Notice: Final Judgment has been filed in LAT/WP vs Free Republic

Miscellaneous Breaking News Announcement
Source: Free Republic
Posted on 11/21/2000 10:14:12 PST by Jim Robinson

We have received word from the Plaintiff's attorney that final judgment in the alleged copyright infringement lawsuit brought against us by the LA Times and Washington post has been filed. We have not officially been served yet, but presumably that will happen shortly. We stipulated to judgment in order to move from the trial court to appeals. Brian will be filing an appeal immediately. There is nothing in the judgment that is new or unexpected. We've been expecting this ruling for over a year since the judge wrongfully denied us our fair use defense, thus depriving us of our constitutional rights.

Brian and I will be posting more on this later. We will also post a list of sources that we have been enjoined from posting full text. Mainly, it's the Los Angeles Times and the Washington Post and any of their subsidiaries. Please do not post from these sources until after this issue is resolved by the appeals court or eventually the Supreme Court.

Thanks,

Jim Robinson

Jim, I'm an attorney in Texas who has done some appellate work. Let me know if I can help at all in the appeal. I can do research, drafting, whatever. I know you probably have good attorneys, but if I can take some of the load off them and lighten any fees, I'm good to go.

The 9th is the most liberal court in America. I wonder where freedom of speech in the market place of ideas stands nowdays in the liberal hiearchy of values. Maybe it depends on the political correctness of the speech.

That's a good question. I've got a gut instinct that Jim will prevail. The 9th still has that old-school liberal instinct in them. But you never know what interests they have beyond the facts in the case.

We shall go on to the end.
We shall fight in France,
We shall fight on the seas and oceans,
We shall fight with growing confidence and growing strength in the air,
We shall defend our island, whatever the cost may be.
We shall fight on the beaches,
We shall fight on the landing grounds,
We shall fight in the fields and in the streets,
We shall fight in the hills;
We shall never surrender.

The public service that has been this website during the election and continued mess is self-evidence of the "fair use" nature of FR's handling of articles.

To: Jim Robinson, clarity

Bottom line: We don't need the WP or the LAT to be effective. On the contrary there's more juice in this site then they ever had or ever will have.

Even if we don't post their articles we can monitor them and expose their lies despite their kicking and screaming. One thing we should not do is link to them in any way whatsoever. Why should FR supply them with thousands of hits?

I'm not a lawyer, but if there is a way to do shun them, minimize our exposure and keep Jim and FR from getting hammered, most or all of us would be all for it.

You are correct. But the LA times is the most inaccurate, most biased, most blatant propeganda piece of bird-cage lining that was ever printed. The editors and managers of the LA times put W.R. Hearst and Pravda to shame.

It was a proud and happy day that I cancelled my subscription.

They are cheap, hire malleable young reporters at low wages who can be shaped and molded into the progressives they want to disseminate information. They have no sense of history, and use words, phrases and terms without even knowing their historical meaning or context.

In essence, I believe they are deliberately trying to dumb-down the citizens, to muddy the waters so that the truth can never be seen.

Moreover, they are greedy, and are willing to sell favorable news stories to advertisers. This makes them a truly worthless source of news. Unfortunately, they are the only game in this town, and as such they must be challenged on every front.

Finally, and most egregiously, they recently reduced the size of their paper in an effort to save money, and as a result had to reduce the print size to 90% of it's former size. Now my grandmother can't even read it anymore even with her glasses. They made my grandmother upset, and anyone who makes my grandmother upset deserves as much scorn and derision as anyone can heap.

If they take down this site, we'll just start another. That's the beautiful thing about the Internet and the software technologies that exist. Just like Napster, no matter how many Big Brother shuts down, more will crop up. And there's a revolution coming in peer-to-peer networks that require NO central server. So there's NO ONE THING to be shut down.

"These are the times that try men's souls. The summer soldier and the sunshine patriot will, in the crisis, shrink from the service of their country; but he that stands now, deserves the love and thanks of man and woman. Tyranny, like hell, is not easily conquered; yet we have this consolation with us, that the harder the conflict, the more glorious the triumph. What we obtain too cheap, we esteem too lightly; 'tis dearness only that gives everything its value. Heaven knows how to put a proper price on its goods; and it would be strange indeed, if so celestial an article as freedom should not be highly rated." -- Thomas Paine

I think that we should include Jim and the Free Republic on our holiday gift lists.

Now here is the foundation of a great idea. Many people have mentioned initiation of a "holiday sales slowdown" to send the message that we will NOT accept Al Gore as the legitimate President. What better way to make a statement of this nature than by diverting the funds you WERE going to spend on a liberal enterprise (Disney, the entertainment industry, L. L. Bean, on and on) to Jim Rob and Free Republic. How about those irritating Democrat/liberal relatives everyone has been complaining about over the past couple of weeks? Don't waste money on a gift...send them a Christmas card, and include a little "gift card" indicating that the money you were ORIGINALLY going to spend on a holiday gift for them has instead been donated to the CONSERVATIVE website, Free Republic. (In THEIR name, of course...that should REALLY frost their backsides.) The GIFT of Freedom...what more could anyone ask for during the holiday season?

Even if we don't post their articles we can monitor them and expose their lies despite their kicking and screaming. One thing we should not do is link to them in any way whatsoever. Why should FR supply them with thousands of hits?

Is that fair game? Post or LA Times "vanities" in which we pull out and eviscerate with the facts their more misleading, deceitful and vacuous "news"?

Duly noted.

Give 'em hell, Brian. Trust you and your family enjoy the holiday. I'm taking some McKenzie's "oyster patty" pastry shells and a sweet potato pecan pie from a good friend (and best pastry chef in town) with me to my grandparents. I've learned to eat things down here I didn't know existed! Thanksgiving's have never been the same.

(I did learn not to bring barbecued shrimp to the family supper back home in Tulsa, though ... scared the kids and flummoxed the help at the seafood shop when I asked for "heads on". =)

They asked us not to appeal, and they offered to forego all damages, costs, and attorneys' fees if we would just not appeal. Ha!

First of all, knowing you sense of humor, are you serious about this offer? If so, just how big of a check are they willing to write to JimRob in order to avoid looking stupid in the 9th Circuit? I would assume they would also be willing to pay all of FR's legal fees at your current going rate plus a increased factor based on the complexity of the litigation, the contingent nature of the fee arrangement, the resources of the opponent, etc. I thin a factor of 2-3 wopuld be appropriate, don't you?

This should be a lesson to all. Never, ever, attempt to screw over a patriot who is willing to risk everything, because you cannot win!

I don't care how much they offer. The founders did not intend for the congress to lock up political free speech or news of government corruption, usurption and tyranny through copyright law. Ya know what, JimRob.....throughout this damnable mess, it keeps coming back to me the interview I saw of the spineless UT Senator Hatch. It was an interview in which he intimated he had been a Democrat in his past--this was alluding to the fact he and Teddy the Swimmer are such great buddies.

During this interview, he said that all of Congress gets subscriptions, i.e., the WP (and I think he said another paper--maybe one of the NY ones) and some magazines. I don't recall that he specifically said "at the expense of the taxpayers", but that was the distinct clear impression I came away from the interview with--because it filled in my old question of "why do these damn politicians keep citing newspapers as sources of authority for anything"....they're always asking to have an article from some paper or magazine put "in the record".

This topic of paid subscriptions is in my list of things to research. If I find that we sucker taxpayers indeed pay for these subscriptions, what do you say about doing some hell-raising?

From ArtB's link...

2. IT IS FURTHER ORDERED that the three named Defendants (Free Republic, Electronic Orchard and James C. Robinson), and each of their officers, agents, representatives, alter egos, shareholders, partners, joint ventures, heirs, executors, administrators, parent entities, affiliates, subsidiaries, divisions, legal predecessors, successors, assigns, licensees, and any and all persons acting in concert therewith or participating with them who receive actual notice of this order, must:

(B) post on the home pages of freerepublic.com, freerepublic.net, and freerepublic.org to a web page at freerepublic.com containing a copy of the Final Judgment and the attachment to it for ninety days beginning no later than two weeks after the date this Final Judgment is signed. These links shall clearly and legibly state they are links to the Final Judgment in this case.

Since this is stipulated, and FR "We have not officially been served yet, but presumably that will happen shortly.", it does seem strange to have someone other than "the three named Defendants" has posted the decision. Just a thought!

No, "we" damn well do not. In Britain, "we" pay a hefty fee every year to fund a government broadcasting service that dominates the airwaves 24/7 with relentless socialist left-wing Europhilic agitprop. The fact that "we" have one or two decent conservative newspapers left is no reason to be smug. America has a couple left, too.

If ever FR were looking to move to a server outside the US, you can bet your bottom guilder Europe (and countries sucking up to Europe) would be the last sensible place to launch a platform for free speech. Ask Jörg Haider.

The Far East, maybe. One or two countries out there are practicing real capitalism...you know, the kind where greed trumps politics.

To: cunning

cunning:

I should have suspected as much from you - every time Britain is mentioned you seem to have a problem. Very well, let's dissect your crap and sort through the remains.

First and foremost - what agitprop are you talking about. While I will admit the BBC has declined in quality since New Labour has assumed power, people like David Frost still maintain some standards. In any event, to suggest the BBC is nearly as bad as ABC, NBC, CBS, CNN is the height of stupidity. Even if I were to accept that argument, I could counter with the fact that Sky News is just as popular - which is high quality (owned by the same people who own Fox News no less).

Next, it is not just the presence of some national right wing papers that means the press is free. It is that they are more widely read than right wing papers in the USA. The biggest selling daily broadsheet is the conservative Daily Telegraph. The biggest selling daily tabloid is the conservative Sun. You cannot say the biggest selling newspapers in the United States are conservative. What is more is that you will find the left wing newspapers will tell the truth, even if it is unpalatable - for example, after the Sudan bombing, the left wing Observer broke the story the following Sunday that it was Wag the Dog.

Finally, the kinds of chicanery in elections that are going on in Florida are simply unheard of in Britain. It simply has not occured. The political system thus retains some level of honesty - Blair does get roasted on a regular basis, unlike America which has a "peerless leader" approach to Clinton. And thus, if all else fails, Jim could move FR to Britain without fear.

Now, are you going to listen, or just be an anti-British bigot?

Ivan

Oh-ho! You want issues?

Lessee...you post that Britain (presumably unlike America) has a "free press", hence locating FreeRepublic in Europe (that's Europe, ladies and gentlemen) would somehow put the server beyond the reach of "leftist bastards".

When called on this, you counter that the BBC is better quality than US broadcasters (uhhh...well, maybe...but what does this have to do with a free press and leftist bias?), that the Telegraph sells more copies than do US conservative papers (sure, it's a wonderful paper...but what do sales figures have to do with anything?), that UK papers are willing to tell the truth (but the example you give is of a US scandal they were happy to expose...they ain't so quick to dish the dirt on, say, the EU, are they?). Finally, you suggest that the UK would never tolerate the shenanigans we are seeing in the US right now. No, it very likely would not. But what on earth does that have to do with...free press and lefties and servers and...what we were talking about?

Bottom line: the teeming masses in both the US and the UK are basically conservative and under a pitched ideological assault from the Left, including a predominately leftist press. Europe is under no such assault; it is miles to the Left and delighted to be there. You can't pitch a croissant in Europe without hitting a leftist bastard. (On the topic of free speech, I do hope you caught the fascinating item in the Independent recently: Now It's Blasphemy to Mock Europe).

I don't attack your posts because I've developed a sudden allergy to your cologne...I do so because you talk the most incredible rubbish.
