HOUSTON - Investigators with Children's Protective Services are looking into the case of a six-year-old girl who they believe could be in danger.

League City police say photographs confiscated from her home show the little girl was watching while her mother performed explicit sex acts.

The child's father is outraged because he says he tried to get something done six months ago. He told KHOU-TV he found sexually explicit negatives that included his daughter back in May.

"I was mad because my daughter was not supposed to look at that," he says. "She is not that age to look at that."

League City police say the pictures show the child watching her mother engaged in sex acts with another woman.

Last Friday, League City officers arrested 21-year-old Janie Melendez and charged her with indecency with a child. She was later released on bond.

The father says he showed the pictures to a CPS caseworker six months ago, but nothing happened. "That's nothing right," he says. "I don't understand why not."

CPS spokesperson Judy Hay say they investigated back then, but found no evidence of sexual or physical abuse.

"This child is telling us of a very appropriate life with her mother," Hay says.

Hay admits they could have done more. "We could have stayed involved with Mom," she says. "We didn't do that. We could have asked for drug and alcohol assessment. We didn't do that. We could have provided monitoring. We didn't."

The mother has agreed to let CPS psychiatrists examine the child. They will determine whether the girl should be placed in foster care.

As I read this I agreed with the father, but what glared at me was the Children's Protective Service's spokesperson referring to drug assesment.

Although the 21y.o. mom in this case is portrayed as the villian (with which I agree), the drug assesment statement seems to have come from way out in left field. No mention is made of drugs yet the CPS agent seems to throw in the testing as a cursory statement of "tools of monitoring" and never raised an eyebrow to the fact that she just weaseled her way into a constitutional backdoor.

SO this agent likes drug laws so she can use them for survelance where other laws would never allow. Now I understand. (/sarcasm)

I guess lesbianism in front of minors with picture proof isn't worthy of legal interferrence. Ask Rosie O'donuts. But they do have a couple of open-ended drug laws they could throw at her.

I wish the CPS people around here would take a tip from the Houston squad. That father had photographic evidence which they waved away after an interview with the child. Our CPS had an anonymous tip that our children weren't being fed enough and we went through two months of proof that they are fed enough - and OUR KIDS ARE ATHELETES. The CPS goon saw them first day and could see how healthy they were but, "We have to follow the investigation through."

Can I resign from the human race?

One other point -

What two adults decide to do in the privacy in their own homes is no business of anybody else. The fact that we have a 21-year-old mother of a 6-year-old child performing lesbian sex acts in front of said child should not be blamed on the libertarianization of sexual behavior in the United States over the last 40 or so years. There is absolutely no connection between all the private individuals engaging in consensual perversion and this particular woman breaking the law with her child. Anybody who wants to draw such a connection can go suck eggs.

But don't let your kid watch.
