Spain Refuses to Extradite Terror Suspects

MADRID (Reuters) - Spain cannot extradite suspected Islamic extremists to the United States while the death penalty is in force there, judicial sources said on Thursday.

Eight suspected members of a radical Spanish Islamic group were detained in Spain last week, accused of involvement in the September 11 hijacked aircraft attacks on the United States.

High Court Judge Baltasar Garzon said in a committal order that the men, mostly Spanish citizens of Arab origin, had links to Osama bin Laden's al Qaeda group.

The United States accuses bin Laden of masterminding the attacks on New York and Washington that killed thousands.

The arrested men have denied the charges, judicial sources said.

At an informal meeting in Madrid on Wednesday involving a representative of the U.S. ambassador, two officials from the Federal Bureau of Investigation and two Spanish justice officials, the U.S. was told that extradition was not possible, the sources said. ``The U.S. officials came away from the meeting with the clear message that under Spanish law Spain could not extradite suspects to a country which enforces the death penalty,'' they said.

The death penalty was abolished in Spain with the introduction of the constitution in 1978 three years after the death of dictator General Francisco Franco.

A total of 85 people were executed in the U.S. last year and more than 60 have been executed so far this year, according to the Death Penalty Information Center.

No, you misunderstand. One of the reasons Spain still has a problem with Basque terrorists is that they've never punished them. There's no death penalty, and they have a system where many prisoners, even those condemned for delitos de sangre (blood crimes, such as murder), get to go home on weekends.

Then they wonder why they've never been able to make ETA stop killing...

mmmm, maybe we could make them a deal. They could extradite them to us if we promised to get them life in prison, but instead of haveing them serve their sentances in the U.S we could pay a third party to incarcerate them....lets say..Turkey. Life in a Turkish prison would be the next best thing to the death sentance, some would say much worse.

Face it, not only will the death penalty keep most all EU nations from extraditing any of these punks here - but so will Bush's saying that they will be tried in kangaroo courts ("military tribunals"). No EU nation will extradite people to such "justice" that is clearly set up to unilaterally repeal the court system and the constitutional rights of the defendant.

If military tibunals are Kangaroo courts how come only 12 death penalties were handed down after WW2 despite over 300 trials and over 100 aquittals?

Is this a EU wide policy?

I have a socialist professor that just loves the EU. He thinks Europe is culturally better than the US and that the EU can do no wrong. But, this guy also said that the world would be better off if the US lost its superpower status.

I trust a military court a h*ll of a lot more to put these criminals away than our own system. Think O.J. Simpson. Also, why should non US citizens who HATE this country be given constitutional rights?

Because we have something called the CONSTITUTION, dammit - and because if we do this to these punks, you can bet any GI ever taken prisoner in some hostile Third World nation lacking any military capability of retaliation against the U.S. will similarly "try" that GI and similarly "execute" him. These kangaroo courts will endanger every current and future GI. Is it worth that?

Nice try, but you don't seem to understand that non citizens are not entitled to the same justice system. If you want to see a media pity party and watch these people get off the hook because of the evils America has commited all over the world then just invite these guys over here to be judged by a panel of sympathetic muslims and multiracial groups who would "feel" their pain.

Oh yeah, and the bit about the GI's, Look I don't want to see them get killed or hurt anymore than you do, but they know the risks involved in going into hostile territory. I dare say that if these governments who you admit have no ability to retaliate harm enough of our men and women than the more reason to just wipe em out. Let's roll!
