Tenth Circuit Panel Rules in Favor of Colo. Company Against Abortion Pill Mandate A three-judge panel of the Tenth Circuit Court of Appeals ruled that a Colorado-based business does not have to adhere to the federal government's abortion pill mandate as its lawsuit proceeds. In a ruling issued Thursday, the panel affirmed a lower court ruling on behalf of Hercules Industries, a family-owned Denver-based HVAC manufacturer. The decision noted that the motion to appeal was "denied as moot" given that the United States Supreme Court likely will hear arguments in a similar lawsuit regarding the Hobby Lobby retail chain.... The Catholic owners of a Colorado-based business won an injunction recently against implementing an ObamaCare mandate -- only to be denied a proclamation now from the Denver City Council. Hercules Industries, a heating, ventilation, and air-conditioning manufacturer which employs 300 workers and has been in business in the Mile-High City for 50 years, was to be honored with a “Good Citizenship Award." The laurel was in recognition of contributions to the community, including the historic restoration of company headquarters and, ironically, its “generous employee health care coverage.” But the award was taken away after the owners of Hercules Industries, the...
  • Judge Sides With Colorado Company That Opposes Contraception

A judge has sided with a Colorado company whose owners oppose contraception and blocked a federal mandate that the company’s health insurance for employees include birth control coverage. The mandate stems from President Obama’s controversial Affordable Care Act. Senior U.S. District Judge John Kane issued an order Friday that bars the government from enforcing the requirement against Hercules Industries, Inc., a Denver heating and air conditioning company. The judge, in an 18-page decision, cited the owners’ religious rights as the basis for his temporary injunction. The owners are Roman Catholics whose religious beliefs are consistent with the church’s teaching against...

Don't get too excited by this court decision, an injunction against the HHS contraception mandate that goes into effect on Wednesday. We've seen other court rulings on ObamaCare go one way, only to be disappointed in the final test at the Supreme Court. Still, I'd rather win the first round than lose it (via The Anchoress): The Catholic family that owns a Colorado-based company won a court victory in their battle to stop the Obama administration from requiring them to provide insurance coverage for abortion-inducing drugs, sterilization and contraception, a mandate they say violates their religious beliefs and First Amendment...
