"The family and supporters of a U.S. soldier convicted and sentenced to prison for shooting and killing a terror suspect who apparently lunged at him and tried to grab his weapon say they are preparing to ask the U.S. Supreme Court to intervene in the case and affirm the soldier’s right to self defense."

Last Thursday, yet another example of the corrupt attempts at appeasement of our enemies within and without was displayed in the rotten-to-the-core decision by three of a five-judge panel of the Court of Appeals for the Armed Forces to uphold the insanely unjust conviction of 1st Lt. Michael Behenna for unpremeditated murder of a known al Qaeda operative who was suspected of orchestrating a bombing that injured and killed members of Lt. Behenna’s platoon. You may recall this awful story of an American hero Army Ranger caught in the upside-down world of a military machine so compromised by leftist ideology...

MILITARY PROSECUTORS WITHHOLD EVIDENCE; ARMY RANGER GOES TO PRISON FOR 25 YEARS FOR SHOOTING AL QAEDA OPERATIVE
-
To keep former Army 1st Lt. Michael Behenna behind bars until 2024 for the "unpremeditated murder" of an insurgent during the war in Iraq, U.S. military prosecutors have resorted to strange and disturbing twists of law, logic and morality. They were all on display again this week in Behenna's final plea before the military's highest court of appeals in Washington, D.C. It was enough to make the gold eagle on top of the American flag in the courtroom shake and then hang its head. Or so I imagined while listening intently as questions from the five civilian judges began...

To all supporters of Michael Behenna, please read the post below from Michael's parents regarding his appeal hearing. Please pass on to all in the DC Metro area. We want to show our support for this hero!!! "To the thousands of Michael Behenna supporters, After three long years of waiting for Michael’s case to be heard by a court not under command influence the day we have been waiting for is about here. On April 23rd at 9am Michael’s case will be heard by the Court of Appeals for the Armed Forces (CAAF). This civilian court will hear oral arguments...

The U.S. Court of Appeals for the Armed Forces _ the military’s highest appeals court _ has set oral arguments for April 23 in the case of 1st Lt. Michael Behenna, who was convicted in 2009 of unpremeditated murder in a combat zone.
-
To summarize the case, on April 21, 2008, terrorists attacked Behenna’s platoon, wounding two of his men and killing two others, along with two Iraqi civilians. On May 5th, officials arrested Ali-Mansur for his involvement in this particular attack. After questioning Mansur, Army Intelligence released him without explanation, then turned him over to Behenna to escort Mansur back to his home. Behenna attempted to interrogate Mansur. Would you briefly summarize the case in the death of Ali-Mansur? A: My understanding is that the prosecution believed Behenna shot Ali Mansur when he was sitting down. The first shot was to the...

The family of an Edmond soldier convicted of murdering an Iraqi while fighting overseas received good news Friday morning. The highest military appeals court decided to hear Lieutenant Michael Behenna's case. He is serving his 15-year sentence in the Fort Leavenworth, Kansas, prison. This appeal could overturn that conviction and the sentence for killing Ali Mansur in 2008. Behenna previously testified he shot in self-defense when Ali Mansur reached out for his gun. Prosecutors argued that Behenna killed Mansur by shooting him in the head, execution style. "Those shots are horizontal and parallel to each other, inconsistent with the fact...

One of the most widely photographed acts of President Obama's first year in office was his symbolic pre-dawn salute to the caskets of U.S. soldiers returning to Dover Air Force Base. In the case of a terrorist named Ali Musa Daqduq, who was released yesterday from U.S. custody in Iraq, the President is letting down those fallen soldiers and their families. Daqduq is a Lebanese national and top Hezbollah operative who in January 2007 masterminded the ambush, kidnapping and murder of five American soldiers in the Iraqi city of Karbala. Arrested by U.S. forces in Basra two months later, Daqduq...

To the thousands of supporters of 1Lt Michael Behenna, It has been awhile since we sent out an update. Michael's lawyers have filed the petition to the Court of Appeals of the Armed Forces (CAAF). The CAAF is the highest court for the military justice system and is similar to the Supreme Court as they do not have to take your appeal. There were four issues on Michael's case presented to the CAAF and we would expect to hear within 30-60 days whether the CAAF will hear his case. If the CAAF does not choose to hear any of the...

Below is a letter Lt. Behenna has just sent out. To all of my supporters, I wanted to write this letter to the thousands of people all over the world who continue to support me and still have hope that justice is indeed attainable in the military justice system. It is an attempt to show my mindset here in prison to the people whom I have not had the opportunity to meet. Recently the Army Court of Appeals ruled against my request for a new trial. As odd as it may sound, I have been preparing for this day for...

To the thousands of Michael Behenna supporters, We are pained to share with you that the Army Court of Appeals has upheld Michael’s conviction and denied him a new trial. The appeal process took over two years (six months longer than is allowed by law) and their ruling was an absolute punch in the gut to justice for a young man who fought so bravely for this country. Back in March of 2009 the sting of Michael’ conviction was eased somewhat by the knowledge that critical evidence was not heard at trial which made us hopeful for a successful appeal....

Freedom Radio will rock and roll Sunday evening June 5th when we welcome back Congressman Allen B. West from Florida’s 22nd district. The Congressman will discuss everything from the budget to the Patriot Act to Obamacare, in the way that only he can. Also returning to Freedom Radio is Vicki Behenna, mother of American hero Lt. Michael Behenna, being unjustly held at Levanworth for simply doing his job as an American soldier. On March 20th, 2009, Army Ranger 1st Lieutenant Michael Behenna was sentenced to 25 years in prison for killing Ali Mansur, a known Al Qaeda operative while serving...

This is so sad. It calls for letters and prayers: "We have no idea why they denied Michael’s clemency request and can only surmise that the Secretary of the Army desires Michael to spend a substantial amount of time in prison."

I just received an email from Michael Behenna's family. Excerpts follow; the full story is at www.defendmichael.com. "Michael’s long awaited Appellate Argument has finally been scheduled. It will take place on December 9, 2010 at 10am before the Army Court of Appeals in Washington DC." "The appellate court will review: 1) The failure of the Prosecution to provide critical evidence of the Prosecution’s forensic witness to Michael’s defense counsel; 2) The Military Prosecutor’s reversible error of making false assertions of fact and interjecting her personal opinion in closing arguments; 3) The military judge’s improper instruction limiting Michael’s right to self-defense;...

Is somebody watching over you today? Is there someone somewhere that is willing to put your well-being ahead of theirs? Those are powerful questions that we seldom ponder here in America. Why? The answer is that safety, security and most importantly freedom, the delicacies sought in so many places in the world, are things we in America nonchalantly pile upon our plates daily like hungry diners at an all-you-can-eat smorgasbord.

To the thousands of supporters of Michael Behenna, Many of you have been asking about the latest on Michael's appeal. Michael’s appellate brief was filed on December 22, 2009 and the military’s response brief was due January 21, 2010. The military asked for and was granted a three-month extension to April 21, 2010. Then sometime in early April the military filed for and received yet another three-month extension making their response brief not due until July 22, 2010! But most amazing of all was that the extension was granted without notice being provided to Michael’s attorneys to argue against it....

To the thousands of supporters of Michael Behenna, Most of you are aware of the facts in the case involving 1Lt Michael Behenna as detailed at www.defendmichael.com. These facts in and of themselves are horrific and represent a total betrayal of a young man who truly fought for his country against a determined and ruthless enemy. But few of you know the gut wrenching details that transpired after Judge Dixon denied the motion for a mistrial. It was a Friday, March 20, 2009, three weeks AFTER Michael was convicted of unpremeditated murder for the killing of Al Qaeda terrorist Ali...

EDITOR’S NOTE: On July 31, 2008, Army Ranger 1st Lt. Michael Behenna was charged with the premeditated murder of Ali Mansur, a known Al-Qaeda agent operating near Albu Toma, an area north of Baghdad. Seven months later, the leader of the 18-member Delta Company, 5th platoon of the Army 101st Airborne Infantry Division was convicted of unpremeditated murder and sentenced to 25 years confinement at Fort Leavenworth. Below is the first installment of a multi-part investigative series detailing the spurious case against Lieutenant Behenna, now 26, adapted from "The Michael Behenna Story (pdf)” (26 pgs., PDF) by new BMW contributor...

What’s the price of defending freedom? 15 years in prison for one Army Ranger. First Lieutenant Michael Behenna was sentenced to 15 years in prison for doing just that, defending freedom. Behenna was prosecuted for shooting al-Qaeda operative Ali Mansur while escorting the terrorist home.

The Army's Clemency and Parole Board has reduced the sentence of an Edmond soldier convicted of murdering an Iraqi detainee, according to Rep. Mary Fallin's office. First Lt. Michael Behenna was charged with killing an Iraqi detainee in September 2008. The Army's Clemency and Parole Board decided to reduce the sentence by five years for the second time. The latest reduction brings the original 25-year-sentence down to 15 years.

It's not uncommon for people convicted of crimes to proclaim their innocence. Most deserve to be ignored, but not Army Ranger 1st Lt. Michael Behenna. On July 31, 2008, Lieutenant Behenna was charged with the premeditated murder of Ali Mansur, a known Al-Qaeda operative operating in the area of Albu Toma, north of Baghdad. Seven months later, the 26 -year-old leader of the 18-member Delta Company, 5th platoon of the Army 101st Airborne Infantry Division, was sentenced to 25 years confinement at Fort Leavenworth after being convicted by a military court-martial panel of unpremeditated murder in violation of Article 118...

Perhaps you’ve heard about this story. If so, please read on for information important to this case you have not read anywhere. If you have read about this incident, definitely read on as it will most likely change your mind about the “guilt” of a soldier convicted of murdering an al Qaeda terrorist in Iraq. Yes, you’ve read that correctly - a US soldier has been convicted of murder for killing an al Qaeda terrorist in Iraq. Since the wholesale murder of nearly 3,000 people on American soil on 9/11, it’s been my understanding that killing terrorists is something that...

The parents of imprisoned Army Lt. Michael Behenna of Edmond have responded to the action of the congressional delegation in seeking clemency for their son, convicted of killing an al Qaida operative in Iraq. The trial ended with the revelation that military prosecutors withheld evidence favorable to Behenna in violation of civil and military law and the appeals process is ongoing. Members of the delegation seek an immediate reduction in Behenna's 20-year sentence, and, ultimately, a new trial. Vicki and Scott Behenna said, "Michael and our family are deeply grateful for this show of force by the entire Oklahoma congressional...

In the open desert outside Baiji, Iraq, a naked man with a thick black beard crouched in the dust of a railroad culvert at twilight. Hours before, he had been mumbling and praying in Arabic. Now he spoke few words. Army 1st Lt. Michael Behenna stood over him in the grainy darkness, his Glock pistol racked and pointed down at him. "If you don't talk, I will kill you," Behenna said. The night was warm and ragged from the dust storm that had turned the afternoon an eerie ocher. Only one light could be seen, far off, along the road....

Memorial Day 2009, however, marks the first of what may be 25 Memorial Days that Army Ranger 1st Lieutenant Michael Behenna will spend behind bars in Ft. Leavenworth. In March of this year, Behenna was sentenced to 25 years for killing known Al Qaeda operative Ali Mansur. Behenna has maintained, and forensic evidence supports, that the killing occurred in self-defense

Imagine that you’ve learned in your local newspaper and on TV that a serial murderer is stalking and killing people in your community. Anxious and concerned for the safety of your family, you buy a gun. Then your worst nightmare happens. Lying in bed and drifting off to sleep, you hear a loud sound downstairs — the unmistakable explosion of your front door being battered down and the menacing footsteps of an intruder climbing the stairs to your bedroom. You cock your already-loaded gun, and when the thug lunges at you, you shoot. Now dead, he is positively identified as...

A military judge Friday refused to throw out Army Lt. Michael C. Behenna's murder conviction despite an 11th-hour claim by the prosecution’s own forensic expert that the infantry officer is likely innocent. A military court on Feb. 27 found Behenna guilty of murdering al-Qaida operative Ali Mansur Mohammed in Iraq on May 16, 2008 during a field interrogation. Behenna, 25, an infantry platoon leader in the 101st Airborne Division, maintains the shooting was in self-defense. The seven-member panel that convicted the young officer rejected that claim, but new information indicates the court may not have heard the whole story. On...

An American military jury has found a US army officer guilty of the murder of an Iraqi detainee. The jury in Fort Campbell, Kentucky, also convicted 1st Lt Michael Behenna of assaulting Ali Mansour Mohammed near Baiji, north of Baghdad, last May. Behenna had argued that he was defending himself when he fatally shot Mr Mohammed during an interrogation. He was found not guilty of the more serious offence of premeditated murder, the Associated Press reported. The defence argued that Behenna had only intended to interrogate Mr Mohammed about a roadside bomb which had killed two members of his platoon.
