  • 2017 is Best Chance for Permitless "Constitutional" Carry in Indiana

Permitless, or "Constitutional" carry has become an expanding trend in 2016. The number of states that do not require a government permission slip to carry a weapon for self defense, open or concealed, has jumped from seven to eleven. The four states added in 2016 were Idaho, Missouri, Mississippi, and West Virginia. Indiana has always been a good candidate for permitless carry. It was one of the first states to have a shall issue permit. That was because of a judicial ruling on the Indiana Constitution, not legislative action.  From In Schubert v. DeBard (1980) Ind. App., 398...

SOUTH BEND — The student and parents suing Concord schools over the annual Christmas Spectacular are still seeking a court order barring the school from reverting to older versions of the show that contain live Nativity scenes. In a filing last week in U.S. District Court in South Bend, the anonymous Concord Community Schools student and three parents suing the school district say school officials' promises to use mannequins instead of live actors to depict the Nativity aren't enough. A court filing in the case by the school district in early October says Concord Community Schools Superintendent John Trout and...

At first I thought that this was fake, but now I don’t know what to think. On October 1st, a video was posted to YouTube that claimed to show a very strange “circle of fire” in the clouds that seemed to respond to the blowing of the shofars in the city of Jerusalem below. When this video came out, many immediately dismissed it as a fake because it is only 20 seconds long and because computer-generated graphics can produce these kinds of effects. If you have not seen the video yet, you can see it right here… Since so many...

The Trump campaign had little problem getting on the ballot, having quickly gathered more than the 4,500 voter signatures necessary. And Early is convinced that Trump will take Indiana, winning over not only Republicans who like his tough talk but some cross-over Democrats, too. Despite polls that show the blustery Trump offending women, Early said he heard nothing but praise from some Tea Party-affiliated women he visited this week. The bumper stickers went fast, he said. “I don’t think he’ll have a problem with women,” Early said. Trump's delegate situation in Indiana is proving tougher. Behind the scenes, younger and...

Josh Kraushaar writes, It's the $64,000 question for establishment-minded Republicans: Would they rather see Ted Cruz or Donald Trump win the Iowa caucuses, assuming none of the more moderate candidates prevail? In an informal survey of senior GOP strategists, the clear winner was Trump. For a number of years, there has been an attempt to require people who exercise their Second Amendment rights to report to the government if any of their firearms are stolen.  While this may seem innocuous to the naive, it serves much deeper disarmist purposes.  The obvious purpose of this law is to make the exercise of Second Amendment rights more legally dangerous, in stark opposition to ownership of other common items, such as gasoline, vehicles, or common poisons.  It singles out the exercise of a single Constitutional right for increased scrutiny, and it creates a reason for the...

A protective order can be effective.  Especially if it is backed up with a gun.  Protective orders are meant to be backed with armed force.  The problem is that in many cases, armed agents of the state either arrive too late to be of help, or they cannot stay around long enough to provide effective protection.  But when the armed force is in the form of the person who asked for the protective order, the protection is multiplied many times.  In this case out of Indiana, the suspect, Jeffrey Frakes, had been released from jail the day before. From

SB 229 passed the conference committee, the Senate 38-10, and the House 75-24, and now goes to the Governor.   This was the last day the legislation could be passed, so it was down to the wire.  The substance of the bill is fairly straightforward and consists of three reforms.  The first two reforms remove traps in existing law for legal gun owners.  Currently, part of the law created "roaming gun free school zones" whenever school children went for an official function.   Where the children went, there went the "gun free" zone.   A legal gun carrier could be sitting on...

Current Indiana law creates dangerous traps for people exercising their second amendment rights.   More than 1 in 9 adults in Indiana have a license to carry a handgun.  Legally carrying handguns in Indiana has become common, legal, and has proven to be safe.  Unfortunately, Indiana has some archaic laws that were created when "gun control" was in fashion.  These laws create traps for the law abiding gun owner.   One trap in the law is the inadvertently constructed "roving school zone".  In current law, students that go to a facility for educational purposes create a "roaming school zone" where...

A few days ago, I wrote about a modest reform to stop the waste of valuable resources occurring at Indiana gun turn in programs, also known as "buy backs".   "Buy backs" is a misnomer, as the guns were never owned by the people who are buying them in the programs.   The reform was a simple one: as tax dollars are expended in these turn in programs, instead of the valuable assets that are collected being destroyed as a primitive symbolic measure, once the guns have been taken off the streets, they should be sold to legal dealers.  This returns...
