Ft. Pierce, FL --( Today, St. Lucie County Judge Cliff Barnes denied all constitutional arguments to dismiss the case against Dale Norman, without written order. State v. Norman is the case of a law abiding concealed carry licensee who was arrested and prosecuted in Fort Pierce, FL for violating Florida nearly complete ban on Open Carry after his otherwise lawfully carried handgun unknowingly became unconcealed while walking. The denials were based, in part, on the courts findings that the statute is facially overbroad and is facially vague, but was not necessarily improper “as applied” in this case. This turns the...

Wisconsin --( The Wisconsin Department of Justice is trying to make it even more difficult to get a Wisconsin Concealed Weapons permit. There are already too many hoops to jump through just to exercise our rights. Now they want to increase the training requirements and make them permanent. If the rules become permanent, do you think these control freaks will ever be willing to loosen their grip when we try to pass Constitutional Carry? And not only that, but our state representatives are rolling over and appear unwilling to lift a finger to fight for gun owners. Meanwhile, the justice...

DENISON, TX-Bystanders rushed to the aid of a Denison woman who was stabbed during an altercation Monday afternoon. The names of both people involved in the stabbing have been released. Denison police say 64-year-old James Livingston of Sherman allegedly stabbed 31-year-old Sarra Armstrong of Denison. Investigators said bystanders got involved in the incident trying to protect Armstrong from further injuries. It was a typical Monday afternoon for John Polonchak until someone ran into his automotive store saying a woman had just been stabbed. "I had a concealed carry permit so I grabbed my weapon, ran down the road, saw a...

MADISON, Wisconsin (WXOW) - After almost a year without permanent rules, Wisconsin's Concealed Carry Law is about to get some. Officials say most of them are basic things taught in most gun safety classes. While law enforcement is generally in favor, many gun trainers say there's no need for new rules. Mike Shea, Gun Training Instructor says, "I would like the new proposed rules thrown out. We have rules that are in place now that are working so to go through and change things mid-stream like this doesn't make any sense." While Chief Tom Molitor of Green Bay Police says,...

Cambridge, Ill. — Petitions were filed this week to place a “concealed carry” referendum on the ballot in the November election in Henry County. Jon Zahm of Osco, a Henry County Board member and co-chairman of the Constitutional Carry of Arms petition campaign, filed the petitions at the office of the Henry County Clerk in Cambridge. “This will allow the people of Henry County to express at the ballot box whether they support the right of an individual who is legal to own a firearm, to have the right to carry that firearm, open or concealed, for personal protection and...

A 46-year old man and a licensed attorney was arrested Tuesday night in New Haven after police say he brought a loaded gun concealed in his waistband into a screening of "The Dark Knight Rises." Sung H. Hwang's lawyer Hugh Keefe told the Associated Press today that his client's arrest at Criterion-Bow Tie Cinemas at 86 Temple St., where he was found with a loaded gun in his waistband, was "baseless." Hwang is a well-known lawyer in New Haven and heads the Law Offices of Sung-Ho Hwang LLC at 1 Audobon St., New Haven. He is also an officer with...
  • Law Professor David Kopel Argues Colorado Gun Laws Have Saved Lives (VIDEO)

    08/04/2012 4:54:58 PM PDT · by marktwain · 4 replies ^ | 2 August, 2012 | S.H. Blannelberry
In a recent article written for the National Review, and then subsequently adapted for the Denver Post, David Kopel of the Independence Institute argues that post-Columbine gun reform in Colorado has saved lives. Given recent events, the shooting in Aurora, which left 12 dead and 58 wounded, it may be difficult for someone outside the gun community to accept Kopel’s argument. But a closer looks at the facts show that Kopel is, indeed, correct. The centerpiece of gun reform following the mass shooting at Columbine High School was the 2003 Concealed Carry Act. The law set up what is functionally...

    The Truth About Guns ^ | 3 August, 2012 | Robert Farago
“We’ve seen a huge outcry from the public demanding common sense gun laws,” Brady Campaign to Prevent Gun Violence senior attorney Daniel Vice told Vice made his org’s claim on popular support upon hearing that the 4th Circuit Court of Appeals blocked a ruling by U.S. District Court Judge Benson E. Legg that “would have flooded Maryland’s streets with unregulated guns.” Translation: Legg tossed-out the Old Line State’s “may issue” concealed carry permitting process as unconstitutional. “A citizen may not be required to offer a ‘good and substantial reason’ why he should be permitted to exercise his rights,” Legg...

Norwalk, Connecticut --( Mr. Duane Doutel and his Attorney Rachel M. Baird appeared at the Norwalk courthouse (GA20) this morning for the newest leg of the ridiculous saga that has befallen Mr. Doutel. Mr. Doutel’s case was called first and a surprised and befuddled Magistrate tried to play catch up as the prosecution announced that they were willing to ‘nolle’ the charges after a year and five months. Attorney Baird made clear Mr. Doutel’s intent to see this trial through to a dismissal no matter what and that they had no plan to take a compromise like a nolle. The...

About the tragedy in Aurora, Colo., rapper/actor Ice-T made more sense – and has a better understanding of the Second Amendment – than gun-control proponents. Asked by a London news anchor about America's gun culture, Ice-T said: "Well, I'd give up my gun when everybody does. Doesn't that make sense? ... If there were guns here, would you want to be the only person without one?" ------------------cut----------------------------- Suppose a guy goes to a baseball game. "Honey," his wife asks afterward, "who won the game?" The husband says, "The Dodgers scored four runs." What's missing? Obviously, the wife still knows nothing...

A man who shot and killed a Dorchester man in a downtown fracas early Sunday morning was licensed to carry his firearm, is cooperating with a police investigation and has not been charged with a crime, authorities said yesterday. “At this point in the investigation, it appears he may have acted in self-defense, and he has not been charged at this time,” Suffolk County District Attorney Daniel F. Conley’s spokesman Jake Wark said about the unidentified shooter. Prosecutors said it appears two groups of people encountered each other at about 2:30 a.m. Sunday in the downtown area of Atlantic Avenue...

A rampage shooting at the Youth With a Mission center in Arvada, Colo., the night before had taken two lives and left a third man critically wounded. The crime scene was 70 miles from the Colorado Springs campus of the New Life Church. But the killer had escaped into the snowy night, and one member of the congregation -- former Minnesota policewoman Jeanne Assam -- had an ominous feeling he might strike again. Acting on her instincts, Assam urged the church pastors to post volunteer guards -- some of them armed -- at Sunday services at the sprawling mega-church. And...
  • Gun laws do little in case of theater killings(WI)

In the aftermath of the Colorado movie theater shootings, I'm not going to argue about concealed carry gun laws anymore. We've been through all that here in Wisconsin. Like many workplaces, the building where I work in this concealed carry state has a sign on the entrance informing folks that no weapons are allowed inside. Some gun advocates think that's part of the problem. After all, folks like the orange-haired suspect in Aurora can read, too. Concealed carry became a buzz phrase on my social message sites after some learned Colorado actually does have a concealed carry law that allows...

Patch readers across the region spoke out, to the tune of more more than 340 comments, when it was reported Tuesday that a U.S. District Court judge declared Maryland's gun permitting process unconstitutional. The ruling will relax the handgun permitting process in Maryland. "People believe the Second Amendment gives Americans the right to keep and bear arms. Actually, it protects their fundamental right to keep and bear arms," Carroll County Commissioner Richard Rothschild told Patch. "Our forefathers understood that arms provide citizens with the means to secure their lives, their liberty, and their property." On Monday, Judge Benson Everett Legg...

PEWAUKEE- Thousands of people across our state have permission to conceal handguns, but many gun owners sounded off at a public hearing Wednesday concerning restrictions for permit holders. Less than a year after Wisconsin set its sights on concealed carry, authorities are now asking the public to weigh in on permanent rules and regulations. In just nine months, more than 118,000 people signed up for concealed carry permits -- using temporary rules that are soon to be made permanent. Authorities used a public hearing to discuss changes to the existing guidelines including: limiting class sizes and defining training, which right...

Charlotte, NC --( In perhaps the clearest case in the country addressing the right to bear arms outside the home for self-defense, oral arguments took place June 8 in Chicago, before the United States Court of Appeals for the Seventh Circuit. Shepard v. Madigan involves lead plaintiff Mary Shepard, an Illinois resident and trained gun owner with no criminal record, who is licensed to carry a concealed handgun in both Utah and Florida. Unfortunately, she has no legal way to do so in Illinois as soon as she steps away from her home or place of business. The National Rifle...

Across the country, more people are interested in buying guns since last Friday's mass shooting. We did some checking, and here locally, to see if that's the case. And it looks like the numbers say yes. After such a horrific event last Friday, Nebraskans are looking for their own ways to feel safe. Many people are turning to owning their own guns. Applications for permits to purchase guns have increased by 43 percent since Friday, compared to the same time period last year. That means an average of 10 permits per day have been applied for to purchase guns. Also...

It will become a lot easier to obtain permits to conceal and carry guns in Maryland as of Aug. 7 under a court order filed Tuesday by a federal district judge. The order signed Monday by Judge Benson E. Legg gives state officials two weeks to implement his March ruling striking down a requirement that concealed carry applicants show a "good and substantial reason" to transport a firearm. -------------------cut-------------------- The shift comes amid nationwide concerns about access to guns, after a well-armed shooter inexplicably opened fire in a crowded movie theater in Aurora, Colo., last week, killing 12 people and...

I won’t pretend to know all there is to know about guns, but I have been around guns all my life. I remember my father hunting deer and pheasant, and he had 3 or 4 guns while I was still at home. We were allowed to shoot the 22 under supervision, which I believe is a good thing for kids. They should know how a gun works, how they should be handled and respected. My late husband had a couple but he never hunted or shot. One of the guns was a 22 that belonged to his grandfather. None of...

Judge Legg has issued a permanent injunction against enforcement of the requirement of needing a “good and substantial” reason to obtain a permit to carry in Maryland. The injunction is to be effective in 14 days. Maryland Shall Issue talks about what this will mean for Maryland residents. In theory, this should render Maryland a shall-issue state, but in practice there are probably ways the Maryland State Police can stall. This will be appealed to the Forth Circuit Court of Appeals, and they could side with the state. Nonetheless, this is excellent, excellent news. Kudos to the Second Amendment Foundation...
