Let the Northern Alliance deal with them as they see fit - they are foreign nationals who came to Afghanistan to fight for the losing side in a civil war. If they ever get back to this country, put 'em on trial for treason. There is no problem or story here. There is also nothing the US needs to do about this at this time.

A good question is this: How pervasive is the promotion of violent Jihad as a 'solution' in the American Mosques?
If those who have recently embraced 'peaceful Islam' can be brainwashed into murderers so quickly, is there any wonder as to how easy it is to get lifelong propagandized boys to become the mad suicidal Palistinian bombers who are killing Israelis?

So it was really not impossible to infiltrate Osama's Taliban.
Too bad someone from the CIA didn't join Mr Walker in his odyssey, it could have simplified matters considerably quite some time ago.
It will be interesting to see if W prosecutes him. As a citizen, he can not be tried by the military rump courts, and that means that his defense could contain all of the accusations against US policies that destroyed Afghanistan. On top of that, since we never declared war on Afghanistan in our wisdom, he is protected by the Jane Fonda syndrome. I bet he walks and gets to write a book.

Does this meet the definition of treason? Talk about giving aid to the enemy!! I'm honestly not sure that it does. We set the standards for treason pretty darn high in this country.
During the VietNam war, the Supreme Court ruled that in order for the "aid and comfort to the enemy" clause to come into effect, we had to be at war. Not just fighting, not in a police action, but at war. We are not at war with either Afghanistan or the Taliban, as we have never made a declaration of war. Only the Congress, not the President, can declare war.
The taking up arms against the country part of our treason definition seems like a much more fruitful area for charging him. But then we come up against our standards of proof. There have to be two witnesses to an act of treason, or a confession in open court. So, unless we have at least two people who saw him actively fighting against U.S. troops, I doubt we can get him on a charge of treason.
Presumably we'll find something to charge him with, though.

Technically, it has to be proven that these so called Americans actually engaged in military action against American assets. If anything, they only fought Northern Alliance forces or were in the presence of Taliban forces who did. While I condone neither their actions nor their sympathies, I belive a case could be made for their innocence of the charge of treason.
