I read the same distinction and use of the word “acknowledges” to convey a degree of validity in context in what the Court said:

“The Court acknowledges Plaintiffs’ frustration with what they perceive as Congress’ inaction in this area...”

Unfortunately, you've quoted out of context. The full quote, in context:

Plaintiffs’claims fall squarely into the category of generalized grievances that are most appropriately handled by the legislative branch. The Court acknowledges Plaintiffs’ frustration with what they perceive as Congress’ inaction in this area, but their remedy may be found through their vote.

Furthermore, ackowledging frustration is not the same as agreeing with the cause of the frustration. Ask any psychiatrist.

Well, I heard Damon Dunne speak at the Conservative Forum last week, and he was very impressive. A Reagan admirer.

Orly has a secret campaign plan in the final days of the race -- sue!

She's already, through a surrogate in the past week, lost two battles trying to oust Dunn in the courts (who literally told her to get lost) but she says her surrogate has another court hearing scheduled on Tuesday, election day, and she openly admits that if (ha!) Dunn wins she'll just keep on suing until the general election.

It's heartwarming to note how concerned she is about wasting California citizens' tax dollars in court.

How about that fact that his SS# was issued to someone else? Does that seem more than odd?

The so-called "proof" that someone else had the number is an internet database entry, with no name attached. It is very probably an error.

Here's Susan Daniels statement on that matter, from the same affidavit mentioned earlier:

"Further, the number assigned to Barack Obama may have been assigned previously, as it appears to also be associated with someone born in year 1890."

There's a good reason Daniels couched that in vague terms, if she wishes to keep her PI license. Here's the typical disclaimer for such database search results, from a document image of database search results for her primary opponent, also supplied by Susan Daniels, and posted on Orly Taitz' blog yesterday:

Important: The Public Records and commercially available data sources used on reports have errors. Data is sometimes entered poorly, processed incorrectly and is generally not free from defect. This system should not be relied upon as definitively accurate. Before relying on any data this system supplies, it should be independently verified.

There's no "independent verification" of this person's existence, or the assignment of that number previously to another person.

Seeing as Obama ( according to his autobiography) did not step foot on the mainland for the first time until 1972, applying form the Conn office would have been impossible.

That number was issued between1977 and 1979, according to the PI who started this whole tempest in a teapot:

From the affidavit of Susan Daniels, licensed private investigator, Document No. 78-5, filed in Barnett, et al v. Obama, US District Court for the Central District of California, Santa Ana (Southern) Divison on 10/01/2009.

"I located a social security number for Barack Hussein Obama and found that it was issued between 1977-1979 in the State of Connecticut."

From the SSA link at comment 43:

Since 1972, when SSA began assigning SSNs and issuing cards centrally from Baltimore, the area number assigned has been based on the ZIP code in the mailing address provided on the application for the original Social Security card. The applicant's mailing address does not have to be the same as their place of residence. Thus, the Area Number does not necessarily represent the State of residence of the applicant, either prior to 1972 or since.

I would also challenge any private detective to testify under oath that Obama never visited Connecticut betwen 1977 and 1979. How could they possibly prove it?

The fact that he had a verified SSN issued in CT is odd, nothing more.

Can any of you disprove her lawsuit accusing Dunn of being ineligible because he had asked Florida election officials in July 2009 to remove from his voting record his 1999 registration as a Democrat?

In the American justice system, the burden of proof is on the accuser, not the accused, and Orly has thus far not proved that Dunn is ineligible.

A district attorney's spokeswoman said Taitz's complaint was "unsubstantiated" and the case dropped.

And is there even a “defense attorney” in this “trial”?

Not an attorney in sight. Originally, Orly Taitz said she'd be there, then recently Phil Berg was supposed to deliver the opening remarks, according to Manning, but neither Taitz nor Berg ever showed, and no explanation was given.

Manning also says he subpoenad a host of federal officials, including Obama, but since none of them agreed to testify, he wants people to come to court wearing masks representing them. One person showed up at the parade with a Condoleeza Rice mask. Quite entertaining.

It's a circus. Manning predicted 30,000 people would show. He had about 50-60 for his "march around Columbia," and another couple of dozen that showed up at the church, but many of these are members of his congregation, so he fell a bit short on his grandiose predictions, as all these opportunists do.

The so-called evidence being presented is about the thousandth rehash of all the unproved allegations about Obama. If you've read Orly Taitz' "dossiers," or her voluminous court filings, or a fraction of the thousands of  FR threads discussing them, you've seen 'em all.

I know from experience that the physician signed a bunch of hospital paperwork in the delivery room right after each of my children were born. He declared the time of birth and all that right there in the delivery room.

The problem with that theory is the reason the Nordyke twins' announcement appeared in the papers so late: the delivering doctor didn't sign the birth certificates until  six days later. The physician would have signed or made notations on  the hospital chart immediately following the birth, but that doesn't have any bearing on the certs.

Most of the young 'uns in our family were born in the '70's, and the general routine was that the nurse would bring a form to the mother within the first 24 hours after birth, ask her the questions and write the answers down. The numbered birth certificate would then come in the mail from the DOH a few weeks later in photostat form, the same as the Nordykes' in appearance, with instructions on how to inform the DOH if there were any errors on the form. It probably varied from state to state.

No one's really certain just what the routine was in Hawaii in '61, or how the BC's were numbered back then, and whether they were numbered at the hospital or at the DOH. Nordyke's just making a guess, the same as the eligibility-ists have.

And Nordyke isn't saying anything new in this article, nor is she necessarily lying. It's her perception of how it happened, and bless her soul, she's 82 years old.

Oh, my STARWISE, you labeled this as Glenn's Birther Revelation (Video), but you didn't quote Beck; you cherry-picked some stats from  the ABC/WaPo poll.  That's misleading, I'm afraid.

Here what Beck actually said in that video clip about the same poll revealing some "inconvenient truths about birhers" --

We know the birth certificate people have been discredited.

According to an ABC pool, one-third of all those who say Obama might have been born in another country, approve of how he is handling his job as president. They have favororable reviews of him personally, and favor him over Congressional Republicans when it comes to dealing with issue No. 1, the economy.

Now you'd think that in the America we grew up in, that would be a huge story -- [that] even a third of people who like Obama think he might have been born in Kenya?

Have you seen this anywhere in the media?*  No. Of course not. There's even more...our own resident geek, Stu, analyzed the poll and found that
only 38% of birthers are Republicans. The other 62% are not.

So if you meet a birther, not only are you in for some annoying conversation, but there's also a good chance that there not one of the "racist red-staters." Let that one marinate.

So which of you birthers who obsess on these  threads 24/7 are Democrats? Liberals? Fess up! Turn yourself into JR, and let the closet-cleaning begin.

OK. I have some concerns. One, the social security # not being from a state that Obama ever lived in.

How do you, or anyone else, know whether or not Obama ever lived in Connecticut? It would help if he would explain how he got that particular SSN, but otherwise, who could possibly attest to the fact that he never lived or visited there for any length of time as a teenager? There's always the summers, and vacations, or staying with relatives or family of a schoolmate... The SSA didn't care where your permanent address was; they issued numbers based on the return address given on the application.

As far as needing a SSN for a dependent child on tax forms, that requirement didn't go into effect until the early '80's.

FWIW, Obama held a low-level job for about a year at Business International in NYC, a private company,  in '83-'84. There is a public record of fellow employees who commented that he exaggerated his job level and accomplishments there in his so-called "memoir."

There's nothing but Obama's say-so that he ever worked at Baskin-Robbins in HI. No concrete evidence to support that has been produced: no fellow employees or bosses who remember him; no work records, etc. That "job" is entirely based on his statement that he worked there, and until and unless that statement is corroborated, it's worthless.

I'm not defending Obama, though I'll surely be accused of that. Rather, I'm pointing out that this is yet another non-story promoted by WND, the home of sensationalist conspiracy theories for fun and profit.

As posted by her on her pestilence-plagued blog yesterday:

We Are Change Accuses Tea Party Patriots Of Being In Cahoots With …

    Before It’s News – 6 hours ago
Orly Taitz, an Orange County attorney who has gone to court to disqualify Obama on constitutional grounds, was invited to speak at the event. …

Please, click on the link and watch the clip made by the “We are Change” group. Just like these young people I was threatened.  Prior to the event I received a phone call from Fred Watson, who was in charge of security at that party. He related to me a message from an organizer of that event Bridget Melson. He stated that I will not be allowed to talk about the fact that my opponent Damon Dunn committed fraud, didn’t list in his voter registration the fact that he was a registered Democrat in Fl and that he called the registrar in FL and asked to delete his record from the database, even though this information was documented. They didn’t care if a crook might get into the office of the Sec of State and mess up future election.  It appears it is more important for the establishment to have a crook that they can work with. That is how Obama became a President- a Chicago crook with multiple Social Security numbers and no valid long form BC.

These young people from “We are change” are honest, they are telling the truth. I was told that if I don’t do what I was told, I also will be escorted to the area for people who want free speech. It sounded like a nightmare, a tea party, which is supposed to be for the expression of free speech, was threatening to escort people to areas of free speech, far away from the event.

I was planning to confront them and had a TV producer with me, in order to record the events on video. At the end I simply didn’t get to all the locations that I wanted to visit. After giving speeches at the Stanislaw County fair and to the Modesto College Republicans, I had to rush to the airport to make it to the last flight to Southern CA, I didn’t have a chance to reach Pleasanton, but I knew that such fascist acts indeed happened. If you want to express you feelings about the way this tea party organizers acted, you can reach Bridgit Melson at 925-918-1090 and Fred Watson at 925-580-1619.

I hope you express your feelings at the ballot box. Freedom of speech is precious. When it is hijacked, the country descends into tyranny. Crooks in the government have sold out each and every citizen by dismantling tariffs, that used to protect American workers. Millions of jobs left the country and millions of Americans became unemployed, homeless and destitute. Unless new people come into office  and stop the insanity of current financial policies and  stop this complete idiocy of unbridled free trade, we all will be destitute and the only free speech zone will be allowed somewhere in the middle of the Mohave desert.

Rise up America, stop this insanity and idiocy.

    --------------------------------------------------------------------

For anyone as yet unfamiliar with "We Are Change," it is an organization that describes itself as "a citizens based grassroots peace and social justice movement working to reveal the truth behind the events of September 11th, as well as the lies of the government and corporate elite who remain suspect in this crime."

Orly's article links to this on the  "We Are Change" website:

We Are Change Booted Out of California Tea Party Event

    Kurt Nimmo
    Infowars.com
    April 26, 2010

Members of We Are Change from the San Francisco area were kicked out of a Tea Party event on April 15. The event was held at the Alameda County Fairgrounds in Pleasanton, California. See the video below.

It appears only supporters of the Republican hijacked Tea Party were welcome at the event.

Orly Taitz, an Orange County attorney who has gone to court to disqualify Obama on constitutional grounds, was invited to speak at the event. She was dis-invited after establishment Republican political candidates got wind of her planned attendance. “It’s not worth it,” Bridget Melson, founder and president of the Pleasanton Tea Party, told the Los Angeles Times. “She’s too controversial. This is not what the tea party is about at this point.”

The event was announced and promoted by the Tea Party Patriots, an organization partnered with FreedomWorks, the “conservative” (neocon) organization headed up by the former establishment Republican Dick Armey and funded by the Sarah Scaife Foundation, a neocon operation directed by the billionaire and CIA operative Richard Mellon Scaife. Other Tea Party Patriots partners include the Republican news portal and blog site RedState and the neocon blogger, concentration camp apologist and Fox News darling Michelle Malkin.

The Pleasanton Tea Party does not list partners or financial backers on its website. However, since they are teamed up with the Tea Party Patriots, FreedomWorks, and the scurrilous neocon Scaife we can assume they share the Republican Borg hive version of Tea Party activism (including swearing fealty to the Republican national platform of total war and the bankster agenda).

The Tea Party Patriots website has posted effusive praise for the Fox News disinfo operative Glenn Beck. Beck has denounced the 9/11 truth movement on numerous occasions, accused it of being in cahoots with al-Qaeda and white supremacists, and believestruthers plan to assassinate Obama.

If the Republican version of the Tea Party manages to absorb the Libertarian Tea Party movement, we can expect a new crop of neocon Republicans to replace the “socialist” Democrats come November. If the momentum continues into 2012, we can expect another George W. Bush as president and a continuation of the occupations of Afghanistan and Iraq. The bankster agenda and the Federal Reserve will move forward, albeit with the trappings of the Tea Party (confined to the same sort of fake Libertarian lip-service Reagan read from a script while fronting as president for the New World Order).

Is it unfair to characterize the Republican Tea Party as the CIA Tea Party? Considering the involvement of Richard Mellon Scaife, a covert takeover of the movement by the spook agency is a distinct possibility. It certainly would not be the first time a legitimate political movement was taken over by an intelligence agency. In fact, the CIA specializes in creating political movements from the ground-up.

Is this it birthers -- is this what you believe? Is this what Free Republic is supporting by supporting you? The Tea Parties run by the CIA? Michelle Malkin is a "concentration camp apologist," Glen Beck is a "Fox News disinfo operative," and Reagan was "fronting as president for the New World Order?"

Are you sure about that? Apparently, you are wrong.

Section 7211. Minimum Standards for Birth Certificates •Requires the Secretary of Health and Human Services (HHS), in consultation with Department of Homeland Security (DHS) and the Commissioner of Social Security and others, to promulgate regulations establishing minimum standards for birth certificates.

That's a regulation for standards, not form. The COLB, in Hawaii, and other states, meets the Federal standard.

By the way, Alvin Onaka, chief of the State of Hawaii Health Department Office of Status Monitoring...

"received the Halbert L. Dunn Award for outstanding contributions to the field of vital and health statistics. He was recognized for a 40-year demographic and public health career at international, national and state levels. He has been at the DOH about 20 years.

State Health Director Chiyome Fukino said, "We are proud that Dr. Onaka has been recognized with this prestigious award and brought it home to Hawaii. Alvin is a national leader in the field of vital and health statistics, and the award is well deserved."

Inspired by the Sept. 11, 2001, terrorist attacks, the Intelligence Reform and Terrorism Prevention Act of 2005 contained a subsection called REAL ID to improve the U.S. system for issuing secure identification documents. Hawaii was already working on a process called Electronic Verification of Vital Event (EVVE), and it is piloting a national system, Onaka said.

"You can't travel without a valid ID," Onaka said, and a birth certificate must be used to verify a federally approved ID, driver's license or passport. "There needs to be a system that allows this to occur, and Hawaii is piloting this."

If a person goes to a Social Security office, for example, and presents a birth certificate from Hawaii, the office can input five pieces of information, access a secure database in Hawaii and get a "yes" or "no" answer on whether it is the same information, he said.

"I think we're before our time, but the rest of the world will catch up with us," Onaka said. "It's going to be a reality. ID theft is the most prevalent crime, and others have to have something to combat it."

Onaka said he is also working with passport offices and even the Little League Association on a system to verify birth certificates of the players to prove they are in the right age brackets."

Graham on Health Care and Immigration Reform

WASHINGTON – U.S. Senator Lindsey Graham (R-South Carolina) today made this statement on health care reform and its affect on immigration reform.

“The first casualty of the Democratic health care bill will be immigration reform.  If the health care bill goes through this weekend, that will, in my view, pretty much kill any chance of immigration reform passing the Senate this year.”

I believe Obama was adopted by his Indo-Nesian stepfather and was declared to be an Indonesian when he entered school. Did he later register as an American?

You have a right to believe anything you choose. But there is no proof of this alleged adoption, and according to U.S. Law, a child cannot renounce his U.S. Citiizenship -- and we are talking of a child who lived in Indonesia from approximately age 6 though 10 -- hardly an age where a child can be held responsible for such an important decision.

The video is hilarious, since it humorously dramatizes, from an actual court transcript, how Taitz simply flies by the seat of her pants, ignoring all established rules, law, logic and reason — and so do these threads, since most who comment totally ignore the subject of the post but instead launch into the same tired pseudo-evidence endlessly listed on every thread, while villainizing the same justice system that uses rules, law, logic and reason to form its opinions.

It’s the childish equivalent of “nah, nah, nah — I can’t hear you” while sticking one’s fingers in ears.

I hope the law specifies that the birth certificate must be the long-form original reflecting the hospital and doctor’s signature. In the end it does not matter because the short form COLB is an abstact that would be subjected to verification against the long form birth certificate and the dingbats in the White House know it.

The proposed AZ law does not specify that the certificate be long-form.

Oh, it matters, quite a bit. There's no federal standard for Birth Certificates, and no distinction between so called "long-forms" and "COLBs." Whatever the individual state deems legal, and is accepted by the the Federal government, as, for example,by  the DOS for passport apps, or by the SSA, for social security application, will stand -- and those include the COLB, which is now being issued in multiple states in lieu of the vaunted "long form," as official proof of birth, since the info on the COLB is abstracted, officially and legally from the so-called "long form."

States can set any standard they wish for state and local elections, but no state will be able to dictate standards higher than the Federal government's standards, for a Federal election.

it provides that such “third person” must not only secure the consent of the law officers of the government, but the consent of the Supreme Court of the District of Columbia before he can use the name of the government in quo warranto proceedings.

Taitz didn't get the consent of the relevant law officers of the government, and she didn't even make an effort to get the consent of the Supreme Court of DC before she filed.
