  • Tsarnaev Conviction Puts Death Penalty Opponents in an Awkward Spot

How about now? Are you in favor of the death penalty now? I ask because the preferred argument from opponents of the death penalty is doubt: We can never be sure; look at all of the people released from death row; we can't afford to risk ending a single innocent life. None of those arguments apply to Dzhokhar Tsarnaev. He admitted, through his lawyers, that he and his brother murdered three people and maimed 260 others at the Boston Marathon. (A few days later, they murdered a police officer.) Tsarnaev knowingly left a bomb next to a family on...

BOSTON (Reuters) - Law enforcement created "dangerous crossfire situations" while trying to apprehend the two suspects in the Boston Marathon bombings, according to a state report on the emergency response that was released on Friday. Police officers lacked "weapons discipline" during a gun battle with Dzhokhar Tsarnaev and his older brother, Tamerlan, who was killed a short time later, in the early hours of April 19, 2013, the report found. Lawyers for the Boston Marathon bombing suspect have asked a judge to dismiss the indictment against their client, saying there aren't enough minorities and younger people in the jury pool. Lawyers filed a motion Thursday saying the selection process violated Dzhokhar Tsarnaev's (joh-HAHR' tsahr-NEYE'-ehvz) constitutional right to have a jury that represents a "fair cross section of the community." They say blacks, people under 30 and Boston residents were underrepresented in the group of potential jurors questioned by the judge. The prospective jurors were chosen from a population of about 5 million in eastern Massachusetts. Jury selection is nearing a...

Given the powerful grief and anger over the Boston Marathon bombing, Boston would seem to be a particularly hostile place for Dzhokhar Tsarnaev to stand trial. But it might just be his best hope of escaping a death sentence. Opposition to the death penalty runs deep in liberal Massachusetts. In a Boston Globe survey in September, 57 percent of Massachusetts residents polled favored life in prison for Tsarnaev, while 33 percent favored execution. As Tsarnaev's lawyers weigh whether to attempt to move his trial out of town, away from those most deeply traumatized by the bombing, some legal experts say...

The American public now knows the identity of the Boston marathon bombing suspects. Tamerlan Tsarnaev, 26, was a former boxer and Chechnyan immigrant, radicalized in the United States by an Islamist mentor. He turned against the West in liberal Cambridge, Mass. His younger brother, Dzhokhar, 19, was a pot-loving college student at the University of Massachusetts. Last Friday, Tamerlan was killed during a shootout with police after his brother reportedly ran him over with a car. Dzhokhar was captured hours later hiding in a boat. Few who knew Tamerlan seemed surprised at the news that he had masterminded the bombings...

To borrow a line from Dennis Green, they are who we thought they were. From his hospital bed, Dzhokhar Tsarnaev has acknowledged his role in planting the explosives near the marathon finish line on April 15, the officials said. The first successful large-scale bombing in the post-Sept. 11, 2001, era, the Boston attack killed three people and wounded more than 250 others. The officials, who spoke on condition of anonymity to describe an ongoing investigation, said Dzhokhar and his older brother, Tamerlan Tsarnaev, who was killed by police as the two attempted to avoid capture, do not appear to have been...

Suddenly, every cable news anchor, every pundit, every Sunday show guest, and every waiter in Old Town Alexandria, Virginia has become an expert on whether or not Dzhokhar Tsarnaev should be informed of his Miranda rights. Let's assume, for the moment, that Dzhokhar Tsarnaev, has never watched a single episode of "Law & Order" in any of its manifestations and, thus, does not know he can ask for a lawyer - or refuse to answer any questions with a lawyer or without. Just so I can catch up (I know you already know this), the whole Miranda thing stems...

Sen. Dianne Feinstein said Sunday she “regrets” discussions on whether the surviving Boston bombing suspect should be interrogated as a potential enemy combatant. The California Democrat told “Fox News Sunday” the Obama administration’s High Value Interrogation Group will interview suspect Dzhokhar Tsarnaev, he will be read his Miranda rights at a later date and federal courts, not a military commission, can handle the case. "I really regret all of this discussion, which is creating a conflict that need not be there,” she said. “The administration is ready. … I don’t think all of this is very helpful.” Two bombs placed...

Federal investigators have begun questioning hospitalized Boston Marathon bombing suspect Dzhokhar Tsarnaev and he is responding, according to reports on Sunday night. NBC News’ Pete Williams reported that Tsarnaev, 19, is beginning to respond to a team of federal investigators mainly through writing. Williams reported that he is being questioned for brief periods and that he has difficulty communicating because of his throat injuries. Tsarnaev was listed in serious but stable condition at a Boston hospital where he has remained since being detained by authorities on Friday, NBC said. He has been intubated and sedated, according to reports. ABC News...

Bombing Suspect Was 'Very American,' Neighbor Says By SHUSHANNAH WALSHE April 21, 2013 The narrow street here that is home to the Tsarnaev family looks like many others in this city just across the river from Boston, but neighbors were still reeling from the news that members of the family who lived next door could be suspected of being behind the Boston marathon bombings. As soon as it became clear early Friday morning that the suspects were Tamerlan Tsarnaev and his younger brother, Dzhokhar Tsarnaev, police swarmed the street. They focused on a brown house here where the Tsarnaevs lived...

A friend of mine made this comment to me via email: It seems to me that the surviving Tsarnaev brother's legal status as a US citizen should be nullified since he must have taken the oath of allegiance under false pretense. If it can be nullified then he would lose the protections afforded him as a citizen. What do you think?

I’m not really in the mood to write a column. The reason why I’m in a foul disposition is I just saw the picture, taken a few minutes before the Boston blast, of the Muslim POS, better known as “Suspect #2”, dropping off his backpack filled with a pressure cooker bomb right behind eight-year-old Martin Richard, his little sister Jane, his mom Denise and scores of others. This image made me both sick and pissed off. Minutes after this picture was captured, as we now know, Martin would have nails and buckshot blast his body to smithereens, Jane would...

WAYNE, Pa. — With the television in her pizzeria showing an endless loop of the Boston manhunt on Friday, Bessie Kontis glanced up at scenes of the quasi-military lockdown and shuddered. “After something like that happens, they should stop all visas, for crying out loud,” said Ms. Kontis, 58, who owns New Wayne Pizza with her husband, Alex. “It’s insane. It just angers me.” Ms. Kontis was born in Greece and immigrated to the United States as a child, but when two men of Chechen heritage were identified as the suspects in the fatal Boston Marathon bombings, her usually broad...

NEW BEDFORD — Agents wearing FBI and Department of Homeland Security jackets detained two men at the Hidden Brook apartment complex just hours after releasing three people believed to be associated with Boston Marathon bombing suspect Dzhokhar Tsarnaev. A neighbor who declined to identify herself said the same two men were among the three people taken into custody by the FBI Friday afternoon. An FBI spokeswoman could not provide any information on the two men, both of whom were led away in handcuffs around 3:50 p.m. Saturday, or anything related to the apartment, citing the “ongoing” nature of the investigation....
