Illinois Home Schoolers Investigated for “Children Playing in Yard”

An unfortunate characteristic of many anonymous child abuse tips is that they fail to get the facts straight, resulting in unnecessary investigations and stress for innocent families. A classic example of this recently occurred in Madison County, Illinois.
Someone saw a Home School Legal Defense Association member familys children playing in their own yard and anonymously reported it as child neglect! Although the tip was so inaccurate that it even had the number of children wrong, the social worker insisted upon interviewing the children, entering the home, and verifying their immunizations.
When the family informed HSLDA about the incident, we contacted the social worker on their behalf, explaining how the law protects their rights in the investigation. For example, social workers do not have the right to interview children or enter the home without either the parents consent or a court order.
We also explained the newly passed provisions of Illinois Senate Bill 1305, which prevents the Department of Children and Family Services from investigating families who choose not to immunize their children. In addition, state law protects the family since they had a religious objection to immunizations.
Finally, the social worker decided to classify the report as unfounded, and the investigation was closed.

We had CPS called because some busy-body looked in our window and saw my kids jumping on the bed (
"They could have been seriously injured!!!!")when they were 3 and 5... had a big hassle, until finally someone listened to reason...
I guess these agencies need to have something to do, since apparently not enough parents are beating and truely neglecting their children...

Heh! Are you kidding? CPS would never release the name of who it was... "Confidentiality", dontcha know...
Oh well, the CPS here has lost any respect they might have had among a lot of people due to the witch hunts they've been involved in... such as the Wenatchee case...

Stupid parents! What were they thinking?
Now, if they'd had a couple of drug pushers, some sexually promiscous teens, a half-dozen foul-mouthed total pedal-to-the-metal pagans, a few bullies to rough up the kids and take their milk money, and three socialist evangelists in the yard with the kids, it would obviously have approximated a public school environment, and all would have been well.

Sounds like Illinois is ahead of a lot of places in protecting rights of the parents.

We live a couple doors from my sister and we both homeschool our kids. Her boys and mine were all jogging around a one mile loop of the golf course in front of our house about 1:00 P.M one schoolday afternoon. They were stopped by the police and brought home in a squad car. The police didn't believe the kids when they told them they were homeschooled.
Made for some high adventure in their homeschool day.

CPS has gotten out of control. Just another example of another Govt. Program that needs to be eliminated.

Sounds like time for a good lesson in civil rights. You have the perfect opportunity because since their being picked up they'll have a keen interest in the subject.

Michael Farris, the founder of HSLDA, has started
Patrick Henry College in Virigina. They receive NO federal funds and even the students must agree not to accept government financial aid. The college targets homeschoolers. Their first semester, they had a fundraiser for beds, desks, chairs and tables.
