THIS is a lesson about sex and school.
A Bronx teacher was accused of having sex with a student for years, starting when the girl was 15. He admitted it on tape in 1995.
He is still teaching in a New York City public school.
When HIV-positive teacher Milton McFarlane last month was accused of having sex with boys in his Bronx classroom, New Yorkers wanted to know how it could happen.
A better question might be: How often?
I've reviewed files of a teacher and an administrator whose sex-abuse cases reached binding arbitration - a kind of trial used to discipline bad teachers. It was an education.
As with McFarlane, the cases were ignored or badly bungled from start to finish.
Thomas Gibbons was a tenured special-ed teacher at William Taft HS in The Bronx, a young, handsome white man in a sea of minority faces.
His heroic image was tarnished in 1995, when Gibbons was arrested for grabbing a young woman by the hair inside Taft, slamming her against a wall, and holding a gun to her chest.
News reports at the time described Gibbons as angry over the girl's attempt to end a long-term affair. It started when she was a 15-year-old student, a recent immigrant from India.
The case went to Special Schools Investigator Ed Stancik, and one of his gumshoes taped the victim's phone calls.
Gibbons called. On the tape, recorded without his knowledge, Gibbons detailed their long sex life. He begged the girl to drop the charges. She agreed.
"It is clear . . . what kind of power this man had and continues to have over [the girl]," Lawrence Becker, former school system counsel, wrote to then-Schools Chancellor Ray Cortines. "She was tricked and manipulated into dropping the charges."
Another former student told investigators that she was sexually touched by Gibbons nearly four years earlier. Her mother complained to the principal, but no action was taken.
Stancik abruptly dropped the case, after the victim refused to testify. Stancik bounced the case to the Board of Education's own investigations office - the same move that allowed McFarlane to slip through the cracks.
In 1996, Gibbons was tried before arbitrator Margaret Leibowitz. The tapes in which Gibbons talks about sex with the girl were the smoking gun.
But Leibowitz, who needed only a "preponderance of evidence" to fire Gibbons, found the evidence insufficient and did nothing.
Gibbons now teaches at John F. Kennedy HS in The Bronx.
Reached yesterday at his Westchester home, Gibbons, 47, complained, "You're calling me to talk about something from the past," and "I've never been convicted of anything." He refused to speak further.
Repeated calls to Stancik's office went unanswered.
The case of assistant principal Joel Sklaroff is also troubling. In 1992 and ‘93, three students at Manhattan's HS of Fashion Industries complained that the married man touched and propositioned them, threatening legal action if they turned him in.
He gave one girl a valentine bearing the message: "Who says that there must be an ‘age barrier.'"
Unable to be heard, the girls went to cops in 1995. In a memo, principal Charles Bonnici explained that he did not believe them.
Bonnici, still principal, did not return a call.
The case went to Stancik who, again, bounced it to Board of Ed investigators.
At Sklaroff's arbitration hearing in 1996, Deputy Chancellor Judy Rizzo was to testify, but she didn't show up. Later, Rizzo was seen with then-Chancellor Rudy Crew at a Yankee parade.
Rizzo, still a deputy chancellor, did not return a call.
Sklaroff wasn't fired. He was suspended for a year without pay by Arbitrator Thomas Lang and transferred in 1998 to Graphic Arts HS.
Reached in The Bronx yesterday, Sklaroff, 54, said he was "on leave" from the school system.
He refused to tell his future plans.
when are people going to face the facts - perverts with AIDS are a special class of perverts and certain federal rights - which in effect is - they should be allowed to molest or rape any child they want - this is because they are a special minority class and they have federal protection - if anyone does not agree with them - it is considered a hate crime - that is because you dont agree that they should be able to do anything they want to any child - there are many states where perverts are under federal protection - so before you start protesting about perverts molesting your children - you had better read the laws - they are a protected species and you have no right to question whatever they do.
