The Bellevue-based Second Amendment Foundation has banked another check to cover legal fees in a federal gun rights lawsuit, this one for $12,000 from the City of Omaha, NE. While the amount is a fraction of the $399,950 payment received last week from the City of Chicago and anti-gun mayor Rahm Emanuel, it represents an equally-important victory to SAF founder and Executive Vice President Alan Gottlieb. This column discussed the Chicago pay-out with a photo image that raced across cyberspace. The Omaha lawsuit was dealt with rather quickly late last year. It involved a legal resident alien, Armando Pliego Gonzalez...

Mitt Romney is getting some heavy air support in Michigan — the state where he was born and raised — as the “super PAC” supporting him invests almost $500,000 on television ads there. According to someone who tracks Republican media spending, Restore Our Future has committed just over $470,000 for commercials starting Tuesday and set to run through Feb. 20. That marks the group’s largest purchase yet in Michigan, where it will have spent more than $700,000 on ads by next week. The group said Monday that it would continue for now to run an ad called “Risk” that targets...

You're home may be considered you're castle but legally in Nebraska you're not allowed to stand your ground if an intruder breaks in but lawmakers are trying to change that. Imagine. You're lying in bed and you hear your door get broken into and then you hear the terrifying footsteps of someone walking down the hallway toward your room. You're first thought might be to protect yourself but legally in Nebraska that's not your first option. "Right now the current law in the state of Nebraska requires that you retreat from the assailant or the source of danger," said Deputy...

OMAHA, NE January 6, 2012 – The Nebraska FirearmsOwners Association (NFOA), announced the official launch of ProtectVictimsNow.org, a website aimed at educating and promoting the passageof a Victim Protection Act in Nebraska. Twenty-nine states have updated their self defense laws inrecent years. Of the 21 remaining states, several already had laws that recognized these changes in self defensejurisprudence. This leaves Nebraska as one of thelast states to enact such legislation. Over the last several years, there have beenmultiple bills and public hearings to attempt to move these changes through ourLegislature. This year the NFOA is renewingour request that the Legislature take...

The New York Times reported last week that Republican leaders in the Senate are trying to recruit Gov. Dave Heineman to run against conservative Don Stenberg in the Republican primary race for U.S. Senate in Nebraska. This recruitment effort is troubling for several reasons. First, it threatens Don Stenberg, a proven conservative who is already leading incumbent U.S. Senator Ben Nelson (D-NE) in the polls. Gov. Heineman is a good guy, but by his own admission his heart is not in this race, and he's definitely no Don Stenberg. In fact, the Cato Institute recently gave Heineman a "C" grade...

A bar owner turns the tables on an armed man demanding money. The robber was captured. One employee says she's convinced the would-be robber would have shot and killed someone, if his gun had been real. "They were on the ground and that's when I was kind of like wow," Kathy Morley said. "And I just keep looking at him and he's pointing that gun at everybody." Morley was just about to lock up at the Time Clock Lounge at 90th & L around 1:30 AM Sunday when the robber entered. "It was only like a minute or some thing...

Incumbent Senator and former Governor Ben Nelson has fallen behind in new polling in Nebraska. The Democrat reportedly has been considering retirement, which should not be surprising at all, considering the data. Nelson has been polling poorly for a while, now. It may be at the point that Nelson's campaign would not even be able to get off of the ground. Nelson was polled against three candidates, including Nebraska Attorney General Jon Bruning. In two of the matchups, Nelson either led slightly or had a 6% lead. However, against Bruning, Nelson has quite the deficit. Considering that Bruning would have...

BELLEVUE, WA --(Ammoland.com)- A federal judge has granted a preliminary injunction against enforcement by the City of Omaha, NE of an ordinance that prohibits legal non-citizens from registering handguns in the city, in a case brought by the Second Amendment Foundation, the Nebraska Firearms Owners Association and Armando Pliego Gonzalez. The order was granted by U.S. District Judge Joseph Bataillon while the court considers whether the registration ban for legal immigrants is unconstitutional under the Second Amendment. “We’re delighted with the judge’s order,” said SAF Executive Vice President Alan Gottlieb. “Mr. Pliego has been a legal permanent resident since 2008,...

If a mountain lion had gotten to within 10 feet of me when I was 15 years old, I might have soiled my pants. Kudos to this kid for keeping his head and doing what needed to be done. From the Associated Press: LINCOLN, Neb. (AP) — The Nebraska Game and Parks Commission says a 15-year-old deer hunter shot and killed a mountain lion that was only 10 feet from him. The boy, of Wayne, shot the cougar Saturday near Creighton in northeast Nebraska. Officials say he was hunting a shelterbelt in Knox County and spotted the mountain lion 10...

Omaha, NE – Some gun owners are saying “no” to proposed changes to Omaha’s gun registration rules, and the city of Omaha says “yes” to a new health care program. The city’s proposal to revise Omaha’s gun registration rules had gun owners from inside and outside city limits showing up in city hall—all hoping to convince the city council to shoot down what some say is “redundant” to current state and federal law. Omaha currently requires every handgun purchased within the city to be registered for a fee. “It duplicates the investigating that the state does with their purchase permit,”...

A bill that clarifies the process of gun purchase application has passed the Nebraska Legislature, and it’s sponsor is “glad it’s done.” State Sen. Mark Christensen of Imperial said he sponsored the bill at the request of the Nebraska State Patrol. LB512 now assures that mental health records are more accessible in the sale of firearms in Nebraska. It makes records available to the National Instant Criminal Background Check System if they disqualify a person from owning or using a handgun. The District 44 senator said essentially LB512 assures second amendment rights. In the past, if a person had an...

LINCOLN — Nebraska will keep its split electoral vote system for at least another year, thanks to a split vote in a legislative committee. The Government, Military and Veterans Affairs Committee was divided 4-4 in a straw vote on changing the system, State Sen. Bill Avery of Lincoln, the committee chairman, said Thursday. The informal vote marked the latest defeat for Republican efforts to return Nebraska to a winner-take-all system of awarding electoral votes. Sen. Beau McCoy of Omaha introduced the latest proposal, Legislative Bill 21. Since 1991, three of Nebraska's five votes have been decided by congressional district. The...

Add two more Republicans to the list of possible U.S. Senate contenders. State Sen. Deb Fischer, 59, of Valentine says she is “thinking” about a run, but won't decide until after this year's legislative session. And while former Nebraska Gov. The two are the latest names to come forward and possibly run in 2012 against Democratic U.S. Sen. Ben Nelson, who has said he is leaning toward another run, although he has yet to finalize his decision. The Republican...

Senator Mark Christensen’s bill to address self defense issues at home and work, LB 889, got killed in this year’s session of the Unicameral but that doesn’t mean he’s giving up. Prior to adjournment, Christensen got a legislative resolution passed to conduct an interim study on a key element of the bill, commonly know as the Castle Doctrine. Christensen has built a reputation as a big advocate of Second Amendment gun rights. As a result, he wants to make sure people have the right to protect themselves in their homes, workplaces and vehicles without the threat of a civil lawsuit....

TEXT OF STATEMENT SHUTTING DOWN 'LAMBS' October 15, 2010Today, for grave reasons, I suppressed the Hermit Association of the Intercessors of the Lamb. The way of life of some fifty vowed members was in peril due to actions of a handful of civil directors. The vows of the former members have ceased (c. 1194), and they are to set...

In the absence of any real action by the Obama administration to crack down on illegal immigration, cities and towns across the U.S. are taking matters into their own hands. Arizona’s immigration law is case in point, but it doesn’t stop there. While many cities are calling for boycotts of all things Arizona (Los Angeles, San Francisco, New York City, to name a few), some in states around the country are following its lead in combating illegal immigration. The City Council of Fremont, Nebraska, a small Midwestern community with barely more than 25,000 residents, just passed an ordinance designed to...

In what is developing into a standoff between states and the federal government that could be bigger than gun control or even health care, 17 states have launched versions of Arizona's immigration law, even as federal officials say they may not bother to process illegal aliens caught by the states. "Over the last couple days, Obama and the chief of ICE have refused to honor their oaths of office," he...

LINCOLN - A citizen's fatal shooting of a would-be robber in Omaha has sparked a debate over whether Nebraska should join three other states and do away with training and permit requirements to carry concealed handguns. Harry J. McCullough III, a 32-year-old drugstore customer, shot one robber who was holding a sawed-off shotgun and apprehended another. McCullough did not possess a state permit to carry a concealed handgun. He probably would be ineligible for such a permit because of his 1997 misdemeanor conviction for carrying a concealed weapon. Many credit the actions of the former security guard with preventing the...

OMAHA, Neb., May 6 /PRNewswire-USNewswire/ -- The Nebraska Firearms Owners Association (NFOA) today called on the city of Omaha to end its practice of registering firearms, in the wake of a case involving a private citizen who fatally shot an armed robber, and who continues to be denied the ability to register a new firearm by the Omaha Police Department, which took his defensive sidearm used in the shooting into evidence. This is a video of Harry James McCullough's attorney explaining what happened in the Nebraska Walgreen shooting. The Nebraska Firearms Owner Association has offered to buy a new handgun for the man who shot and killed a robbery suspect at an Omaha Walgreens. Harry "James" McCullough, 32, said he's been overwhelmed by the support from people appreciative of his actions. On Monday, April 26th, he noticed two men, one of them armed with a shotgun, threaten the clerk and another customer at the Walgreens on 61st and NW Radial. That's when he shot the man 4-times, killing him. McCullough then held down the other suspect until police arrived. "You only have one chance," is what he told...

Harry James McCullough took it personally. The former security guard was standing at a Walgreens checkout counter when he saw two masked men, one with a sawed-off shotgun, enter the store. Marquail Thomas, 18, pointed the shotgun at customers and yelled, “Nobody (expletive) move!'' “There's no doubt in my mind what they were going to do,” McCullough said Thursday. “There was no time to react. You only have one chance.” McCullough pulled out a pistol and shot Thomas four times. Thomas collapsed outside the store and died later at a hospital. McCullough chased down the second masked man, whom Omaha...

LINCOLN, Neb. (AP) - The Nebraska attorney general's office says the city of Omaha is violating state law by forcing people who have permits to carry concealed guns to also register their guns with the city. The formal - but not legally binding - opinion issued Friday says Omaha's rule imposes a gun-possession regulation not allowed under a measure passed last year by lawmakers. That law says cities can't have local rules barring people with conceal-carry permits from carrying concealed guns inside city limits. Background checks and training are required to get conceal-carry permits. Sen. Mark Christensen of Imperial introduced...

LINCOLN — Is Omaha a confusing place for gun owners? Not if you ask City Prosecutor Marty Conboy. Conboy said the city’s handgun registration ordinance still applies to people who have obtained a state concealed-gun permit, despite a state law adopted last year to nullify city ordinances banning concealed guns. “State law doesn’t regulate registration,” Conboy said Thursday. His comments came after plenty of confusion was voiced about Omaha’s ordinance during a public hearing of the Legislature’s Judiciary Committee. Some of those testifying at the hearing, as well as State Sen. Colby Coash of Lincoln, said a recent memo from...

Former Republican presidential candidate Mike Huckabee says those unhappy with the health care overhaul set to be pushed through the Senate this week should express their displeasure at the polls next November. WASHINGTON (AP) - The little town of Libby, Mont., isn't mentioned by name in the Senate's mammoth health care bill, but it's one of the big winners in the legislation, thanks to the influence of Finance Committee Chairman Max Baucus, D-Mont. As the Senate health care debate enters crunch time, the pressure from all sides continued to grow today, with Sen. Ben Nelson, D-Neb., right in the middle. His spokesman quickly dismissed a report by conservative columnist Michelle Malkin that Nelson was even being threatened with “closure of an air force base,” presumably Offutt Air Force Base, which is south of Omaha and home of U.S. Strategic Command. Malkin also said Nelson has been promised a “bribe bigger than Sen. Landrieu's.” That's a reference to Louisiana Sen. Mary Landrieu, a Democrat and one of the last holdouts on the vote to...
