  • Rivkin and Casey: The Opening for a Fresh ObamaCare Challenge

ObamaCare is being implemented, having been upheld as constitutional by the Supreme Court in June in a series of cases now known as National Federation of Independent Business v. HHS. It is becoming increasingly clear, however, that the court took a law that was flawed but potentially workable and transformed it into one that is almost certainly unworkable. More important, the justices also may have created new and fatal constitutional problems. ObamaCare, or the Affordable Care Act, was conceived as a complex statutory scheme designed to provide Americans with near-universal health-care coverage and to effectively federalize the nation's health-care system....

Democrats are exulting in their narrow victory on Nov 6, saying that ObamaCare is “now a certainty,” and the “best is yet to come” as they implement their glorious promises of healthcare for all. The fact is, however, that key parts of the Act are not in effect yet and may be blocked at the state level.

The U.S. Internal Revenue Service on Wednesday released final rules for a new tax on medical devices, products ranging from surgical sutures to knee replacement implants, that starts next year ... ... The tax applies mostly to devices used and implanted by medical professionals, including items as complex as pacemakers or as simple as tongue depressors. Products sold for humanitarian reasons, such as experimental cancer treatment devices, are not exempt from the tax. ... it remains "an open question" when latex gloves come under the tax

Chief Justice John Roberts rewrote the Affordable Care Act (ACA) in order to rescue it from the Constitution. The IRS rewrote the law in order to rescue it from financial oblivion. And the leftist scribes who authored ObamaCare claim none of this illegal, post-legislative tampering really matters. For they contend that what they wrote in the law is not as important as what they really meant! John Roberts stunned and angered “fellow” conservative justices on the Supreme Court when he deliberately ignored the actual language of the Affordable Care Act in ruling the law Constitutional. For although the law’s authors...

Thursday, December 06, 2012 Cook Co Obamacare to start for uninsured adults January 1 COOK COUNTY - Starting January 1, Cook County will be one of the nation's first counties to immerse itself in Obamacare after the General Assembly agreed earlier this year to request a special federal advance. The desired waiver would help to bail out Illinois' most populated county budget overwhelmed with health care costs. The feds agreed to kick Cook County in to the Obamacare system ahead of the rest of the nation to pay for adults 18 through 65 not covered by Family Care or Medicaid...

The Obama administration has been consistently arguing since announcing a year’s grace period for some religious organizations to figure out how to violate their consciences and obey the Department and Health and Human Services abortion-drug, contraception, sterilization mandate, that the controversy over religious freedom and the mandate is over and the Catholics are happy. That, as has been pointed out here before, ignores all the lawsuits pending. And that they are not just from Catholics. Today in New York, a judge dismissed Justice Department claims that the Archdiocese of New York’s lawsuit in response to the coercive mandate is unnecessary....
  • 'Obamacare' saves consumers nearly $1.5 billion

Washington — Consumers saved nearly $1.5 billion in 2011 as a result of rules in President Obama´s healthcare law that limit what insurance companies can spend on expenses unrelated to medical care, including profit, a new analysis shows. Much of those savings — an estimated $1.1 billion — came in rebates to consumers required because insurers had exceeded the required limits. The study by the New York-based Commonwealth Fund also suggests that the Affordable Care Act forced insurers to become more efficient by limiting their administrative expenses, a key goal of the 2010 law. In some cases, insurers passed savings...

Look, I don’t even know anymore. I’m just gonna put these out there for you as yet another indication of how tough getting anywhere close to solving our deficit and debt problems is. It’s a nice complement to the latest in the fiscal cliff saga, in which allegedly intractable, unreasonable Republicans offer a Simpson-Bowles-like compromise that might actually come within a couple ballparks of acknowledging our debt problems while Democrats seem rather enthusiastic about cliff-diving and yet the press and public are determined to blame Republicans for going over. Let’s see if that can change in the near future. Presumably...
  • Letter from Hobby Lobby Stores CEO

David Green is the founder and CEO of Hobby Lobby Stores, Inc., which is challenging the Obamacare contraceptive mandate. This letter is an excellent illustration of how stupid one-size-fits-all federal policies trample individual freedom. When my family and I started our company 40 years ago, we were working out of a garage on a $600 bank loan, assembling miniature picture frames. Our first retail store wasn't much bigger than most people's living rooms, but we had faith that we would succeed if we lived and worked according to God's word. From there, Hobby Lobby has become one of the nation's...

In an effort to intimidate states (that is, Republican governors) into setting up state-run ObamaCare exchanges, the leftist authors of the Affordable Care Act have opened the door to lawsuits which could prevent the federal government selling health plans at affordable rates. A centerpiece of the ACA involves the offering of federal subsidies “…designed to help low and middle-income individuals purchase health insurance.” However, as the Act clearly states, “…subsidies may only be applied to insurance exchanges set up by individual states, not exchanges implemented by the federal government.” Congress also denied federal exchanges the authority to provide tax credits...

Okay here's an idea. Forget about paying for the contraceptives for those brash, "busy",child-bearing years, whiny 50 and under, female crowd. Hire the workplace experienced, life-experienced, in-need-of-employment over 50 crowd. We are, after all, the ones that need our social security paid for. We might need more time off due to arthritis and aches and pains, but at least the medication for those discomforts aren't against the consciences of businesses. Males young and old would be a good choice, too. Haven't heard them whining about having to pay for "birth" control.

A group of Reps. led by Barbara Lee (D-CA) is asking Obama to extend healthcare coverage to the children of illegal immigrants for whom he waived deportation months before the election. These "DREAMers" -- so-called because they are recipients of a de facto DREAM Act -- are "not eligible for Medicaid, the Children's Health Insurance Program, or federal subsidies provided under [Obamacare]." The waiver of deportation was known as the Deferred Action for Childhood Arrivals (DACA), and Democrats are now saying it simply does not go far enough. According to Reps. Lee, Judy Chu (D-CA), Zoe Lofgren (D-CA), Lucille Roybal-Allard...

Affordable Care Act is in full swing, there’s a lot of apprehension and perhaps, sometimes, enthusiasm about what is truly in store for the medical profession. The last time you visited your doctor you may have noticed that he or she was more apprehensive, cautious, and yes, maybe more overwhelmed. The fact of the matter is that the health care profession is undergoing the most significant renovation to ever happened in the history of the United States. Here are many things that keep many doctors awake at night:

This election season brought out some of the more bizarre behavior we’ve seen from corporations across the country. Having unlimited access to candidates through unlimited campaign contributions wasn’t enough. Some CEO types got on bully pulpits to blast the president and his health care plan before the election. Some of that rhetoric was over the top. Some of it could have been illegal. Papa John’s CEO John Schnatter warned that he would raise his pizza prices from 15 cents to 20 cents per order to pay for Obamacare, which could bring the third largest pizza delivery operation in the U.S....

A light had been flicked on in the four-bed ward and someone shouted out “anybody for breakfast?” just moments before he died., Ms Clwyd said. She painted a picture of nurses who treated her husband with “coldness, resentment, indifference and even contempt"

Item One: Obama-friendly retailer issues special dividend to avoid Obama tax increase... Late last week, Sinegal and the rest of the Costco Board of Directors voted to pay shareholders a special $7 per share dividend to avoid higher dividend taxes that are scheduled to go into effect on January 1, 2013. As the Wall Street Journal notes... That’s a $3 billion Christmas gift for shareholders that will let them be taxed at the current dividend rate of 15%, rather than next year’s rate of up to 43.4% — an increase to 39.6% as the Bush-era rates expire plus another 3.8%...

Those who thought ObamaCare was set in concrete by Chief Justice John Roberts' decision last June are in for a shock. December 14 is the new deadline (extended from November 16) for states to let the feds know, yea or nay, whether or not they will be setting up a health insurance exchange, which is the key to participating in the misnamed Patient Protection and Affordable Care Act. Obama's belief that the public would warm up to his signature legislation once it became the law of the land has proven false. The current Kaiser Family Foundation poll reports that only...

The Olive Garden, Red Lobster and LongHorn Steakhouse parent lowered its profit and revenue projections for the quarter ended Nov. 25, blaming sour promotions in its eateries, Superstorm Sandy, its purchase of the Yard House USA chain and even its efforts to mitigate the coming costs of healthcare reform, also known as "Obamacare."

A vote to report a state Obamacare exchange bill out of the Michigan House Health Policy Committee came up short yesterday, with only two Republicans supporting it (Committee Chair Rep. Gail Haines of Waterford and Rep. Mike Callton of Nashville). Following the vote, House Speaker Jase Bolger, R-Marshall, declared the state-run exchange dead, saying: “…After due diligence, however, it is clear that there were too many unanswered questions for the committee to feel comfortable with a state-run exchange and we will not have one in Michigan… The committee apparently was not able to get the answers to key questions or...
