stand the thought that if DW isn't the guilty party, there are OTHERS to look at, even if the idea that a parent did this, is sooo distasteful to some.
