A vote to report a state Obamacare exchange bill out of the Michigan House Health Policy Committee came up short yesterday, with only two Republicans supporting it (Committee Chair Rep. Gail Haines of Waterford and Rep. Mike Callton of Nashville). Following the vote, House Speaker Jase Bolger, R-Marshall, declared the state-run exchange dead, saying: “…After due diligence, however, it is clear that there were too many unanswered questions for the committee to feel comfortable with a state-run exchange and we will not have one in Michigan… The committee apparently was not able to get the answers to key questions or...

Now that Obama has been re-elected and Democrats still control the Senate, Republicans no longer have the chance to repeal Obamacare. But all is not lost. There's still an opportunity for America to stop this disaster by choking the life out of the federal monstrosity. Obama's signature legislative achievement is likely headed back to the Supreme Court. Just last week, the high court ordered a lower federal court to take up a lawsuit by the patriots at Liberty University, who claim Congress violated the college's religious freedoms by forcing it to provide federally mandated insurance and requiring payment for abortion-related...

Obamacare supporters rejoiced in June when the Supreme Court ruled the U.S. could use its taxing authority to mandate that most people buy health insurance. But their celebrations may have been a bit premature. The Affordable Care Act faces other legal hurdles—including a challenge that only could have been made after the Supreme Court’s ruling. The right-leaning Pacific Legal Foundation amended its challenge to the ACA after the Supreme Court upheld the insurance mandate under Congress’ taxing powers. The group's challenge turns on the Origination Clause in the U.S. Constitution, which requires that bills for raising revenue start in the...

(Reuters) - The Internal Revenue Service has released new rules for investment income taxes on capital gains and dividends earned by high-income individuals that passed Congress as part of the 2010 healthcare reform law. The 3.8 percent surtax on investment income, meant to help pay for healthcare, goes into effect in 2013. It is the first surtax to be applied to capital gains and dividend income. The tax affects only individuals with more than $200,000 in modified adjusted gross income (MAGI), and married couples filing jointly with more than $250,000 of MAGI. The tax applies to a broad range of...

Thanks to the 62,615,406 individuals who took off their thinking caps and re-elected President Barack Obama, thousands upon thousands of folks are receiving their pink slips now or soon will over the next several weeks or months. These lost jobs are often high-paying and are disappearing by the hour. The culprit? It's none other than Obama's landmark legislation, The Affordable Care Act, aka ObamaCare. Re-electing Barack Obama guaranteed that the 2.3% medical device tax, a key funding source for ObamaCare, will go into effect on January 1, 2013. This transfer of money from these companies to the federal government, which...

Dems: Federal health programs should cover DREAMersBy Sam Baker - 12/03/12 02:53 PM ET Federal healthcare programs should cover the children of illegal immigrants, a group of House Democrats says. Democrats are asking the Obama administration to make healthcare available to children who are able to stay in the U.S. under the deferred-action immigration policy that President Obama announced earlier this year. The policy — similar to the DREAM Act — allows many children of illegal immigrants to remain in the U.S. without fear of deportation, as long as they meet certain criteria. Republicans believed a Mitt Romney win would seal Obamacare's fate. Democrats - or rather, the lonely two-fifths of Americans who support the president's beleaguered healthcare law - believed an Obama win would secure its future. Both sides were kidding themselves.Romney may have pledged to repeal the law, but his positions on Obamacare had the life span of a rainbow. He supported an identical law when he got the credit for signing it as governor of Massachusetts. He then opposed Obamacare when that's what GOP primary voters wanted to hear, and later endorsed parts of it when he thought that's what...

Opposition to Obamacare fueled the Tea Party wave of 2009-2010. The next wave will include continued opposition to Obamacare, along with other fiscal issues, The Tea Party tsunami at the gates. The fight over Obamacare as a law ended when Chief Justice John Roberts enganged in mental gymnastics to uphold the law under Congress’ taxing authority, and then again when Obama’s reelection removed any possibility of complete repeal. The fight over Obamacare now is over implementation. There are inherent problems in the law itself which will raise popular ire, but the battle now is over exchanges and other aspects of...

There is an antique saying -- no less true for its antiquity -- that you need to be careful what you wish for, because you just might get it. This came to mind when I read a recent report about what is happening at a Pennsylvania college. One of President Obama's most loyal -- not to say fawning -- constituencies clearly is academia. His rate of support among collegiate faculty and administrators surely approaches near-unanimity on the typical campus. This is why the news about the Community College of Allegheny County (CCAC) is so richly ironic. CCAC has just announced...

The "Affordable Care Act" might die a death of a thousand legal cuts. Last June, upon learning that the Supreme Court had ruled Obamacare's individual mandate constitutional, many observers were forced to concur with the Dickens character who opined, "If the law supposes that… the law is an ass." Yet, the increasing number of anti-PPACA lawsuits that have been receiving serious attention from the courts suggests that the legal system may not be as irrational as it seemed when Chief Justice John Roberts began braying from the bench on June 28. If this seems Pollyannaish, consider the fate of McCain-Feingold....

The signature power grab of the left may be the “law of the land” as conceded by ever conciliatory House Speaker John Boehner, but getting the massively complex statute up and running will be far more difficult than getting it passed. When Democrats rammed ObamaCare through congress in 2010, their intent was to literally acquire the power of life and death over the American people, not create a workable healthcare plan. And this becomes increasingly apparent as the requirements of the 2700 page behemoth are gradually made known. Those who wrote the law believed that elected officials in the 50...

Each year, Congress holds a sword of Damocles over the heads of the medical profession. The "doc fix" is a budget adjustment to bring Medicare fees into the world of reality. democrats love to omit it for the sake of appearances. Obamacare cuts $716 billion from Medicare. Obama calls it "waste." Physicians call it reimbursement. What that will do is make finding Medicare providers far more difficult. The AMA supported Obamacare, on the promise that the law would include a permanent “doc fix.” But Democrats reneged on that promise, owing to the cost of a permanent SGR adjustment: something on...

New Obamacare regulations will force pizza chains like Domino's to post up to 34 million nutrition signs in its stores -- one for every pizza combination the company makes. The rules require fast food and grocery stores that have more than 20 stores to require labels for each product they produce. Jenny Fouracre-Petko, the legislative director for Domino’s, said mandated signs will cost Domino’s nearly $5,000 per store. Even worse, the cost will get passed down to the consumer, many of whom will never see the signs since “10 percent of pizza customers never enter a Domino’s store” because they...

Chief Executive Kathleen Pacurar said Thursday that the cuts include temporarily shutting down San Diego Hospice’s most visible presence in the community, a 24-bed specialty hospital in Hillcrest. Thought to raise about 60,000 pounds/year, it would amount to twenty percent or so of the cost to garrison a vast new country won from France in the war that concluded only two years earlier. It was the wrong tax at the wrong time. It was wrong because direct taxes had been left to the individual colonies since 1607. Parliament’s timing was horrible because instead of prosperity with the conclusion of war, the colonies slipped into hard economic times. Regarded as...

    1. Deregulate the state exchanges, while capping subsidies. 2. Slowly shift Medicare patients into the exchanges. 3. The blaming of governors for not implementing ObamaCare is in hyperdrive for a reason— the federal government and liberals backing ObamaCare overestimated the federal government's ability to build a system of the complexity and technological intricacy necessary to pull this off. They counted on states to do some heavy lifting (with a hefty price tag) to make this happen, yet have given them very little regulatory guidance and passed the bill in a way least likely to engender cooperation. PRINCETON, NJ -- For the first time in Gallup trends since 2000, a majority of Americans say it is not the federal government's responsibility to make sure all Americans have healthcare coverage. Prior to 2009, a majority always felt the government should ensure healthcare coverage for all, though Americans' views have become more divided in recent years. The current results are based on Gallup's annual Health and Healthcare poll, conducted Nov. 15-18 this year. The shift away from the view that the government should ensure healthcare coverage for all began shortly after President Barack Obama's election and has continued the...

Well, I don’t want to call it a lie… Butt it is beginning to look like a mis-misunderstanding. Probably because nobody knew about all the entitlements (like free condoms) that were in the bill until after we passed it.(snip) Well, I’m sure Congress will take care of everything. They always do. Or as Winnie-the-Pooh used to say: “Don't underestimate the value of Doing Nothing, of just going along, listening to all the things you can't hear, and not bothering.” In other news, The US Ambassador to the UN must have skipped that Ambassador school class they have on “charm” because...

...the Patient Protection and Affordable Care Act of 2010. Last June, in NFIB v.Sebelius, the Supreme Court gave the act a mixed bill of constitutional health. It upheld the individual mandate by saying that it was constitutional under Congress’s taxing power. However,it also ruled that Congress could not compel the states to expand their Medicaid programs by threatening to cut off all Medicaid subsidies if they did not do so. Imposing onerous new requirements in a program that already represents such a large part of the states’ budgets that they can’t afford to lose federal subsidies, the Court ruled, is unconstitutional....

MADISON, Wis. - Meriter Hospital said it's laying off about 50 employees. In a statement Tuesday, Meriter Health Systems said it will see a significant drop in Medicare reimbursements beginning in January and the layoffs are a result of a plan that realigns positions in preparation for the cuts in Medicare reimbursement. Meriter confirmed that 140 positions are being eliminated, but through attrition and reassignments, it only expects approximately 50 employees to lose their jobs. Of Meriter's 3,500 employees, fewer than 4 percent were directly affected, according to the statement. Meriter said this change impacted all levels in the organization...

Good morning everyone. Today I have prepared a remedial lesson for us on Obamacare.  I just realized that we haven’t discussed Big Guy’s legacy legislation since well before the reelection. And I recall that many of you have some reservations concerning its efficacy. So now that it has been deemed the law of the land, I did a little additional research. As it turns out, Obamacare is not as bad as you’ve been led to believe. It’s actually worse, much worse. All the way from the “free, preventative” annual exams, If you are complaining of a new problem, then you...

The US Supreme Court on Monday set the stage for further litigation over the constitutionality of President Obama’s health-care reform law. In a somewhat unusual maneuver, the high court agreed to send one of several cases challenging the Affordable Care Act (ACA) back to a federal appeals court to consider the underlying merits of the lawsuit – including whether the measure violates religious freedom. In late June, the Supreme Court voted 5 to 4 to uphold the ACA as a valid exercise of Congress’s taxing authority. The ruling forced the dismissal of a handful of other cases challenging the reform...

WASHINGTON—States will receive more than $9 in federal money for every $1 they spend to cover low-income residents under President Barack Obama's health care law, according to a nonpartisan analysis released Monday. Expanding Medicaid to cover about 20 million more low-income people will cost over $1 trillion nationally from 2013 to 2022, said the joint report from the Kaiser Family Foundation and the Urban Institute. But the analysis found that states will pay just $76 billion of that, a combined share of roughly 7 percent. The feds will pay the other $952 billion. Republican governors have resisted the Medicaid expansion,...

The Supreme Court today ordered a federal appeals court to take a new look at the controversial Obamacare law and whether it unconstitutionally forces taxpayers to fund abortions and contraception, violating religious freedoms. The high court ordered the 4th U.S. Circuit Court of Appeals to consider the case of Liberty University, a Christian college that contends ObamaÂ’s health care law violates the schoolÂ’s religious freedoms. A federal judge rejected the case and the 4th U.S. Circuit Court of Appeals ruled the lawsuit was premature but did not deal with the main points the lawsuit brought up.When the Supreme Court upheld the...

The C.R. Bard plant in Queensbury is laying off 54 full-time employees, citing lower-than-projected sales. Employees were notified of the layoffs Monday, and the actual reductions will take place over the next few weeks. The layoffs announced Monday are on top of 55 layoffs at the medical device manufacturing plant in July, said Scott Lowry, C.R. Bard vice president and treasurer. “It’s a challenging health-care environment for a lot of reasons,” Lowry said. “We’re right-sizing to meet those changes. We’re not seeing the volumes we had in the past, the volumes we were expecting.” No additional layoffs are planned for...

What a clusterfark. The Hill: ***** "The Obama administration faces major logistical and financial challenges in creating health insurance exchanges for states that have declined to set up their own systems. The exchanges were designed as the centerpiece of President Obama's signature law, and are intended to make buying health insurance comparable to booking a flight or finding a compatible partner on Match.com. Sixteen states - most of them governed by Republicans - have said they will not set up their own systems, forcing the federal government to come up with one instead. Another five states said they want a...
