SCOTUS denied cert - that was the response to the linked petition. I think it's a pity, it was well written and raises three good questions. (Actually, I think SCOTUS is afraid of touching the Second Amendment - too much trouble no matter how they rule.)

I meant to say the response from the US Attorneys. It may have answered some of those questions. In any case, thanks for the information.

While you are correct that Emerson had a hearing (I was mistaken on this point), he did not buy a gun while under the restraining order. See the link here: http://www.ca5.uscourts.gov/opinions/pub/99/99-10331-cr0.htm

He already owned the pistol. You are 100% wrong when you say that he got arrested for obtaining hte gun after hte order was issued. He was in fact pinched without warning.

Moreover, the temporary injunction issued by the court did not expressly prohibit Emerson from owning a gun. You are 100% wrong when you say that the order prevented him from possessing a gun; it did not explicitly so say.

The wiretapping laws vary from state to state. They set the intent of secret recording. In some states it is illegal and inadmissible to record a conversation unless all parties are aware of the recording. On phones the beeping signals the conversation is being taped; this is legal. Police have to get court permission to install wiretaps. As a citizen do you think you could get a wiretap to listen to the cops? I recall that Newt Gingrich's cellular telephone conversation was tapped and his conversation was spilled to the press much to his chagrin. The couple who did the taping were given a slap in the hand, and the politicians and press were given a pass even though this was an illegal act. I don't archive the instances where stories of cops getting away with crimminal acts who were recorded but the victims was prosecuted for illegal recording. Every now and then such a story surfaces. I read one this week; I think in this forum.

In the case of the Rodney King episode the cops had no expectation of privacy aand the wiretapping laws would not control.
