MIAMI — A Florida woman Tuesday hailed as a victory for women's rights a court ruling that cleared her of disturbing the peace when she bared her breasts during a camp-out in a state forest.
"Who decided that women's breasts are more obscene than men's?'' Kayla Sosnow asked at a news conference in Gainesville.
"By going top-free, we are rejecting the criminalization of our breasts and reclaiming control of our bodies,'' she said.
Sosnow organized the news conference after Florida's Eighth Circuit Court of Appeals threw out on Sept. 17 her conviction on a disorderly conduct charge — which incorporates disturbing the peace — on the grounds that only the police officer who made the arrest had objected to her partial nudity.
The court found no proof that any member of the public was disturbed when Sosnow peeled off her shirt at a 1996 camp-out in the Ocala National Forest in north Florida.
The event drew 2,500 members of the Rainbow group, an organization that promotes ecologically sound living.
Someone did make an anonymous call to a police command post in the forest and reported that Sosnow was walking around topless in the 90-degree (32 degrees C) heat.
The officer was acting on that tip when he went to the campsite and arrested Sosnow, who served 20 days in jail, trial documents said.
But the appeals court said the anonymous tip was hearsay that should not have been admitted as evidence in her trial.
"Because the tip was the only evidence that anyone was offended or bothered by defendant's conduct, without it the state could not prove its case,'' the appeals court said.
Florida has no statewide law requiring women to cover their breasts, though many cities and counties have local ordinances requiring it. In areas where no such ordinances exist, police have relied on the disorderly conduct statutes to arrest topless women.
In recent rulings, however, the state appeals courts have said bare-breasted women should not be arrested simply because a police officer saw that they were topless. The rulings have held that disorderly conduct must disturb someone other than a law enforcement official.

I wish that were so. They get several thousand people together here in a part of the county that is poorly patroled.
There are problems.
For one a lot of the 'followers' like to make their living by shoplifting.
For another the area they like to gather in is a very redneck section of the state.

Phew! You posted your warning just in time. I coulda been booked for the wrong side of Florida and probably would have had a miserable time all because I saw an opportunity to see a little skin on the cheap. Better that I stay right where I am and continue to run across the Ariz. St. Univ. campus every now and then. It's the one university in America that could get away with charging people a cover charge to walk among the students. If the dangers in that part of Florida are as great as you say, why would ANYONE want to run around topless? Hey, wait a minute...the conditions there are great, aren't they? It is legal here in Eugene, Oregon for women to be topless as it should be everywhere.
Breasts are secondary sexual characteristics. Should men wear a bra over their beards? I think not. Women should support this.
