SAN FRANCISCO (CNN) --"A federal appeals court has blocked the Oct. 7 California recall, but stayed its order for seven days to allow an appeal. The ruling from the 9th U.S. Circuit Court of Appeals follows a hearing last week in which the American Civil Liberties Union sought a postponment of the vote. The ACLU argued that election officials should have more time to replace antiquated voting machines in several California counties."

As an aside, will this take any steam out of the Democrats' national campaign charge that Republicans are trying to steal elections or will this embolden them to say that they are preserving democracy by stopping the recall?

I've read the decision, and I have to say, what a bizare ruling. Judging from how it was written, choices in language and issues not part of the case, this decision was written with the intention of being overturned.
Which makes me wonder if the intention was to force the SCOTUS to overturn /and/ come up with a reason that would weaken the rulings of Bush v Gore, giving a double victory to Democrats who will use both to bash the 'right-wing' SCOTUS and re-energize the vote for 2004.
Were it my choice, I would not appeal this to SCOTUS, but rather within the 9th Circuit...

Jon Scott was great interviwing Torres on FOx News. Torres was going ballistic trying to come up with an answer for why the Dems didn't argue this point last election. Then Scott says (paraphrasing) "I've read the brief and help me to understand the second argument; the court says minorities don't know how to use the equipment, why can't they use the equipment like everyone else?".
Torres stuttered that he hadn't read the brief yet and uh, and uh, and uh......

This move is straight from Clinton's playbook.
He wants the final decision, like Florida 2000, to be thrown into the Supreme Court. That way, when the S.C. rules against them and lets the Recall proceed, the idiot dems can scream and shout that the Recall, aided and abetted by the Supreme Court, is a political move to overturn an election.

When I heard the news I had to laugh. This court is more predictable than the weather and even more predictable than the outcomes of early-season college football games, when big teams commonly play scrubs to warm up for conference play.
