Excellent idea to start to recall the legislators. The demoncrats are scared silly that the Davis recall will spread to other useless riders on the government gravy train.

There will be no recall. Once the signatures are in and verified, Davis will resign and let the Democratic Lt. Gov. take over making the recall moot.

I believe you are right, but I am not totally sure that his resignation would stop the petition from being put on the ballot. As an example, and this might not be the best example, after the three strikes initiative was qualified, the legislature passed it into law before the voters could vote on it. Nonetheless, the initiative was voted upon and passed by the voters anyway. Similarly, the initiative to recall Davis may be certified for the ballot. I don't see why it cannot still be placed on the ballot because there is still an issue of who will be Governor. True, Bustamante will be appointed after Davis resigned, but he would not be an ELECTED Governor. The ballot would simply validate the wish of the people to recall Davis, and appoint his replacement. At that point, Bustamante would no longer be Governor. My advice to him would be to accept the position as ACTING Governor, and not to resign as Lt. Governor so he has a place to go back to. Anyway, the resignation of Davis might stop the process, but I am not so sure.

I believe California law prohibits this. Once the signatures are verified, the recall election must take place. If Davis resigns, the Lt. Gov takes over until the results from the recall election are in.

Yes but the message has been sent. Davis hates Bustamanti so I wouldn't be so sure he is going to step down. Politicians have big egos and it would be hard to swallow being the first recalled governor in our nations history. Davis may hope that more than one republican runs, making his chances better for reelection.

I'll take it, since I have the right page bookmarked. California Election Code:

11302. If a vacancy occurs in an office after a recall petition is filed against the vacating officer, the recall election shall nevertheless proceed. The vacancy shall be filled as provided by law, but any person appointed to fill the vacancy shall hold office only until a successor is selected in accordance with Article 4 (commencing with Section 11360) or Article 5 (commencing with Section 11380), and the successor qualifies for that office.
