  • NM: Are New Mexico Gun Bans at Rest Areas Legal?

When I crossed the border into New Mexico from Arizona on I-40 this summer, I stopped at the Manuelito Visitor Center/Rest Area.  I saw the rest area rules and read them. The line at the bottom of paragraph 2. said:  ALL FIREARMS MUST REMAIN IN VEHICLES. New Mexico has a strong pre-emption law, enforced by their Supreme Court.  Rest areas, according to handgunlaw.com(pdf) are not a prohibited area.   From the map below, it seems that the Manuelito rest area, which is on I-40 across the border from Arizona, on the way to Gallup, is not in an Indian reservation....

In the wake of the Chattanooga shootings, in which five unnamed U.S. servicemen were murdered by a self-radicalized jihadist, U.S. Army Chief of Staff Ray Odierno suggested that allowing soldiers on base or at recruiting centers “could cause more problems than it solves.” With all due respect to his service and status, this is nonsense.

There are fears Melbourne's gun crime could be spiralling out of control with police data showing a 300 percent rise in firearm offences in the past five years. Mr Iddles said the streets were more dangerous than he had ever seen. "The homicide rate's not up but if you have ice and you have the threat of terrorism, it's more dangerous now on the street as a police officer (than) in all my time of 37 years," he said. Data shows police find an illegal firearm in Victoria every 48 hours. Mr Iddles said Melbourne's northwest suburbs were a particular...

In a podcast with far left comedian Marc Maron, President Obama put forward a typical "first step" toward further infringement of Second Amendment rights.  Building on the existing, ineffective background check system, President Obama posited these "standards".  From the patriotpost.us: “The question is just, is there a way of accommodating that legitimate set of [hunting and sporting] traditions with some common-sense stuff that prevents a 21-year-old who’s angry about something — or confused about something, or is racist, or is deranged — from going into a gun store, and suddenly he’s packing and can do enormous harm?” There is...

In Oklahoma, Judge Thad Balkman ruled in favor of second amendment supporters when he issued a tempory restraining order to prevent the City of Norman from enforcing a ban on the carry of weapons during the Norman Music Festival.   The city argued that it was not banning weapons; only that the private organization that it had given control of city streets and sidewalks was banning arms.   From newsok.com: Bateman and Assistant City Attorney Rick Knighton argued that the festival operators essentially lease a three- or four-block area from the city for the special event. The self-proclaimed champions of women’s rights, the political left, is once again insisting that a woman’s right to protect herself from sexual attackers should be regulated, restricted, and in some cases banned. After all, only American Liberals would believe that a woman being raped is morally superior to a rapist being shot. Arguing that concealed carry on college campuses would actually “reinforce rape culture” on campus, an editorial in the University of North Carolina’s student’s newspaper argued against arming young (law abiding) women.Concealed weapons would not significantly reduce sexual assault and would create inadvertent risks within other forms of interpersonal violence…...

Arizona state Senator, Dr. Kelli Ward, added an amendment to a bill on restoration of civil rights.  The amendment would remove several obsolete and arcane weapons bans.  The bill, SB 1460, would add second amendment rights to civil rights that are restored when a person who had been convicted of a felony petitions a court for restoration of their rights.  From havasunews.com: Her amendment to SB 1460 legalizes devices "made or adapted to muzzle the report of a firearm.'' A person who wishes to disarm others because they do not trust themselves to bear arms responsibly. Disarmists often claim that armed citizens are afraid, fearmongers, or cowardly.   All of these accusations are projections of the disarmists' own fears.   Most armed Americans are less fearful than those who wish to disarm them, but...

New Jersey’s absurd citizen control fetish doesn’t play well in New Hampshire, Iowa, Colorado, Minnesota, Missouri, Utah, Nevada, South Carolina, North Carolina, Arizona, or Michigan. These state comprise the first two months of the 2016 Presidential primary season, and the majority of Republican voters in these states are either very pro-gun to begin with, or are trending towards passing much more Second Amendment-friendly laws. Even after the Newtown, Conn., massacre, Republican opponents of reasonable firearms restrictions in Congress blocked proposals for strengthened background checks and other steps to make future gun tragedies less likely. Now the question is whether anti-gun-control extremists will allow a federal ban on the manufacture, sale, import or possession of guns that are undetectable by metal detectors and X-ray machines to expire on Dec. 9. If fact, nowhere in the list of 23 executive actions recommended by Obama will the American public find the words, “these weapons will be banned” or “confiscation will begin on…” The president wisely left the heavy lifting of “assault weapons” bans and other unconstitutional offensives on...

Thursday was inauguration day in Venezuela. Hugo Chavez — who has dominated Venezuelan politics one way or another for 14 years — was again sworn in as President. Only this time, the authoritarian populist could not take the oath in person. He departed for cancer surgery in Cuba on Dec. 10, 2012, and has not been seen in public since. This latest surgery is his fourth round of treatment in Cuba. Few expect Chavez to serve out this next six-year presidential term.

A nationwide appeal has been sent to gun owners and their families asking they go to their state capitol this Saturday, January 19, from noon to 3 p. m. to show support for our 2nd Amendment rights. In Florida, gun owners are asked to meet in the “middle of the state” at noon, at the Hernando County Fairgrounds, 6436 Broad St., Brooksville, FL 334601. (1) This urgent call to action is in response to the Barack Obama/Joe Biden/Diane Feinstein legislative aim of imposing bans on arbitrarily selected groups of firearms and accessories. One North Carolina police lieutenant warns internet audiences,...

When the Supreme Court, or any other court for that matter, makes a ruling in a case they first look for precedent, in other words to see if there has been a court decision rendered on the same subject in the past and usually defer to the old decision in ruling on the case. The greatest teacher in life is experience; it only takes one time of burning your fingers on a hot stove to know that you never want to touch another one. The next greatest teacher is observation, paying attention to someone else's experiences and profiting from their...

Though it’s doubtful anyone will hear much about it, neither lawmakers, judges or even a president has the constitutional authority to infringe upon the inalienable right of the American people to keep and bear arms. One hundred thirty eight years ago, the Supreme Court wrote that the right to keep and bear arms “…is not a right granted by the Constitution. Neither is it in any manner dependent upon that instrument for its existence.” (1) The case was the United States v Cruikshank and the Court made it clear that the right to keep and bear arms is an inalienable...

"You never let a serious crisis go to waste. And what I mean by that it's an opportunity to do things you think you could not do before." ~Rahm EmanuelHere it is, folks, and it is bad news. Obama shared his administration plans just five days after the school shooting that killed 26 children and adults at Sandy Hook Elementary School. Now Congress and the White House have the framework for legislation from 2008 (see below), a serious tragedy, and a corrupt mainstream media like never before... They really do not believe you need anything more than a brick to...

In spite of Vice President Joe Biden’s threat in this morning’s gun grab task force meeting that “executive actions” are on the way, the legitimacy and survivability of such a move is by no means assured, as the gun ban juggernaut, reanimated following Sandy Hook, has encountered some unforeseen bumps in the road that have the potential of halting it in its tracks with no place to go that isn’t blocked. Gun owners, horrified and then outraged by a full court press from the government, the “Authorized Journalist” media and citizen disarmament advocacy groups, are beginning to push back in...

A Democratic legislator in Iowa is startling citizens with his most recent proposal: ban the sale of semi-automatic weapons, and confiscate them from existing gun owners if need be. Here is an excerpt from Iowa’s Daily Times Herald, which conducted the interview with State Rep. Dan Muhlbauer: In an interview, a fiery Muhlbauer said it is time to act with “radical changes” on gun laws and other issues to protect schoolchildren from shooting sprees like the one last week in Newtown, Conn. “We cannot have big guns out here as far as the big guns that are out here, the...
