Do we even care our Constitutionally guaranteed rights are under assault by the U.S. government?
Is it too much trouble to be concerned?
Does it hurt to think about democracy and the rule of law?
Were those who died to keep us free, on a fool's errand?
Have the American people become so easily duped and manipulated?
Do they believe their government can and should "give" them everything?
Is our Congress completely without guiding moral direction and understanding of their oath of office?
Have the historical facts and brutal inhumanity of Communism faded with time and rewriting?
Is the power and ideology of the LIBERAL pen stronger than the sword of truth?
Does the warning of our forefathers, to keep government powers separate, no longer raise alarm when it is not heeded?
Are we witnessing a dictatorial shift in our government, a government that has now become big enough to take it all away?

We can not concede our rights as Americans to an oppressive and out of control government. WE ARE THE PEOPLE!

Continue writing to Congress! If we don't let them know they are wrong and then follow through again and again,
ultimately running them from office, we will be aiding and abetting the fall of the United States of America.

The Only Hope for Elián......Judicial Amour Propre.

Write and berate your congressmen. Tell them you are ashamed, angry and not going to abide by their inaction. Remind them they are there to represent you and follow their oath of office and the Constitution, not the polls and bending to the political whims of the executive branch, criminality of the Justice Department and demagoguery of the LIBERAL media.

Tell them they are equal with the executive and judicial. They are charged with being our voice, but above that, they, as our representatives, must understand the importance of governing through wisdom and total regard for preserving our rights and freedoms from oppressive government. That's called statesmenship!

If you get no response or a wishy-washy, half-hearted, non-response, a it's-not-our-job, we're-moving-on,
or it-is-not-advisable-at-this-time dodge, a this-is-a-court-issue and they-will-decide because this-is-a-family-issue put-off……

DON'T JUST SHAKE YOUR (((HEAD)))!!! SHAKE YOUR [[FIST]] AND
WRITE BACK AND TELL THEM --- THIS IS NOT THE RIGHT ANSWER!!! -- OR -- WHERE IS MY ANSWER!?!?!?

If we don't demand they do their jobs, they won't.

We can't let them hold court, announce they have a yellow streak down their backs and just nod, accept defeat and move on.
This is our country and these guys work for us!
If our senators and representatives are not up to the job, or think we don't have the will to follow through,
we well get the government we deserve.

In an unusual speech to lawyers and courtroom observers before the hearing, Circuit Judge J.L. Edmondson warned against jumping to conclusions based on the judges' questions.

"It is entirely possible that a judge may make a statement or ask a question that is the exact opposite of what he is thinking, because he may want to see how the lawyers respond to it," he said.

Judge Edmondson also promised the judges will try to rule quickly, within a few weeks, on whether Elian is mature enough to seek asylum despite the father's wishes to take him back to Cuba.---Appeals court takes up Elian Case

In my experience, there's a definite pecking order of effectiveness when approaching a U.S. Congressperson: Letters are awesome. Calls are ok. E-mails are ignored. Always be polite, even though it's not warranted or deserved.

You are MOST CORRECT! The written letter sent via snail mail shows determination to communicate!

Here some of the transcript of the May 11th hearing and some paraphrasing and thoughts.

Complete transcript of appeals court proceedings-- (May 11, 2000)

Kneedler (speaking for the Justice Dept.) brings up the attorney general often as interpreting and guiding the events leading up to the hearing……Then on (Page 36)---Attorney general made administrative adjudication over regulation---she made decisions to displace the child's wishes, absent regulations, on the basis of guidance by analogous things but without a regulation. (This is paraphrasing Kneedler, speaking for the Justice Dept.) Kneedler also heavily cited U.N. H.C.R. (United Nations guidelines on immigration).

(Page 44)--Greg Craig when explaining that it would be correct, under U.S. laws, to return a child to a father in East Germany after fleeing with their mother (who was shot in the process) by using universal applications of international conventions and customs. ------- [This is a twisted answer if ever I heard one. Start out your thought with U.S. laws and conclude with the application of international conventions and customs as your defense!]

(Father's reason for not coming to U.S. before 4-5 months)-- Coffey's rebuttal to Craigs assertion that situations both political and administrative were hostile to father and barred Juan M. from coming: Page 46--(INS said to apply in early Dec. '99-and in these cases visas are routinely granted),Page 47,Father answered on form, when pressed to apply for a visa by the INS, "No, I'm not interested." And when asked, do you want to go to the U.S. now to see Elian, yes or no? Elian's father, Juan Miguel, checked, No.

It was mentioned by both sides and a judge that the INS has the discretion to interpret their own guidelines. However, Coffey argues that the INS has the discretion to promulgate rules that are consistent with the rules of Congress and that they should not begin to fashion them, for the first time, in the scope of controversy, or get discretion to make up the rules as they go along, especially in a case of this magnitude, controversy and emotion. Page 49-50)----(Then Coffey starts to take apart U.N. regulations on page 52-53 before being stopped for time and asked to sum up.)

By snatching Elian Gonzalez from his great-uncle's Miami home, the Clinton-Reno regime tip-toed around or trampled at least half of the Bill of Rights' 10 amendments. Here are the constitutional guarantees that now lie tattered:

The First Amendment's freedom of the press provision could not shield an NBC News crew from abuse. Federal agents kicked cameraman Tony Zumbado in the stomach, yanked an audio cable from his camera and otherwise disabled his gear. He told NBC: ``[The feds] put their foot on my back and told me not to move or else they were going to shoot.''

Soundman Gustavo Moller was struck in the head by another officer's rifle and ordered to be still or be shot. Moller told me he suffered a small gash, ``but because it was the forehead, it was bleeding a lot.''

NBC has asked the Immigration and Naturalization Service to explain its actions and why, as NBC News Vice President Bill Wheatley told the Associated Press, ``our people weren't able to do their work because of the actions of agents.''

INS Commissioner Doris Meissner told CBS that overwhelming force was necessary due to ``the possibility that there might be guns'' in the Gonzalez home. So what? The Second Amendment guarantees the right ``to keep and bear arms.'' If the mere presence of firearms on private property justifies such federal behavior, residents of the 40 percent of American homes with guns should sleep with their eyes open.

By using an improper search warrant, the Justice Department violated Fourth Amendment restrictions against ``unreasonable searches and seizures.'' This document was signed not during business hours by the federal judge hearing Elian's case, but on Good Friday at 7:20 p.m. by a magistrate unfamiliar with the matter. The warrant application claimed that Elian was ``concealed,'' which he wasn't, and that he's ``an illegal alien,'' which he isn't. The affidavit also failed to mention Lazaro Gonzalez's alleged weapons that supposedly required a SWAT team's response.

Harvard law professor Alan Dershowitz, a Clinton ally, dismisses this warrant and says the administration, ``acted lawlessly.'' As he told Fox News: ``It's a dangerous day for all Americans.''

The Sixth Amendment includes the right to ``the assistance of counsel'' in criminal proceedings. Elian is no crook, but the spirit of this amendment suggests that he may see the lawyers who are arguing his asylum case. Elian's attorneys currently cannot contact him or even observe his condition while surrounded by U.S. marshals.

Even worse, the only lawyer in touch with Elian is Greg Craig, his father's counsel, who is working to vacate the Cuban castaway's asylum application. This is like having Leonid Brezhnev represent Alexander Solzhenitsyn in court.

The 10th Amendment reserves powers ``to the states respectively, or to the people'' that are not constitutionally delegated to the federal government. Nonetheless, Washington intervened in a child-custody matter routinely handled by state authorities.

The Justice Department alerted then-Miami Police Chief William O'Brien before ``Operation Reunion'' and reportedly ordered him not to inform Miami Mayor Joe Carollo. Carollo had grown close to the Gonzalez family and might have broadcast the news. Still, federal officials should not have meddled with a local government by constructing a wall of silence between a police chief and his popularly elected boss.

Justice's contempt for the 11th Circuit Court of Appeals insults the separation of powers. The department was not deterred by the court's refusal to grant an order to transfer Elian from his great-uncle to his father. When a three-judge federal panel rejected her plan, Jackboot Janet executed it anyway. Of course, all this could have been avoided had Reno simply waited until yesterday's court hearing to make her family-reunification case.

Bill Clinton and Janet Reno harbor neither respect nor reverence for the Bill of Rights and the Constitution. They merely use them to line the federal Leviathan's cage.

Yet an April 24 Gallup Poll revealed that 60 percent of Americans applaud the extra-legal abduction of a 6-year-old boy. This matters because if the president and attorney general skate past this abuse of power, the next time federal agents storm a private home, waving a flimsy search warrant, the door they batter down might be yours.

Cuba routinely invokes forced exile as a condition for prisoner releases and also pressures activists to leave the country to escape future prosecution, in violation of international norms ensuring citizens' rights to remain in their own homeland.137 In November 1998, for example, Cuba released two prominent political prisoners, Dr. Dessy Mendoza Rivero and Jesús Chamber Ramírez, who had suffered serious physical deterioration while incarcerated, on the condition that they go into exile in Spain. In a trip to Cuba, Spanish Foreign Minister Abel Matutes had requested their release along with that of several other political prisoners.138 Armando Alonso Romero said that state security agents at Villa Marista forced him to sign papers saying that if he did not leave Cuba, he would have to complete the remainder of his sentence. He said, "this isn't liberty, it's forced exile" (destierro).139

The "choice" between continued prison terms or exile left the prisoners with no good option. The released Cuban prisoners were extremely reluctant to leave their homeland and their families. Officials at the Cerámica Roja Prison in Camagüey repeatedly called José Miranda Acosta to their offices in March and April 1998, insisting that he leave the country. But Miranda Acosta told them that he wanted to stay in Cuba. He recalled the prison's security director telling him that he could not remain in Cuba because he "had maintained a hostile attitude toward the revolution." The officials brought his brother to the prison to try and convince him to leave and stressed that exile was his "only option." Finally, Miranda Acosta acceded on the condition that he would be able to meet with some family members before leaving. But the government provided Miranda Acosta with minimal time to visit with his family prior to his exile on May 4, 1998. Although he had not seen his daughter during his imprisonment, the state security agents at Villa Marista allowed him only five minutes with her on April 29, in the presence of a state security investigator. They did not allow him to see her again before his departure.140

Although Adriano González Marichal, who was exiled to Canada in April 1998, mourned the loss of his homeland and his inability to see his elderly mother, he noted that "I am proud that we panic Fidel Castro, that he is terrified of twenty people that he's had to deport."141 ---[END EXCERPT]

Dear Cincinatus' Wife and All Others

Although we can all have compassion for the situation posed by the plight of the little Cuban boy, Elian, a boy whose mother came with him in desperation to our shores (illegally) and died by drowning in the attempt to reach our "land of freedom," is this situation any different from the many other unfortunate situations experienced by aliens trying to enter our country illegally?

I know, I know...and you, too, certainly know...you think back to those words at the base of the Statue of Liberty, those words of inspiration to the world's tired and oppressed. America as a nation and Americans as a people surely has absorbed its share into what is supposed to be a "melting pot" where we all benefit by our diversity and sharing of values. But while Castro has numerous times emptied his prisons and sent a mass of humanity to our shores, we did not know, really, whether the person coming to mingle in our midst was a sincere, honest, and unfortunate victim of oppression or whether the person in our midst was a rapist or a murderer in his own country run by a tyrant. We cooped these unfortunates up until we could sort them out, and eventually gave many amnesty and the right of residency and American citizenship.

Before the direction of this reply is taken in the wrong way, perhaps it should be the concern of every American to, as we say, think of "little Johnny" already in America, already an American citizen, already your offspring who also wishes to enjoy all the freedom and rights and privileges that your bringing him into the world gave him reason to think that he, too, deserved your concern and compassion. Yes, think equally of every "little Johnny" just as much as you think of "little Elian," for quite honestly he is your own life and blood, he is your pride and joy!!!

And, as an American adult, with kids in school, how much attention have you given "little Johnny"? When was the last time you broke away from the program on the "idiot box" to attend a Parent-Teacher conference, or go to talk to his teacher about a problem he was having at school? When is the last time, as a parent, that you looked at his textbooks to see if they contained the "right stuff" or whether he was being dumbed-down by the equivalent of pablum for coursework? Although you as a parent know that you want something better than you had, when you went to school, have you really prepared yourself to evaluate those things he's expected to absorb, or have you left it up to some goody two-shoes member of the local school board to decide the material that is supposed to prepare your "little Johnny" for the future that hopefully will be better?

All of what you say may be true, as you pose it, when "we, the people" need to let our representatives in government know what we believe to be the direction we should take as a nation. We MUST be active, but first we also must be informed. And, to be informed means that we each must be able to take our nose off the grindstone long enough to look up and see the horizon, to see the direction of this country that seems to daily lose sight of freedoms and rights that we know are buried somewhere in that U.S. Constitution and in our Bill of Rights. Is it not true that many an immigrant coming to our land, knows the basics of the operation of our government better than we do by having to pass the test in American citizenship BEFORE he can receive American citizenship? Is it not true that too many Americans who were born and raised in this wonderful country never have taken the time to know the workings of our American government by some self-study of the U.S. Constitution...they drift along with the crowd and, when it comes to leadership, "let George do it."?

Perhaps we need a "wake-up call" to our own well-being and to that of our own children, personified here in that proverbial kid we call "little Johnny." He, too, deserves our utmost attention, for he depends upon us for his guidance and hope for the future.

While we can all sympathize with the plight of one "little Elian" from Cuba, perhaps we should at least give EQUAL attention--IF NOT MORE--to our responsibilities to every "little Johnny" in America whose future rests in our hands by our adult concern, OUR parental guidance, AND, most importantly, by participating in government by exercising our DUTIES as active, informed citizens.

Thank you for your timely reminder that we should always foster the love of freedom and the knowledge of what it is, in our children.

This is the court order issued by Miami Circuit Judge Rosa Rodriguez declaring that Gonzalez must stay in the country until a March 6 court hearing. The decision, which was hailed by Miami's Cuban expatriate community, was rejected by Attorney General Janet Reno, who asserted that the Gonzalez matter should be decided by federal authorities, not a local court.

That preceeds the filing, in the above post, on the "Smokinggun site."
Looks like Janet and Bill don't like the states deciding anything.
On May 11th, during the oral arguements before the 11th Circuit Court of Appeals-Atlanta,
it was made quite clear that the INS has wide discretion to interpert their own guidelines.
It was also pointedly discussed that they shouldn't be making such total reversals
about what the "rules" are, during the heat of this emotional issue.

It's interesting when the facts start oozing out.

I'm surprised the Miami community didn't riot!
I'm glad that they didn't and amazed at the calm and quiet daily prayer vigils held everyday of the media and Justic Department siege.
I can see they knew they weren't going to get help from the feds and were looking to a higher authority and power.
They worked within the guidelines of the law and were called lawless.

We need to continue the fight and to pray that God give this child a voice louder and more powerful than those who have been lying and spying for Castro.

He had secret security clearance -- a fact that had immigration lawyers fielding calls Friday from Cuban clients concerned about the possibly sensitive information that Faget could have given to the Cuban government. The INS said it is reviewing all cases and files on which Faget worked, a massive undertaking.

``Whenever there was a Cuban issue, he was involved,'' said immigration lawyer Leopoldo Ochoa, who handled the controversial citizenship case of trumpeter-defector Arturo Sandoval.

Lawyers are concerned on two fronts -- the secret information Faget could have delivered to the Cuban government and the Cuban agents he could have helped plant in South Florida to monitor the Cuban exile community.

[my comment on that thread]--- This part about Gary Hart caught my eye. I posted a story about a year ago, it could be longer. Perhaps we could find it in Alamo Girl's encyclopedic downside legacy source. The article was about a government investigator that had been running a security clearance on Gary Hart. When the questions started getting personal, Hart called on his friend Secretary of Defense Cohen to intervene. I believe the clearance was being done so he could be on a defense department committee or something. There were more interesting connections between Cohen and Hart and I hope I ,or someone, can find this story. The investigator, who had been doing his job, was removed from or quit his job, I think, I'm not sure.

For those who don't know about the Faget arrest in Miami, he was the acting INS district deputy director in charge of asylum examinations when Elian was going through the process. Go here to read the shocking details. He is currently standing trial for spying. I belive the case has gone to the jury.

The following from Alamo-Girl's file USA Today 8/10/99 Edward Pound "...A group of influential Republican congressmen pressed Defense Secretary William Cohen on Monday to reinstate an investigator who was removed from his job only hours after he began a security background review of Cohen's old friend, former Colorado senator Gary Hart. Twenty House members, including the chairmen of two committees and four members of the Armed Services Committee, sent Cohen a letter of "protest" demanding he rescind a proposed 30-day suspension of David Kerno, who works for the Defense Security Service in Lakewood, Colo., near Denver. Kerno, 53, described by the lawmakers as "a professional and principled investigator," does not deserve to be punished for doing his job, the letter said. Kerno began to check into Hart's background last year after Cohen named the Colorado lawyer to the prestigious National Security Study Group, a panel that will make an extensive review of the nation's security needs.....In his background inquiry, Kerno asked colleagues in a Denver law firm about Hart's personal life. Later that day, Hart complained to Cohen's office. Within 30 hours, Kerno was assigned to a desk job.

The Defense Security Service later started suspension proceedings against him. Kerno has said he was only doing his job, which requires agents to dig into personal lives. Hart's relationship with a part-time model forced his withdrawal from the 1988 presidential race.

The security service conducts background checks on Defense personnel and others requiring access to classified data. The agency also has been sharply criticized for mismanagement and failure to cut an enormous backlog of investigations. The General Accounting Office, a congressional watchdog agency, is reviewing the agency's practices and will issue a report this year. In their letter, the lawmakers said Cohen's failure to defend Kerno was "astounding and only highlights this administration's lack of concern for the important national security interests behind personnel screening and the security clearance review process." They said the questions Kerno had asked Hart's colleagues were "standard procedure" for background inquiries. The lawmakers urged Cohen to halt Kerno's "threatened punishment," an act that would "reassure the public that the background investigation process will remain above board...."

This is no blow to the rule of law. This is a blow to government intervention into families and their rights. A decision against Juan and Elian would have opened the door for the government to take on anybody that disagreed with the modern agenda. Teach your kids that homosexuality is wrong? I get replies to both e mail and to snail mail, the secret with e put your address on there and let them know you are expecting a reply. On gun issues we sign our mail as lifetime voting members of the NRA usually sending along a bumper sticker "I am a gunowner and I vote". On issues where Republicans side with democrats, I do not hesitate to use my signature as Republican County Vice Chair, and to the one democrat that represents us I do not hesitate to use the signature of Election Commission Officer.

I also am quick to remind them that they work for me, we pay their salary. I also am very quick to let them know that I will be putting their votes on Free Republic and other webpages for the world to see. Use whatever firepower you can find to let these employees know we are mad as h#ll and we aren't going to take it anymore!!!!!

I haven't had much success, but I'm glad that your efforts are being recognized. I was so upset with the Minnesota Republican's captitulation to the DFL and Jesse the Fraudy, that I ripped up my MN Republican membership card and mailed it to my Representative. I received a hand-written response within days. They need to get a sense of urgency.
