How about the fact that the NJ case was a state-wide election for a federal position while this is a state-wide election for a state position?"

Both NJ and FL in 2000 involved STATE supreme courts. This decision by a panel of the 9th Circuit IS a federal matter already. That's why SCOTUS almost HAS to take it.

Nice try, but the "equal protection" portion Bush v Gore applied to the different treatment to be given different ballots cast using the same method applied not by state legislature (the party that is Constitutionally-charged with setting the rules of a Presidential election), but a state court changing the rules after the election was run in order to effect a different result.

This, on the other hand, is trying to declare that because some jurisdictions (which just happen to be the most-reliably Democratic ones) still use punch-card ballots (which are still legal in California), those ballots are by definition treated differently because they realize they can't gin up enough "no" votes to save Gray-Out Davis and they fear they can't gin up enough votes for Bustamonte to get him in in that eventuality.

Brit Hume was on just now doing a beautiful job of articulating that the judges job is to interpret and apply the LAW. Not to decide what is in the best interests of the public. Brit was great.

I'm nauseous about this. Going to have to step out for a while.

Time for us to start screaming as hard as the libs do. Flood the media with letters etc.

Not if the recall elecion is pushed to March of 2004. That is the presidential primary election, where EVERY Democrat will be at the polls, voting for their favorite Democrat presidential candidate. The GOP timed the submission of the recall papers specifically to avoid the March election. This is a HUGE win for the Democrats. No, if the Recall is delayed until March, it will share a ballot with the referendum to overturn the Illegal Alien drivers' licenses and a racist MEChA seperatist, as well as eight or nine Democrat Presidential candidates who've promised to Amnesty Illegals if elected. Illegal Aliens will be the central issue on the March Primary in California, in the face of a furious electorate.

also why isn't Bustamonte being called to task for SUPPORTING THE VIOLENT OVERTHROW OF CALIFORNIA?

Add this to the mix: The Texas State Senate was shut down today as they considered redistricting during their 3rd special session. Too many protesters interrupting the proceedings.

My patience is wearing thin. . . . .

I just heard on KFBK News Talk Radio here in Sacramento that only a 3 member panel made this decision! It wasn't even the full court. Didn't say which 3, but I'll bet they're heavy Dufus Butt Kissers!

Even this stupid 9th circuit court cited international ramifications, i.e, how can we call for free elections outside the US when we don't have them here? Utter nonsense but such is the court system.

It's totally broke.

It matters little what the composition of the Ninth Circus panel is; just know that it was enough to kill the election. That is what this is all about, killing the Recall until March.

What should be done is the following: Schwarzenegger, McClintock, and Issa should file a joint emergency request for a Writ to the SCOTUS. My assumption is that the SCOTUS, having been at the center of controversy once, will decline any writs and not hear the case. In this case, I disagree with Billybob.

Assuming that happens, I would urge both Republicans to jointly withdraw from the election under protest and not participate in a fixed game. Nothing is gained by the Republican candidates granting any legitimacy to this scam. I would also recommend that the Republicans scream "fix" and "scam" at the top of thier lungs.

Yes, I am on record that I expected the Ninth Circuit to say yes to the election, to prevent itself from being embarrassed one more time by being slapped down by the Supreme Court. Now, it is time for another dose of embarrassment. Spread the shame with a trowel, this time.

Brit Hume just said he thinks the appeals court overreached with this ruling. There is no federal issue involved here.

Brit Hume just did a brilliant analysis that I can hardly do fair justice. One of the things that he said is that within the ruling is extraordinary language about where the October election is in the "public interest". Brit said that it is not the court's job to judge what in in the "public interest", it is the court's job to interpret the laws. They are to determine what the law says, regardless of whether it is a bad law or in the "public interest."

What happened to the argument that the election cost too much money???? I'm sure reprinting and remailing all the notices and information associated with changing the date sure is not going to make this any cheaper!
