October 10, 2003 -- EAGLE, Colo. - The woman who accused NBA superstar Kobe Bryant of rape said he attacked her from behind - grabbing her around the neck with both hands, leaning her over a chair, pulling down her panties and raping her, a detective testified yesterday.

Actually, Kobe's room was at the end of a first-floor hallway. His bodyguards were in rooms on the third floor. There were no people in rooms near Kobe's.

I am not a supporter of Kobe in any way, but could blood have come from her being on her menstrual cycle? Or just recently?

I think logic dictates the blood came from the numerous lacerations (see the excerpt I posted at #75) she suffered. There was no testimony that she was having her period, and she did get examined, so I would think that possibility must be discarded (plus it would be unlikely she would consent to intercourse if she was). In fact, Mackey would have used that if there was any evidence indicating it was menstrual blood.

I bet there's a way to tell if blood was from the cycle or from an injury. It's not just blood in a cycle, there's a sloughing off of tissue, too. And don't forget the vaginal tearing involved. Finally, if there was an issue of the victim's cycle being involved in the bloodstains I'm sure Kobe's lawyer would have brought it up. Since she didn't, I'd assume the defense isn't disputing that the blood came from sexual activity.

I don't know why everyone is ragging on the Defense attorney. This is a man's life we're talking about. I know it's difficult to listen to, but she would be neglect in her duties if she didn't use the woman's background to her advantage. It's the only thing they have.

What I find very strange is that his wife wasn't with him on his first trip to Colorado.

New mom, not working....Dad is going somewhere...
I would be with him for a bit of a family holiday with the darlin' new baby girl. To take care of hubby after his surgery etc.

My guess is that his wife is totally into Mommy mode with the baby and not paying attention to him. Being ignored is not something he is used to.

So he takes it out on the first chick through the door.

I know several women who have been raped because of something stupid they did (their own words) and they didn't report it....Opened a door, got in a car, got alone, went somewhere...whatever.

You just explained the problem. These women think they were raped because they think they did something to start it and it's their fault it happened. It's also why they don't report it. Reality is these women should be able to be naked and spread eagled in front of a topless bar and still not be expected to be raped.

But with rape,
The actions of the victim give validity to the crime (in societies twerked mind).
While we would come off as just plain silly if we did it with another crime
(ie, my 'stupid man wearing a Rolex in a ghetto bar' analogy).

Sadly, every one of these women, when they told the story, knew they had been raped, but thought they wouldn't be believed because of their bad judgement.

This is the preliminary hearing.

At the trial, she'll have to testify to all this herself, but having one person, usually a detective, lay out prosecution evidence is SOP at a preliminary hearing.
