Late Friday, the federal district court in Nevada issued a declaratory judgment that makes is harder for copyright holders to file lawsuits over excerpts of material and burden online forums and their users with nuisance lawsuits. The judgment – part of the nuisance lawsuit avalanche started by copyright troll Righthaven – found that Democratic Underground did not infringe the copyright in a Las Vegas Review-Journal newspaper article when a user of the online political forum posted a five-sentence excerpt, with a link back to the newspaper's website. Judge Roger Hunt’s judgment confirms that an online forum is not liable for...

There are few things more savage and bitter than a nomination fight for the Presidency. You have a dozen or so candidates, all of them seeing a future Presidential portrait in the mirror every morning, separated by the most slender of ideological threads, most of them knowing each other for years, contending for the highest office in the world. The first debates, which seem to happen before some of the voters have even been born, resemble the early rounds of American Idol only more harsh. "Governor Palin, many of your opponents here on stage say you're not informed enough to...

I have a similar story. When I was seven years old, the young and the hallucinogenic SDS revolutionaries were marching and rioting outside our door, 725 Geneva St., Lake Geneva, WI 53147, on July 4, 1966, also the same date, a year later. Our humble, old parsonage and the church next door were located right at the downtown section of that little resort town for wealthy Chicagoans -- Geneva and Broad, one block north of Main. I remember a dream I had then; the rioters getting more and more violent, my older brothers decided they needed to defend the house....

Mark Levin asked me to post the link to where you can download a pdf of the epilogue, 'A Conservative Manifesto,' from his book 'Liberty and Tyranny' from his web site. Feel free to spread the word. (For the benefit of the uninformed, the book is by a patriot. If you are a lib, it is far better than free government cheese. ;-)

We received a copyright infringement notice today from Forbes.com. They requested that we either remove a thread that contained a full text posting of one of their articles or reduce it to a brief one paragraph excerpt with a link back to their source article. We have complied with their request and have added Forbes.com to the excerpt and link only list. My understanding of fair use is that we can quote small amounts of copyrighted works for critiquing and discussion purposes as long as we're not adversely impacting the publisher's market for his works. Our excerpt and link list...

OK - so I wanted to post a Mitch Albom hit piece - but realized upon trying to post that the Detroit (not so)Free Press is blocked. Now - I at least think I have a clue about the FR problems with materials being posted (although it seems that the sources would be glad to be quoted to increase hits to their own site, and to float the name about... but that is another argument)...And I understand that legal agreements have been reached with several media sources that require only excerpts, while there are apparently some that are completely banned/blocked....

These are the first three of five excerpts from America Alone: The End of the World as We Know it, by Mark Steyn. Published by Regnery Publishing, Inc. Copyright © 2006 by Mark Steyn. America Alone: The End of the World (part 1) Mark Steyn, National Post Published: Tuesday, November 14, 2006 John O’Sullivan, a former editor of National Review, once observed that postwar Canadian history is summed up by an old Monty Python song. I’m a Lumberjack and I’m Okay begins as a robust paean to the manly virtues of a rugged life in the north woods but ends...

He told her that Cindy’s grief had turned into panic attacks that forced her to leave a job with Napa County. At home, she took refuge with a computer that became her companion day and night.“This went on for months,” Cherie recounted. “Cindy had become addicted to online chat rooms of a pornographic nature. She had many men communicating with her. She eventually had physical rendezvous as well.

This column is being written in a bedroom in Los Angeles once occupied by 2nd Lieutenant J.B. Blecksmith, a 2003 Naval Acadamy graduate and Marine who died for his country, fighting to liberate Fallujah in the fall of 2004..... It may seem expedient at the moment for Senators to posture for the benefit of 'The New York Times' editorial board and to the American civil Liberties Union...The real question that should be asked at the present judiciary hearings: DID THE BUSH ADMINISTRATION ENGAGE IN SUFFICIENT SURVEILLANCE ....NOT TOO MUCH ?

Two weeks ago, the President renewed America’s commitment to the ideal of liberty for all. Tonight, he will lay out the policies to advance that ideal at home and abroad: “Over the next several months, on issue after issue, let us do what Americans have always done, and build a better world for our children and grandchildren.” “First, we must be good stewards of this economy, and renew the great institutions on which millions of our fellow citizens rely.” “One of America’s most important institutions – a symbol of the trust between generations – is also in need of wise...

I once saw a list of sites that did not permit their content to be fully used on Freerepulic. They were sites where we have to post excerpts, then link back to the site for the full text. In doing a search, I've come up empty. I'd appreciate seeing the list, so I can save it for future reference. Thanks.

Received another letter from Gannett Publications, publisher of USAToday, and several other newspapers. Due to contractual arrangements they have with third-party content providers, they have denied our request to allow posting of excerpts. They will only allow the posting of titles and links.

... let's put the argument where it belongs: in Chat and not in the body of a most excellent article post from the master himself. Here is what I posted in the latest quidnunc excerpted Steyn article post: Oh dear Lord ... another fascinating Steyn article sullied by lots of kvetching about quid posting an excerpt. Some of the complainers even note that quid is notorious for posting excerpts. HELLO quit your griping and post your own full copy if you wish. As most of you are aware, we've recently received several copyright complaints. In the last few weeks, we've received complaints from the SJ Mercury News, Independent (UK), SF Chronicle and The Boston Globe. Just a couple days ago the Post-Gazette send a cease and desist notice and yesterday I heard from the Tribune-Review. Tonight, I got a call from Amy and there were two more registered letters at our PO Box. The McClatchy News (Sacramento Bee) and USAToday are now added to the list of publications that have complained about copyright violations. Well, folks, the handwriting is on the wall....

The San Francisco Bay area, long the must-go destination for speculators and visionaries of every ilk, is losing people. Meanwhile, greater Los Angeles is absorbing nearly 300,000 more people each year. But it is the counties in and around the Central Valley that continue to see the steadiest population surge, the Census Bureau reported Thursday. [blah, blah, blah]

WHO'S HOT.... 1. JOHN KERRY Introducing the next president of the United Sates -- John Kerry Heinz. Yes, according to the latest polls, and the gospel of Dan Rather and Peter Jennings, the Democrat Party's wealthiest hypocrite is on his way to a smashing presidential electoral victory over George W. Bush in November. Indeed, after a series of impressive primary wins, Senator Flip Flop is looking good! No matter that the Insincere One changes political stances as often as Paris Hilton changes sex partners. For example, after a brief four-month combat stint in Viet Nam (which lately he can't stop...

Liberals at the wheel 'Enemy Within' excerpt: Savage says wrong drivers steering nation's course A near-death experience taught me one of the most important lessons of my life. I was 17 years old and working as a busboy in the Catskill Mountains in upstate New York. One afternoon my friend Harry suggested we take a break and drive around the narrow mountain roads for an hour or so to relax before serving the hotel guests another meal. His car, his idea. Off we went. At one point Harry started speeding, like kids will do, down a steep, two-lane stretch of...

The Case for Israel You've seen Alan Dershowitz defend O.J. Now see him defend Israel. The famous lawyer makes the case for the Holy Land. A Jewsweek exclusive. by Alan Dershowitz July 24, 2003 Editor's note: In September 2003, Alan Dershowitz will be releasing a revolutionary new book called "The Case for Israel" which will, in classic legal fashion, lay out the case for the Jewish State.
