Whether the federal government can compel citizens to get vaccinated is a question that will be decided in federal court. And there are several ways to challenge the mandate, any of which may prove to have limited success. The challenges will come to the mandate’s legal mechanism: an emergency rule issued by the Occupational Safety and Health Administration. The fact that it’s an “emergency rule” means it can bypass the usual regulatory safeguards and hit the public with the full force of law without comment or argument.Reason.com:Of the nine emergency standards issued between 1971 and 1983, three (dealing with asbestos, vinyl...

While the Supreme Court considers one challenge to a provision of the Affordable Care Act (ACA), a federal appeals court located just blocks away is contemplating a separate challenge that could have much more dire consequences for the future of the law. […] The conflict at the center of the Halbig (vs. Sebelius) case (and three other challenges across the country) has to do with tax subsidies granted to those who seek to obtain insurance from the exchanges. The ACA grants the credits to qualifying individuals in order to defray the cost of the insurance. Millions of Americans are expected...
  • Is it even legal…(for the Administration to allow federal subsidies for policies...?)

Various legal challenges to Obamacare that are about to start winding its way through the Federal courts are premised on the idea that federal subsidies sold on a federal exchange (as opposed to those sold on a state exchange) can't be subsidized by federal dollars as authorized under the ACA. But given the Adminstration's imminent proposal to allow insurance companies to sell subsidized policies directly, this part of the ACA becomes even more important to revisit. How could it possibly be that an insurance policy sold directly by a health insurance company could qualify for a federal subsidy? http://www.redstate.com/charliesalmanack/2013/11/20/is-it-even-legal/

SAN FRANCISCO - The future of embryonic stem cell research could be shaped in a suburban courtroom where two taxpayer groups are challenging the legality of California's new agency dedicated to the controversial field. Opening statements were scheduled for Monday in a pair of lawsuits seeking to invalidate the law that created the California Institute of Regenerative Medicine, which is authorized to hand out $3 billion in research grants. The lawsuits allege — among other things — that it violates a state constitutional mandate that the spending of taxpayer dollars be under state control. "The act delegates the disbursal of...
