U.S. Islamic Leaders Issue Fatwa on U.S. Muslim Soldiers Fighting Other Muslims

(U.S. Muslim soldiers need to defend their country and combat
terrorism) (720)
By Phillip Kurata
Washington File Staff Writer

Washington -- Two prominent Islamic scholars in the United States have
issued a fatwa, or legal opinion, on the importance of American
Muslims serving in the U.S. military to defend their country and
combat terrorism.

"All Muslims ought to be united against all those who terrorize the
innocents, and those who permit the killing of non-combatants without
a justifiable reason. The Muslim soldier must perform his duty in this
fight despite the feeling of uneasiness of 'fighting without
discriminating.' His intention must be to fight for enjoining of the
truth and defeating falsehood. It's to prevent aggression on the
innocents, or to apprehend the perpetrators and bring them to
justice," the fatwa reads.

It was written by Taha Jabir Al-Alawani, President of the Fiqh Council
of North America and President of the Graduate School of Islamic and
Social Sciences, and Sheikh Muhammad Al-Hanooti, a member of the fiqh
council. The two Islamic scholars issued their legal opinion in
response to a query submitted by Chaplain Abdul-Rashid Muhammad, the
most senior Muslim chaplain in the U.S. military, who sought guidance
on the permissibility of U.S. Muslim servicemen to participate in the
war effort in Afghanistan and other Muslim countries.

"Muslims are part of the American society. Anyone who feels he's
fighting in a just war must fight," Al-Alawani said.

"We abide by every law of this country except those laws that are
contradictory to Islamic law," said Sheikh Al-Hanooti. The sheikh
added that U.S. Muslim military personnel may refuse to fight on the
grounds of conscientious objection.

"If any Muslim serving in the U.S. Armed Forces has a conscientious
objection to combat and believes that it is against Islamic principles
to fight in any war, then that individual has the right to stand by
his or her concience," Al-Hanooti said. "They realize, of course, that
they may be administratively separated from the military as a result
of their choice."

Muhammad, who is stationed at the Walter Reed military hospital in
Washington, says there is no conflict between being a loyal soldier
and a loyal Muslim. He is helping some Muslim American servicemen deal
with their qualms about fighting terrorists who claim to represent
Islam.

"It is time now for us to not only wake up, but speak up," Muhammad
said in a recent interview. "The prophet said when we see evil action
we are compelled to change it with our hand, challenge it with our
tongue or at least hate it in our heart."

Muhammad, an African American who was raised as a Baptist, became the
first Muslim chaplain in the U.S. military in 1993. Until then, all
the 3,150 U.S. military chaplains were either Jews or Christians. In
1996, a second Muslim chaplain was commissioned by the Navy. Since
then the number of Muslim chaplains in the U.S. military has grown to
14.

Qaseem Uqdah, a Marine Corps veteran who is executive director of the
American Muslim Armed Forces and Veteran Affairs Council, said the
Muslim military chaplains include Muslims who were born into the faith
in Asia, Africa and the Middle East and Muslim converts, who include
several African Americans, an Anglo-American and a Chinese American.
Uqdah's group has been selected by the U.S. military to recommend
people as Muslim chaplain candidates.

U.S. military officials say a shortage of candidates with the required
education limits the number of Muslim military chaplains. Three Muslim
chaplains are currently being trained at the Hartford Seminary in
Connecticut.

The newest Muslim chaplain is James Yee, a Chinese American and a
graduate of the West Point military academy, who was born into a
Lutheran family. He became interested in Islam while a student and
later spent four years studying Arabic and Islam in Damascus, Syria.
Currently he serves with the 29th Signal Battalion at Fort Lewis,
Washington.

Chaplain Yee said that Muslims on his base have come to him with
worries about being ordered to fight Muslims overseas.

"An act of terrorism, the taking of innocent civilian lives is
prohibited by Islam, and whoever has done this needs to be brought to
justice, whether he is Muslim or not," Chaplain Yee said.

If a muslim is a citizen here or trying to become one, there is no choice. If called to duty they must fight. This was a decision that should have been made when they went through the papaer work. As for the undecided -

GO HOME and TERRORIZE other muslims! TERRORISTS and sympathizers are NOT WATNED IN THE U.S.. And guess what? I DON'T CARE if that hurts the fewwwwliiingggsss of others. Too da* bad.

I would not trust any American, born and raised in the US, who converted to Islam. I don't care what the circumstances are, they did this, at least in part out of spite, but definitely not because of any religious conviction. Since it's a false religion, there is no spiritual reason to convert to it whatsoever. I can understand people from another culture, who have not been exposed to Christianity, falling for a false religion, but not an American. With all the exposure here to Christianity, there is no way someone would adopt Islam, except as a protest of some sort.......

I fear we're going to have to issue a few nuclear tipped Fatwa's before this war is over. No kidding intended.

We just don't get it. I'm in the U.S. Army stationed in Europe. I was dismayed by the P.C. commercials on the Armed Forces Network (AFN) which started appearing after the WTC ATTACK (it's not a tragedy or disaster, it's an ATTACK!). Anyway, these commercials attempt to show the softer, patriotic side of Muslims in the U.S. armed forces. I consider it ill-timed, insulting, P.C. propaganda.

Why don't I ever see any commericals on AFN proclaiming the great Judeo-Christian heritage of the United States, or how it compares FAVORABLY to the brutal, Muslim dictatorships? Hmmm? I want answers. Now.

These moderate Muslim leaders in the United States need to speak out against the teaching of Islam which calls for the death of anyone leaving Islam. Read my article here:

I would hate to have to trust a muslim to cover my back were I in harm's way. The muslims are a security risk and I suspect also a morale drag. They should be separated from the service immediatley. What about that US Army sargeant from Eygypt who was involved in the embassy bombings? Would you like to be in a combat situation with someone like that? He would probably frag you or lead you into an ambush on purpose.

I think your comments do not take into account that there are areas in the United States where the teaching of the Bible are not brought into the community effectively. I can take you to neighborhoods all across the North East and Mid-Atlantic states where Christians stay away and make very little impact.

I've seen numerous commercials here in the US of similar content. One that really annoys me has been on FOX lately. Basically, it shows a bunch of muslim americans who each say something like "I'm 1/2 syrian and 1/2 Egyptian, and I'm an American".

What angers me about this is that it represents the typical liberal "template". Namely, that the biggest problem in America is that all of the evil white guys here are about to go off and attack other citizens because of their religion.

The first time I saw this commercial, I shouted at my TV set "Why aren't you making commericials aimed at Muslims? Shouldn't we be broadcasting PSAs telling Muslims not to be hateful and bigoted towards everyone else? After all, it wasn't a bunch of white guys who plowed those planes into the buildings. Why are they preaching at us??

"We abide by every law of this country except those laws that are contradictory to Islamic law."

Apparently US Islamic Leaders consider that Muslims are above the law.

Yah, I picked that line out as well.

This is their biggest problem as well as the problem with most cultures who try to emulate us.

You can't pick and choose what laws and practices you follow. It's the whole kit'n'caboodle or nothing else is going to work.

Am I really supposed to believe these lies?

The problem is in the interpretation. Remember that "innocents" are Muslims. Look closely.

"All Muslims ought to be united against all those who terrorize the innocents, and those who permit the killing of non-combatants without a justifiable reason. The Muslim soldier must perform his duty in this fight despite the feeling of uneasiness of 'fighting without discriminating.' His intention must be to fight for enjoining of the truth and defeating falsehood. It's to prevent aggression on the innocents, or to apprehend the perpetrators and bring them to justice,"

When read from a western Judeo-Christian mindset, this says "fight with the US against the terrorists." When read from a Muslim mindset, it may mean "fight against the infidels for Muslims." The only part of this that I can't easily put a "militant Muslim" interpretation on is "The Muslim soldier must perform his duty in this fight despite the feeling of uneasiness of 'fighting without discriminating'." I assume the 'fighting without discriminating' refers to the idea that a Muslim is supposed to fight infidels only, not other Muslims.

Bottom line, I'm not convinced we can trust them.

I they are conscientious objectors, they should not have joined the U.S. Armed Forces to begin with. Remember, we have an all volunteer military. And no, they do not have a right to refuse to fight just because they don't want to do battle against their fellow muslims. No Christian would be allowed to refuse to fight against their fellow Christians, especially if they were volunteers.

Wasn't there a mutiny aboard a navy ship during the gulf war by some muslims who decided that they did not want to fight against their fellow muslims? I seem to remember hearing something about that at the time.

We abide by every law of this country except those laws that are contradictory to Islamic law," said Sheikh Al-Hanooti.

In other words, they will abide by few (if any) of our laws since Islamic law goes against virtually every freedom and every process of government which our Constitution protects.
