"Grossly unseemly" describes the situation in the article perfectly.

live on the coast in Southern California and have to deal with the flying advertisements. They are generally quite annoying, not just from the standpoint of the visual, but the planes that drag them make a huge racket and are flying very low. Conversation stops when they fly over as you can't hear anything else.
I go to Huntington Beach frequently and have seen the planes fly over all the time, never were they loud enough to disrupt a conversation. Either you are flayt out lieng or your hearing aid is adjusted way to high. Which is it ?

I live in Dana Point. They are loud enough to disrupt conversations if you are on the bluffs. They are just off shore at that point and not much hogher then the bluffs themselves. In particular the biplanes are the ones that can stop conversation.
Way to go to the "you must be lying" card.

It is not only a Free Speech issue, but here is the only law you need to know. The City cannot by law control the Airspace above it. The Federal Government has given that Authority to the FAA to designate airspace over the entire nation. For non-residents, here's a couple of inside pointers that may be helpful:
1. the city council person that objected to the pro-life bannners as a specific instance behind her support of the ordinance just had triplets - hardly an anti-lifer;
2. HB is hard-core Republican territory. While the city council is decidely left leaning due to the influence of Bolsa Chica, this is Bush country. You don't think the FAA will have to deal with this?
3. in reference to #2, if they think HB is affluent, what is NB? IMO, it's second only to BH in terms of wealth in SoCal. PLUS, it's also Republican - these are the guys that pay the bills. Anyway, they're getting their own initiative ready shortly, so Bush is gonna have even more noise coming his way from wealthy supporters;
4. last, but not least, the real party campaigning against this law is the owner of 'WhatALottaPizza'. He and the banner companies are claiming 1st ammendment infringement. Last week they had 3 planes flying in formation with a huge American flag towed behind. They looped around and around the main beach area and downtown for about an hour.
