McKinneys want new hearing, say board denied them due process in election case

U.S. Rep. Cynthia McKinney and her state legislator father say Georgia's Board of Elections violated their right to due process by acting on allegations that the two broke election laws.

In a letter Thursday to Secretary of State Cathy Cox, who chairs the Board of Elections, an attorney for Cynthia and Billy McKinney asked for a new probable cause hearing to determine whether they illegally campaigned within 150 feet of a polling site during last year's chaotic presidential election.

On Wednesday, the board referred the allegations to an administrative law judge, who will decide whether violations occurred.

The McKinneys also issued a written statement Thursday headlined, "Republicans Get Nervous when Black People Vote," complaining they were not informed until the day of the hearing that their case was to be considered. They also lashed out at the majority Democratic board for taking testimony from three Republicans and no one else.

The accusations stem from a fracas at a polling site near Stone Mountain on Nov. 7, 2000. Police were called after long lines and a shortage of voting booths angered people waiting to vote.

Witnesses said Cynthia McKinney (D-Ga.) used a bullhorn to encourage people to stay, saying she needed their votes. State Rep. Billy McKinney (D-Atlanta) also is accused of grabbing an election official's lapel during an argument. Each allegation carries a maximum $5,000 fine.

The board did not make a decision on the request for a new hearing. In any case, a board spokesman said the McKinneys will be allowed to present evidence and cross-examine witnesses before the law judge.

Isn't that an Assault? Just what we need - another felon in Congress.

So they weren't supposed to act on them? Are the McKinneys above the law?

In their minds, you're darned right they are. And if you try to enforce the law, you're a sheet-wearing racist (if white), or an Oreo (if black). Let's hope they get nailed. I suspect rampant voter fraud from the McKinney's, but that'll never get proven. At least this is something.

This is just crazy. The McKinney's know that the Dems run Georgia from top to bottom, so the only way this is moving forward is because the Dems have tired of their antics. In addition, the DeKalb Co. DA will not pursue the assault allegations, which were worse than just "grabbing the lapel" of the elections board member. My questions is when will the citizens of DeKalb tire of their antics and retire these people?

My comments on 12/6 freep post said that there would be allegations from these embarrassing people of racism... now it is confirmed. Georgia voters need to remember these antics and that of Cynthia when she wrote that scathing letter to the Arab Sheik asking for his check (remember, the one Giuliani refused to accept???) right after the 9/11 attacks. ARE YOU LISTENING ATLANTA VOTERS ??????????
