The Free Republic Legal Defense Fund
As most of you know, Free Republic is engaged in a life
and death struggle with elements of the socialist
propaganda machine, namely, the Los Angeles Times and
the Washington Post, over whether or not the First
Amendment guarantees our rights to gather in our
electronic townhall forum where we virtually pass around newspaper
clippings of news accounts of government abuse and or
unconstitutional expansion, for discussion and critiquing
purposes.
The LAT/WP has brought suit against us in federal court for alleged copyright infringement and unfair competition. The trial judge in the case erroneously disallowed our fair use and first amendment defenses, basing her ruling on the false assumption that Free Republic is a commercial enterprise. We have appealed to the Ninth Circuit Court of Appeals where we hope to prevail. We have just filed our final reply brief in this appeal. Looks like Brian Buckley and his crew have done a terrific job in presenting our case. If all goes as expected, we believe that oral arguments will be heard in September. Free Republic is the premier conservative news forum on the Internet. We started in 1996 with just a few dozen posters and now in our fifth year we have grown to over 60,000 people who have registered and or are participants or readers. Free Republic rallies and activism efforts helped impeach President Clinton and our "Sore Loserman" campaign prevented Al Gore from stealing the White house. Free Republic is not affiliated with any political party or news source. We are a completely independent grass roots discussion group. Why do I have the feeling that, if a liberal counterpart to FreeRepublic (though none of them even come close to being like FR) was to copy the WP/LAT's propaganda and paste it all over their website, they would have absolutely no problem with it?
Methinks that they don't want to enforce the copyright laws. They just want to eliminate and irradicate any harsh criticism of their works and ideology.

Brian, did you ever see my post about another "fair use" case making its way through the Ninth Circuit, Ellison vs. AOL ? The latter case, juxtaposed with the FR case, points out the difference between the application of the doctrine to creative writing and to news stories.

The Post and it's owners are total hyprocrites. They didn't have any problems publishing the entire STOLEN Pentagon Papers in 1972.
All those STOLEN documents the Post uses to break scoops don't seem to bother them. They'll give you a line about "freedom of press", but it seems that "freedom" is a notion they think can be copyrighted!

A search party was sent out a long time ago to find, and if possible rescue, the Los Angeles Times' journalistic integrity.
Unfortunately, the search party has never been heard from and is feared dead. Rumor has it - and this is only rumor - that the search party is buried beneath Staples Center and that the Times' journalistic integrity is still at large, lacking a medium, and ever so small.
We have appealed to the Ninth Circuit Court of Appeals where we hope to prevail.
Actually, you might be better off if the 9th rules against you. They have such an abysmal record of getting overturned by the Supreme Court that whatever they rule is more likely to be wrong than not.

I am with you all the way in the court case, you should be able to post their crap, however the "socialist" conspiracy that you point to is based on theory, not fact. If they are Socialist explain this - WDIV (Detroit) (NBC), KPRC (Houston) (NBC), WPLG (Miami) (ABC), WKMG (Orlando) (CBS), KSAT (San Antonio) (ABC), WJXT (Jacksonville) (CBS).
The above are affiliate television stations owned by the Washington Post Company. If indeed the Washington Post Co. is headed by "socialist" stock-holders, middle-managers, Editors (at it's publications and news-desks), and perhaps even the financial officers are a part of the whole thing. General Electric one of the major producers of military and civilian aircraft as well as a major player in the Nuclear power industry owns the NBC parent and Westinghouse another defense/energy player is a part of the ownership of CBS.
Certainly these companies, frequent contractors (huge receivers of TAXPAYER dollars) must be headed by extreme dupes or a part of the conspiracy. Either that or their business dealings are done with complete ignorance.

Well, it is a fact that the Washington Post and the Los Angeles Times promote socialism, as does most of the mainstream media. They hate our Constitution with its strict limits on federal power, and so must destroy it in order to advance their agenda.
Contrary to our Founders and our forefathers who agreed with and ratified the U.S. Constitution, they want a BIG and POWERFUL centralized federal government. They want the federal government to control every aspect of our lives, health, education, welfare, the environment, the economy, religion, charity, business, agriculture, manufacturing, production, transportation, capital, labor... everything. Right down to the amount of water to flush our toilets.
They promote "saving" social security rather than abolishing it. And increasing the confiscatory income tax rather than eliminating the jackbooted IRS and the slave tax. SS is nothing but an unconstitutional socialist wealth redistribution scheme - a Ponzi scheme at that.
They favor high taxes and wasteful government spending on just about any socialist program you can imagine. They defend corrupt politicians as long as they are liberal democrats. Sure, they wrote editorials admitting that Clinton and Gore were corrupt (how could they not when it was so obvious to every man, woman and child in the nation). But then they went ahead and urged their readers to vote them in anyway. In their liberal eyes, anyone who is not a Republican (or conservative) deserves to be elected or reelected, no matter how corrupt.
They advocate nationalizing our health care system. There is absolutely no reason in the world and no constitutional authority for the federal government to get involved in health care. Just one more huge abusive government program for the politicians to screw up and corrupt, while the taxpayers and private citizens take it in the shorts.
Directly contradicting the second amendment, they advocate gun control. Actually, they are in favor of disarming the American citizen.
They advocate ignoring the fourth amendment and authorizing no knock raids, government snooping into our bank accounts and business records, wiretapping, and other covert information gathering tactics.
They promote liberal activist judges and liberal twisting and distorting of the Constitution. They promote world government institutions and programs such as the United Nations, and other schemes and international treaties that would dilute our national sovereinty and subject us to world powers and tyrants who would disregard our constitutional protections.
In short, anyone who reads the articles and editorials from these sources and does not see them for what they are, big government advocates, are probably blinded by the socialist utopian dreams themselves.
Yes, we are at war with the socialists. We have met the enemy and they are our national socalled free-press.

I didn't say it was a conspiracy, the media is simply a product of liberal education. The entire political spectrum has been in a leftward slide for over a century as government controlled schools and universities turn out more and more liberal product. As a result, the media is liberal, the people are liberal, the politicians are liberal, the judiciary is liberal and the government at all levels is liberal. Liberalism begats more liberalism. Liberalism is like a plague. If left unchecked, it spreads and lays waste to all humanity within its reach. The progressives and socialists of the last century have done their job well.
And obviously, this is not a problem confined only to the USA. In fact, most other nations are already socialist or communist or ruled by dictators or tyrants. Great Britain is socialist. France and most of Europe. China. Canada. Australia. Because of our conservative heritage and the stubborness of the few remaining individualists who refuse to give up our cherished Constitution and Bill of Rights, especially the first and second amendments, America is one of the last relatively free nations on Earth. But freedom is fading fast.
In my opinion, both of the major politcal parties have shifted left. The democrats are way beyond liberalism. They are now full-fledged socialists. The Republicans are the new liberals. There are very few conservatives in office in either party. None of the Democrats respect the Constitution or the concepts of limited government and separated powers as established by our Founders, and the Republicans are not much better. Neither party respects the sovereignty of our state governments, and the general population has been dumbed down by the liberal state run schools to the point that they have no idea what the true purpose of government is or what liberty is all about, and they do not know enough to be alarmed at the leftward trend. They're fat and happy and smug in the false security of a benevolent government and its saftey net. Safety net? Truth be known, it's more like a death shroud.
As far as corporations are concerned, they grease the political skids by providing campaign cash in return for favors rendered. Corporations play both sides of the aisle. And the taxpayers and consumers get stuck paying the freight.

Bill Clinton, Al Gore, NAFTA and NAFTA expansion to the FTAA - both the pres, former vice-prez and the most popular Dem for President in 2004 FULL FAVOR these deals. There must be a whole lot of Socialists running through the halls of Corporate America.
Short-term-ology. The corporate officers and functionaries read the economic tea leaves and see that the short-term dollar is made more readily, or the short-term risk abbetted by greasing the federal gears. Don't have to be socialists -- just a "booster" in the Sinclair Lewis sense. Easier to buy legislation and legislators in the socialist model, perhaps, certainly so in the unaccountable-to-the-Constitution mode. And once you own a piece of the legislative or regulatory pie, it's hard to give it up.
The Constitutional mode of Federal Government is a very hard road to hoe -- it requires men of dedication to Liberty and Justice, and not mere politicians. In politics, one has to be political, but our Constitution requires that men (and women) often make hard and long term judgements.
Witness the adept Democratic politician, Grover Cleveland, who refused to allow federal flood relief funds because they were un-Constitutional.
But still, after a century of the secular socialists in charge of our education (post John Dewey), and about the same length of time with highly corruptable fiat money run by the unelected Fed, we do have a lot of socialistic thinking everywhere -- including boardrooms. The larger the business, probably the more so.
You know, worse than the enemies that are before us, in plain sight, are the ones that are crawling around where we don't see them right now. There are alot of people out there that want FreeRepublic gone. We should support Jim Robinson and this site, with this in mind. Everyone should remember that there may, no...WILL be other attacks in the future! Best we be prepared for them now!

I believe Mr. Buckley is the same attorney representing Glenn Spencer of VCT regarding fair use doctrine and First Amendment Right to freedom of speech. I saw him at a public meeting on Sunday regarding the illegal immigration out in California and the lawsuit filed on behalf of Glenn Spencer regarding the omission of Spencer's ad regarding the illegal immigration problem and Antonio Villaraigosa.
Howdy JimRob...do you happen to know what happened to posts 2-6 of this thread? Never seen a thread do this unless what someone posted was breakin' FR rules of conduct, and I can't recall that they were...especially the post #5 that I had replied to. Gremlins at work again?

Attorney Flyer is an outstanding attorney and is being brought up to speed on the facts of this case. He is as sharp as a razor. Should it become necessary to give an oral argument or take other action to pursue this case to a successful conclusion, I have complete confidence in his abilities.
Revealing further details would, of course, provide Eschoir and the Anti-Freepers something to distort and spin-doctor. Hence I have chosen to delay any announcement as long as possible.

While the commentary is, in many ways favorable to our cause, the above shows how pervasive is the misunderstanding as to the pupose of our form of government. Besides many liberals, I'm sure there are Neo-Cons at the Weekly Standard and others on the conservative side that buy this Utilitarian, economic based, vision of our Republic's raison d'etre. I don't. Creating Markets is certainly nothing the founders had in mind for our government. As the futility of planned economies and liberal vision in general became more evident in the last fifty years, the "creating markets" purpose to government became the fall-back position of many. Since planning won't work due to free market forces, went the arguement, then let's Use free market forces.

It seems to me that what is done on Free Republic is no different then me clipping a picture or article from a town paper and sending it to a relative.
When they take our vehicle of discussion away, I guess talking will cease which just leaves ACTION. Take names and kick ass!!!!!

Unquestionable true, and of course so do the owners of the property rights. Where it gets interesting is when certain such owners show contempt for other owners. For example, one large metropolitan newspaper clinging to its own rights is downright contemptuous in an editorial today regarding Microsoft's intellectual property rights:
"[Federal District Court Judge] Kollar-Kotelly should demand that Microsoft hand outsiders the software keys they need to write programs that work on Windows. Software disclosure would not undercut Microsoft's ability to profit from selling Windows. It would only increase Windows' legitimacy by helping its operating system run the sort of programs that ordinary PC users want, not what arrogant Microsoft bosses think they should use."
