Rep. Andy Gipson - New Gun Law Reflects Constitutional Principle

As a lawyer/lawmaker, I respect the rule of law in our nation, and I took an oath to defend and uphold the Constitution. The law is designed to encourage good conduct and deter wrongful conduct. It’s not intended to criminalize law-abiding citizens simply exercising their constitutional rights. Unfortunately, laws can be interpreted in ways that are contrary to these principles. Under prior interpretations of Mississippi’s firearms laws, law-abiding people – even “concealed carry” permit holders-- could be charged for breaking the law simply by carrying a lawful pistol or revolver in a holster. House Bill 2 becomes effective July 1,...

Would Open Carry of Handguns Make You Feel Safer?

A few days ago we asked if you would feel safe going into a business that had a sign that read “Guns are welcome on premises, please keep all weapons holstered unless need arises. In such a case judicious marksmanship is appreciated.”1,524 of you replied and the comments below are representative of what most of you had to say about this issue: BEST COMMENT – Here’s the thing with the people who believe it would be unsafe.
FL:Constitutional Challenge to Prohibition of Open Carry

A Florida constitutional challenge to their open carry ban is going forward. On 19 February, 2012, Dale Norman, who had recently been issued a concealed carry license, was arrested for openly carrying a firearm in a holster on his hip. The weight of the pistol had caused his shorts to sag, exposing part of the pistol, attracting the attention of at least one member of the public, who brought it to the attention of the police, who arrested Mr. Norman. The court found Mr. Norman guilty, but refused to rule on several constitutional issues. 1. Is Florida’s statutory scheme...

AZ:Yuma Open Carry, Sheriff Dept, honk and a friendly wave

I was out running this morning (missed a session yesterday covering the Phoenix Gun Turn in). I was open carrying, a habit I picked up during Desert Storm back in the 90's in Arizona, not the sandbox. While running, I heard a short honk. I turned to see a Yuma Sheriff's Dept. truck going by and caught a friendly wave from the deputy. Nice to be trusted by peace officers. In my experience, Sheriff departments are very supportive of armed citizens. Dean Weingarten

Michigan Dad Decides to Open Carry .45-Cal. Handgun at His Daughter’s School

Seeking to make a point about firearms, a Michigan man decided to open carry his .45-cal. handgun at his daughter’s school and later uploaded the footage to YouTube. The father says he made sure to first notify the school, the Michigan State Police, the county sheriff and other local law enforcement officials that he would be exercising his right to carry a gun. The man behind the video told TheBlaze on Wednesday that he was not legally required to alert police or school officials that he would be carrying a gun.
AR:Constitutional Carry will be the Law in Arkansas

On 4 April, 2013, Arkansas HB1700 became ACT 746. The revised law will not go into effect until late July or early August of this year. The bill makes a definition change in the statute that has been interpreted to limit the legal carrying of weapons in Arkansas. The original language was this:A person commits the offense of carrying a weapon if he or she possesses a handgun, knife, or club on or about his or her person, in a vehicle occupied by him or her, or otherwise readily available for use with a purpose to employ the handgun,...

Alabama Senate passes bill allowing free, lifetime permit to carry pistols in vehicles (updated)

MONTGOMERY, Alabama --- The Alabama Senate passed a bill today that would allow for free, lifetime permits to carry pistols in vehicles and that would make other changes to state gun laws. The bill passed after hours of debate and a parade of amendments, some of which were approved. It now moves to the House of Representatives. Those who received a permit to carry in their vehicles would have to undergo a background check and the permits would be revocable if, for example, the permit holder committed a crime, said Sen. Scott Beason, R-Gardendale, the bill’s sponsor. Under current law,...

Updated: March 20, 2013 A Senate panel has passed a bill that would allow people to carry guns in public in South Carolina without a concealed weapons permit. Supporters of the open carry bill said Wednesday it still needs some more work to make sure there aren't any loopholes. They plan to tweak the bill when it goes before the Senate Judiciary Committee next month. Currently, anyone who wants to carry a gun in public has to have a permit and keep it concealed. It takes at least eight hours of training to get permission to carry a concealed weapon....

Fourth Circuit gets it right on Open Carry

Does Open Carry, in an Open Carry state, give police a reasonable articulable suspicion that a crime is occurring? Cops can’t just stop you, frisk you, or demand identification from you. Terry v. Ohio decided that a police officer must have “reasonable suspicion that the person has committed, is committing, or is about to commit a crime and has a reasonable belief that the person “may be armed and presently dangerous” before he can detain you. But does that change if you’re hanging out with a person who openly carries a firearm?

In spite of the enormous push for more infringements on citizen’s Second Amendment rights by the old media and their “progressive” legislative allies, several states continue to work toward restoring rights lost in the last century’s growth in governmental power. South Dakota, South Carolina, Utah, Georgia, Montana, and Nevada all have bills pending that would implement Constitutional, or permitless carry. Utah is the most likely to pass a measure into law first, as veto proof majorities have already passed a bill. It only needs Governor Herbert’s signature to become law.
During a brief address Saturday (March 9) in Benton County, Rep. Sue Scott, R-Rogers, discussed a plan to revive an amended version of her open-carry measure, House Bill 1408. The amended bill, which she referred to as a “baby step,” would protect those with a concealed-carry permit if their firearm inadvertently becomes exposed, as when the wind blows a jacket open, in unincorporated areas, she said. The amended version is expected to be heard Tuesday in the House Judiciary Committee, Scott said.

But many, possibly apprehensive to offend customers, have decided to wait and see if open carry becomes an issue first. Business owners have the right to control the presence of guns on their premises and it appears many are treading carefully since the open carry law went into effect Nov. 1. Signs banning, or welcoming, legal firearms are not widespread. Business owners face a difficult decision: if they ban firearms, will they alienate pro-gun customers? But if...
