There are federal laws against tampering with a jury, attempting to influence the trier of fact or law, and also laws against extortion and blackmail. Larry Flynt has admitted that he is paying money to dig up dirt -- and we all have dirt in our lives -- to try to help Clinton in the Senate trial and before that in the House impeachment. The Senate trial is exactly analogous to a trial in court. Why isn't Flynt tampering with the trial when he blackmails the Senate or the House?

I was shocked to see that the Democrats DID NOT propose legislation that would repeal all federal sexual harrassment law, or laws that would repeal the requirement that an oath be taken before testifying at a civil deposition or in front of a grand jury. The FBI refused last week to say that its lab report accurately portrays President Clinton's DNA profile, or whether that profile may have been altered in documents released to the House Judiciary Committee for reasons of national security or privacy. If the President's DNA was camouflaged in FBI documents, a DNA paternity test recently arranged by STAR Magazine would be unreliable. Reportedly test results rule out any possibility that Clinton is the father of Little Rock teen Danny Williams. Experts say that the only proper method for checking the paternity of the boy is through a paternity law suit, where the boy's DNA sample could be matched against a subpoenaed and verified sample of the President's.

Does all this mean that Senators are unprincipled if they vote to acquit Clinton? Not necessarily. Senators could, of course, find Clinton innocent of some or all of the factual allegations -- although not, i n fairness, without first hearing the witnesses against him. Failing that, Senators could oppose removal on the grounds 1) that the Claiborne and Walter Nixon precedents were wrong; 2) that the Constitution prescribes a lower standard of impeachability fo r Presidents than for judges; 3) that Clinton's alleged crimes are less grave than Claiborne's or Walter Nixon's; or 4) that discretionary considerations counsel against removing Clinton, even if he is proven guilty of high crimes. The first three arguments are untenable; the fourth is respectable although not, in my view, persuasive.
