Today, December 13, 1999, the fight for justice begins in earnest in my criminal prosecution in Maryland. First, the court will deal with the issue of immunity. After that, the court will deal with the evidence in a follow-on Kastigar hearing. There is speculation that the Judge may close the hearings. I hope the hearings as well as the trial are completely open to the public. I have nothing to hide. Do they?

But before I go much further, I must first express my heartfelt thanks to each one of you who continue to help me in my overwhelming and expensive fight against the State of Maryland, and by extension, the Clinton White House. This literally could not be done without you.

Within the next few days I will learn if the immunity I was given by Judge Starr on January 16, 1998 was legal. Today's hearing is about the issue of immunity. The powerful democratic machine in my adopted State of Maryland is vested in this case, and so has chosen to fight the immunity I was granted by Judge Starr. I ask you to think about something for a minute. The notion that officers of the court can promise immunity to a potential cooperating witness, in writing, and assure that witness that it protects that witness from any other arm of the law attempting to access and use the immunized information or materials, (only to discover months later that it could be "misinterpreted" or knocked out on a technicality), is mind-boggling.

This would mean that in my case, I would have been enticed to make "statements against interest", or to even unwittingly waive my constitutionally-guaranteed fifth amendment privilege -- none of which would have happened had I not believed in the veracity and authority of the Office of the Independent Counsel and the inviolate protection offered me by their letter immunity. Was I promised that the State of Maryland could not try to prosecute me? Of course not. Could the State Prosecutors obtain what had been provided in compelled production under a grant of immunity? I was told they could not.

I am told that federal prosecutors all over the country handle immunity issues in precisely the same way that my immunity was handled. I am further told that states routinely honor their fellow federal prosecutors' immunity agreements. But, this case is anything but routine.

Imagine if you will, the far-reaching impact of this immunity dispute. From my perspective as a non-lawyer, it looks a little like this: A federal witness is guaranteed immunity by a federal prosecutor and so, walks in the front door and provides compelled key information and hands over compelled materials critical to the federal investigation. But, when the witness exits the back door, having complied with the terms of that immunity, he or she is summarily slapped with an indictment by the State, based on that very same immunized information. How many witnesses do you believe will cooperate with the government when faced with this scenario?

I doubt that many law-abiding citizens would see the logic in this scenario, but even those who traffic outside the boundaries of the law would probably refrain from cooperating as well. If this is allowed to happen, I am told that it could adversely affect federal prosecutions all over the country. Once again, it is a matter of right versus wrong, principle versus expedient semantics. It is that most revered of documents, the Constitution, versus a runaway political machine.

Because of the political flavor of this unusual prosecution, anything can happen. Many political pundits are calling for a dismissal, some saying "everyone wants this to be over." For my part, this sudden turn around smacks of political self-interest. After investigating me for over a year and after forcing me to live with the threat of incarceration and the knowledge that I could be convicted as a felon, I am anxious to be fully exonerated.

Despite this expensive lesson, I continue to believe that each and every citizen has the duty to turn over evidence of criminal wrongdoing, especially evidence that implicates our highest elected government officials. For those of us who work, with honor, for the federal government, it is, in fact, a sworn duty.

For close to two years now, the White House mouthpieces have orchestrated a masterful campaign, in fact, a propaganda campaign, to undermine my credibility. Their now-exposed "nuts and sluts" crusade (routinely hauled out by these FOB to impeach those who dared disclose the truth about this President), would simply not work in my case. On they went to "Plan B." The next best message was, "She is a heinous and despicable villain, hell, she even looks the part; she "betrayed" a "vulnerable" young colleague; she is guilty of committing acts more monstrous than war crimes; besides, she was front and center at every single scandal Mr. And Mrs. Clinton touched, so she must be to blame." Did it work? You bet. Did I do anything publicly to try to fight it? Nope.

There is no method by which an average citizen can effectively fight the White House in the media. Not this White House. It's a completely lopsided playing field. The Clinton apologists have effectively colored the dialogue by drowning out the facts in a sea of spin, and they have even been able to change the dynamic of the impeachment of the President.

As for me, they have been able to ensure that retribution is full and long lasting. They have removed me from my position as Director of a very important Secretary of Defense program and stuck me at another, less visible location. They have essentially ended my 20-year career in government and they have caused me to amass hundreds of thousands of dollars in legal debt. But, omnipotent as they may seem when one reflects upon the past two years, there is one thing even they cannot do. They cannot bastardize the Constitution. The framers ensured the protection and the rights of each and every citizen. When I am feeling helpless, I find myself clinging to this truth. It is almost as if those intuitive framers foresaw the eventuality of a Clintonesqe presidency looming on the national horizon. I'm eternally grateful that they did.

Funny, but virtually everybody wants this case to go away, but the Maryland Attorney General's Office was to embarrassed to drop the indictment.

Rush just mentioned that the Maryland judge hearing the case has determined that Linda's immunity does not count in this case and prosecution will go forward.

Once the higher courts overturn her (almost assured) conviction, I hope she gets filthy rich suing the state of Maryland.

I am not -- fortunately -- in Linda's shoes, but I wonder what would happen IF, upon ruling that the trial would be closed, Linda and her legal team walked out and refused to take part in the trial. I know that the court would hold them in contempt, but could they also hold the trial without Linda's participation? What recourse would she or anyone have if they decide to hold the trial, and adjudicate her in absentia?

The sad fact is that people will literally die because of this judge's shameful behavior in not respecting the federal grant of immunity. The obvious effect of that decision is that there will be delays in obtaining immunized testimony from witnesses, and as a result, legitimate law enforcement activities will suffer. And, people will most assuredly die as a result of the authorities not having vital information that they otherwise would have been entitled to obtain. Who will suffer from the crimes that might have been averted had not this judge made such a wrong-headed call? Probably not the Clinton's themselves, or their puppets, but a bunch of Clinton dupes are bound to be victimized unnecessarily...

Linda does a wonderful job of summarizing the whole scenario. My guess is, if this does go to trial the Clinton's will make certain it is a closed hearing as Linda is entirely believable unlike Bill, Monica, Vernon and Bruce. It's amazing how good the truth sounds when you hear it. Putting Monica on the stand again could be risky. She's been hurt and eventually she'll realize it and prove to be an ongoing problem for Bill.

A defendant has a right to face his/her accusers but no obligation to do so. If she were to skip the trial, that would be her right. If she is convicted in absentia, she'll be picked up and held for sentencing. But she has every likelihood of being vindicated long before a trail commences. She just needs to hang in there. And she needs to listen to good advice.

Unfortunately, that doesn't fly. She has herself been recorded by Lucianne Goldberg, chattering with glee about getting the goods on Clinton....details that don't point to criminality on the part of Clinton, but rather details that would spice up the book they had in mind at the time. She DID write a previous tell-all book about the White House, too. Her argument of needing to tape for protection just isn't going to hold water.

No, I'm just being a realist. It looks as if she has no defense. The prosecutors are saying they did not promise her immunity from state prosecution, and the judge has ruled today that she did not have immunity.

The only recourse for Tripp at this point is to do what she did before: protect herself. If she flips, she'll be a VERY wealthy woman. She'll get a slap on the wrist AND she'll be a very wealthy woman.

I don't know about that, you need 12 out of 12 to convict.

I remember reading the transcript of one telephone conversation in which there was an implied threat.

With a majority to convict, Tripp would be in trouble, however with an unanimous ruling, required, hell I'll pick the first 12 jurors without regard to biases etc., and go pro se, and still be the rap, and have a lota fun doing it.

And if I am wrong about all this (I have been known once or twice in my life to be wrong), the worst I'll get would be a free 6-month vacation in Pennsylvania, with golf, tennis etc.

OK, this next is not an attack on you: the starkly different manner in which the case of the weak (Linda Tripp) is handled, versus the handling of the case of the mighty (Bill Clinton), might make realists out of some few Americans, in the same way that the abolitionists became realists before the first American Civil War.

It is beginning to look like no conservative has a defense against the venomous hatred and duplicity of our enemies, the socialist Democrats. The Democrats are making a downpayment similar to the one that the Southern slavers made in the first half of the nineteenth century.

If convicted, perhaps she will never be able to sell her story if Maryland has one of those laws where you can't profit from criminal activity. A lot is going to come out in the trial itself. As far as I can remember, a Clinton-appointed judge ruled that the subject of Clinton's perjury was so relevant to the Jones lawsuit that he was fined $90,000. So, what case are you talking about?

Was she ever threatened! She was told she would be prosecuted for perjury if she told the TRUTH! And the corrupt Justice Department could do just that.

Congress needs to impeach Clinton again along with all of his cabinet.
