Dan Burton is chairman, by producing such things in room 2157 of the Rayburn Building, in the city of Washington, on September 11, 2001, at the hour of 5:00 PM

This works for me. The executive and legislative branches have an honest disagreement about privilege? Fine. Take it to the judiciary, and let them sort it out. That is what the separation of powers is about. Both the legislature and the executive believe they have rights -- rights conceded are rights lost. The two branches disagree about what those rights are. Let the courts settle it (that is their job), then call it a fair fight with no hard feelings.
Does anyone seriously think that Mr. Bush will not willingly comply with the court's eventual conclusion in this case? This is a man with tremendous respect for the law. But just because you respect the law does not mean you roll over and play dead. Similarly the Congress should not roll over and play dead.

There is no logical reason why the documents requested, which span 4 decades,
should not be turned over as required.
They should have been handed over without the need for a subpoena.

I personally don't because Dubya does respect the law and continues the de-clintonizing of the White House - i.e., continue doing the right things. Like it was prior to clinton taking office.
Check out Thread 1 and you'll see a lot of discussion regarding the probability that he used the executive privilege to posture himself so as not to look like he was trying to sick the dogs on clinton. Well folks I used exec privilege but now the court says I have to comply and so here it is.

Alternative theory..Burton has already "seen" the material..if there wasn't anything hot, he wouldn't bother going after it..this is carefully choreographed...possibly for two reasons...1)..to make Bush seem a good guy, and possibly a sting operation on Waxman..see if the House Dems shoot themselves in the foot...BTW, it'll be interesting to see if Lantos plays nice this time......he has got to be thrilled with the way Bush and Powell avoided the UN conference...compared to the way Clinton hung Israel out to dry....so maybe Bushs will have an unexpected friend at the hearings..I'm not holding my breath, but I wonder if Lantos might behave a tad more even-handed..

Ashcroft needs to give up anything and everything related to Burton's request - and let the chips fall where they may.
Personally, I would not be embarrassed by having an ex-POTUS locked up at Leavenworth. It's way past time that some folks begin to reap what they have sown.
