    John Roberts was as well vetted as any “conservative’ justice could have been. He had a long relationship with the Federalist Society and liberals were opposed to his nomination based on his record.

    His actions last week were surprising and disappointing and could not have been predicted.

    We will never know why he ruled as he did.

    Maybe, because of his history of epilepsy, he let his emotional sympathy for those with pre-existing conditions trump his fealty to the Constitution and just did NOT want to throw out the whole law.. despite the mandate being unconstitutional under the commerce clause?

    Maybe he mistook bleating from the left wing press as reflecting real public opinion and didn’t want to hurt the court’s standing with the public and allowed himself to be swayed?

    Maybe his epilepsy drugs affected his thinking?

    Maybe he has nasty skeletons in his closet and was blackmailed?

    We will never know.

    It would have been nice to have this behind us, but we just has to deal with the situation as it is.

    When life gives you lemons, make lemonade.

    His decision also gave us some gifts.

    1. A fired up conservative base. Romney raised over 5 million dollars in small donations in the 24 hours following the decision. Since the only way to defeat Obamacare is now to rally behind Romney.. there is no longer any logical reason for NOT getting on board. The stakes are too high. This could be a repeat of 2010!

    2. For the first time in 75 years, the SCOTUS has put limits on the expansion of government powers under the commerce clause. Left wing jurists are NOT happy over this. What’s more, it was the opinion of a majority of 5 of the 9 justices in this case..and is now legal precedent!

    3. The refusal to allow the government to penalize, monetarily, states that refuse to expand their Medicaid eligibility requierements under this law is ALSO a first.. that could come back to haunt big govt types that use the federal government’s power of the purse to blackmail state governments. It places many federal govt programs that cut off funds for state noncompliance in legal question..Again, ANOTHER precedent that is giving pro-big government left wing jurists nightmares.

    4. Obamacare is STILL unpopular..and Roberts has now indelibly branded the mandate in the public’s mind as a TAX..a HUGE tax.. making Obama AND the Democrats in Congress who pretended that it wasn’t a tax..as liars who deceived the American people. and pulled a shell game. It also now has Obama breaking his promise NOT to tax those making less than $250,000 a year; it will actually impact the POOR! This a HUGE bludgeon with which to bloody Obama.. and we aren’t waiting around to take advanage of it! Americans for Prosperity, a conservative super-PAC, has already taken out a 9 million dollar media buy in swing states to point this out.

    5. MOST American voters oppose this law. Romney and the Republcians have promised to repeal it. Obama and the Democrats defend it. Not a good place to be if you are an incumbent running in an election year. This will not only affect the Presidential race.. but all races down ticket. Can you say..GOP US Senate?

    All in all... a short term victory lap for Obama and the Dems , but potentially a huge victory for the GOP both in November.. and long term in terms of some of the legal precedents set... IF we are aggressive, don’t let up thepressure and take full advantage of it!

    How conservative is Newts’ record?

    If a rating of 100% from the American Conservative Union isn’t good enough for you..then what is it going to take?

    I liked Romney in 2008, considering the alternatives, and he certainly LOOKS presidential, but as info came out about Romneycare, his recent pandering to the climate change crowd and other issues..my enthusiasm dimmed considerably. He looks too much like the other “establishment’, northeast moderate republicans we have had in the White House recently.. like GHWB and GWB. I want a SOLID conservative with fire in his belly.

    To be honest, I always thought the “baggage’ of Newt’s divorces made him a non-contender.

    But then, the more I think about it..that was what the liberal MSM WANTED me to think!

    I like Bachman.. but her lack of executive experience turned me off.

    I was happy when Perry entered the field , but his performance in debates and inability to defend his positions nuked him quickly.

    Then I supported Cain.. but the smear campaign conducted against him was too successful..and his explanations about his 13 year ‘relationship’ with this most recent woman was just too much to swallow.

    Newt is a sold conservative, his baggage is already out there and could be easily dismissed as old news..and a lot of the myths about his divorce have been debunked.

    He is brilliant, quick witted, articulate and would make mincemeat of Obama in any debate.

    In short, ladies and gentleman.. it looks like we may have a candidate.... a fired up, solid conservative with ideas and the determination to implement them..to take the fight to Obama and his media drone allies.

    An anecdote for you....to point out EXACTLY how long this has been going on.

    Back in college from 1968-72, one of the most active socialist professors on my campus was an English professor.

    One day, I eavesdropped on a conversation he was having with some of his useful idiot disciples. During that conversation, I specifically remember him saying that the the socialist movement had been using the consumer movement for years to advance its agenda..but that the future for advancing socialism lay in the environmentalist movement..which was just getting started. The very first “Earth” Day was observed in 1970.

    This has been going on for a hell of a longer time than 2002.

    I’m a physician myself, licensed to practice in New York and Pennsylvania.

    If I caught a fellow physician doing this..I would have absolutely no problem with testifying in court that this is probable fraud..and definitely a violation of medical ethics.

    If these demonstrators in Wisconsin and the physicians who are LYING to assist them... thought they had the moral high ground..they just lost it.

    I used the name King Pyrrhus...since it was sooo appropriate.

    For those who don’t know who he was..here is the story:

    “The phrase is named after King Pyrrhus of Epirus, whose army suffered irreplaceable casualties in defeating the Romans at Heraclea in 280 BC and Asculum in 279 BC during the Pyrrhic War.

    In both of Pyrrhus’s victories, the Romans had more casualties than Pyrrhus did. However, the Romans had a much larger supply of men from which to draw soldiers, so their casualties did less damage to their war effort than Pyrrhus’s casualties did to his.

    The report is often quoted as “Another such victory and I come back to Epirus alone,” or “If we are victorious in one more battle with the Romans, we shall be utterly ruined.”

    Although it is most closely associated with a military battle, the term is used by analogy in fields such as business, politics, law, literature, and sports to describe any similar struggle which is ruinous for the victor.

    “Fellow Americans,

    Late last night, in a narrow and partisan vote, the U.S. House of Representatives passed the most significant piece of social legislation in over seven decades. It did so in the face of overwhelming and principled opposition from the American people. Large majorities of Americans oppose this legislation because it offends the historic American dedication to the principle of self-government. They understand that this new law will accelerate Washington’s intrusion into our most personal and private decisions.

    This is why opposition to this bill will only grow. Supporters of this bill argue that popular hostility will recede upon its passage. But, rather than cementing our descent into a European-style welfare state, last night’s passage of Obamacare is best seen as a historic turning point, a true catalyst for real change.

    I write to reassure our supporters, the conservative movement, and the American people at large that The Heritage Foundation will do all within its power to keep this issue alive in the public square and make the intellectual case for the repeal of this act. We will bring all our resources to bear on behalf of those who believe America is and will always remain the Land of the Free.

    This, rest assured, can be done. The American people are never permanently thwarted. President Obama’s health care legislation can and will be repealed.

    Those who supported this bill are our fellow Americans, and we do not question their good will or patriotism. In public policy, however, good intentions alone do not suffice. And let there be no mistake, our philosophical differences with supporters of this bill are profound. The reason government-run health care has been the holy grail of the left for decades is that liberals realize as much as we do that it is a giant step toward the creation of a European-style welfare state. This is an evolution Americans have always resisted because it is alien to our national character.

    If there is one good thing about the past year—one in which we have witnessed unprecedented horse-trading, press stunts, midnight votes and political manipulation in both houses of the U.S. Congress—it is that the American people have come away educated as never before about the differences between these two visions for America. Americans are strongly opposed to this bill not because they have been hoodwinked but because they understand this bill both in its particulars and at an instinctive, gut level.

    They understand this health care bill forces individuals and employers to buy insurance policies designed by government bureaucrats. This intrusion is intended to follow us from cradle to grave.

    Instead of empowering families and individuals to make their own choices, Obamacare empowers the bureaucracy to make those decisions for them. It is this unelected bureaucracy, unanswerable to the electorate, that will determine the content of health benefits packages, including medical treatment and procedures, and how much will be paid for those services. Yesterday’s legislation brings us one step closer to fully government-run medicine, with expanded government power over the financing and delivery of medical services that is sure to ration care in the name of cost control.

    You will hear the left say this new entitlement will be popular with the American people. Do not believe them for a second. Yes, 32 million people will gain the theoretical right to health insurance. But over half of that coverage comes from placing at least 16 million more Americans into Medicaid, an unpopular and overextended welfare program that already rations care.

    Americans will not stand for it. The American love for liberty prevailed in our founding, and will prevail once again.

    In December of 1773, to protest unjust taxation, a group of American colonists dumped tea in Boston Harbor. The punishment for that first Tea Party was a series of intrusive laws passed by Parliament that were so oppressive that they could only be described as the “Intolerable Acts.”

    Obamacare is today’s Intolerable Act. And just as the colonists banded together to enact change after those acts were passed, so should America respond to Obamacare. This law must be repealed.

    Much of the fight against this bill will be led by the individual states, a process we encourage. All told, 33 states have already taken steps to challenge various aspects of Obamacare, including its unprecedented mandate that every American purchase health insurance or face a steep penalty for noncompliance. Four additional States will have this question on the ballot in November.

    On Capitol Hill, the initial battle over Obamacare will occur when Congress considers whether to fund the tens of thousands of new federal bureaucrats necessary to implement the new law. In the tradition of the Hyde amendment, which prevented federal funding for abortions through annual limitations appended to appropriations bills, conservatives should look to the appropriations process as our first line of defense. Straightforward funding limitations would prevent any Administration official or any bureaucrat from implementing the law.

    Our health care system requires reform, and we have long advocated measures to improve our system. We can and should strengthen the ability of American families to choose the coverage they want, rather than giving that power to Congress and its agency bureaucrats. We can also spur competition and choice to bring efficiency and lower costs to the health system, in place of the bill’s deadening regulation and damaging price controls. And, above all, we should foster state innovation rather than Washington-based central planning.

    But such reforms can only be considered once this tragedy of arrogance has been fully and completely repealed.

    Fortunately, there are no permanent victories or defeats in Washington. For millions of Americans and for Heritage, Round One of this fight is over. Today, the Heritage Foundation is answering the bell for Round Two. Join our fight; become a part of our mission. Help us educate our lawmakers, as well as those who aspire to become tomorrow’s lawmakers. Together we can make the persuasive case for repeal of this Intolerable Act and thereby return us to our American destiny.

    Repeal by amendment to the constitution.

    Of course, there is one additional way for states to win a fight about the constitutionality of health-care legislation: Make it unconstitutional. Article V of the Constitution gives state legislatures the power to require Congress to convene a convention to propose an amendment to the Constitution. If two-thirds of state legislatures demand an amendment barring the federal regulation of health insurance or an individual mandate, Congress would be constitutionally bound to hold a convention. Something like this happened in 1933 when Congress proposed and two-thirds of the states ratified the 21st Amendment, removing from the Constitution the federal power to prohibit the manufacture, sale and transportation of alcohol. But the very threat of an amendment convention would probably induce Congress to repeal the bill.”

    Today..the same day I heard the news that Murtha died...

    ..I received a campaign solicitation letter from William T Russell, a GOP candidate for Murtha’s seat.

    What I know about him is in his letter.. a Lt Col in the US Army reserve, Iraq War veteran, Pro gun rights, Pro tight border security, anti-death tax and capital gains taxes..and wants to make the Bush tax cuts permanent, pro-life (thought that isn’t an issue I’m big on..one way or the other).

    In his letter he claimed that Murtha apparently felt threatened enough by him that Murtha’s chief of staff threatened to have Murtha use influence with the Secretary of the Army to get Russell recalled to active duty... to keep Russell from running aginst Murtha..and that Russell’s former commanding officer was willing to testify under oath that he had been contacted by Murtha’s office with regard to that very threat!!

    Sounds like an OK candidate.

    Anyone know more about him?

    Is he the real deal?
