Patrick Henry was a prophet.......We or our children shall have to deal with the unintended consequences.
Unintended perhaps, but certainly not unforseen. Patrick Henry knew the time would come that the unscrupulous power hungry -- today's fascist left -- would arise. The founders had a grasp of human nature that eludes many today (or goes unspoken and unreported). They tried to warn us. We would not listen. Instead we cleaved to the siren's song: "Your freedom for your needs and security".
In 1776, Americans knew that the militia of the whole people was the last defense against any group attempting to overthrow our government. Our founding fathers also believed that a standing army was a threat to liberty and democracy; the reason the Posse Comitatus Act later became law.
If Congress relaxes posse comitatus constraints on a standing army, then our founding fathers would view both the "active military" and the "organized militia", our National Guard, as a threat to democracy. That is true because a President can activate Guard units without congressional approval and they become an integral part of the "active military". Our laws however, provide a last defense against any group attempting to overthrow our government, that defense is the "unorganized militia".
The "unorganized militia" is composed of all able-bodied males between 17 and 45 years of age who are not members of the National Guard or Naval Militia, see 10 USC 311. Unfortunately, the "unorganized militia" is unarmed.
Congress must therefore, (a) provide a standard military firearm with ammunition for every member of the "unorganized militia", (b) require that each "unorganized militia" member be trained and retrained periodically, and (c) provide facilities and personnel for training the "unorganized militia".
If we are truly at war as President Bush says, then the above actions would prepare the "unorganized militia" to fulfill its historic role and assist the "active military" and "organized militia" in the "War on Terrorism". It also reduces the threat of a standing army.
