"It is emphatically the province and duty of the judicial department to say what the law is."It's amazing that this case involved Madison, the father of the Constitution. His interpretation of it was vastly different than that of the federalist Marshall, who was an activist judge.
Regarding "Lincoln on Judicial Despotism": Lincoln's position was to ignore the ones you disagree with - instead of appealing. So much for his oath to God.
